About this file

This document contains questions and answers regarding a solicitation for ramp replacement projects at two buildings at a Department of Veterans Affairs medical center. The solicitation is set aside for certified service-disabled veteran-owned small businesses and requires that at least 85% of the contract value, excluding materials, be performed by SDVOSB subcontractors certified in the SBA database. The maximum EMR listed in the instructions is a hard threshold for responsiveness. Phase I of the proposal does not involve pricing and the design-build specification should be referenced for Phase I response requirements. The solicitation seeks to replace ramps at Buildings 12 and 16 under Project 658-23-103 with a performance period and pricing to be determined.

Question & Answer Ramp Replacement Building 12 &16 Project Number: 658-23-103 Solicitation Number: 36C24623R0059

1. Please clarify the subcontracting requirements identified in Para 4.15 ii. Confirm that 85% of the value of the project, not including material costs, shall be performed by SDVOSB Subcontractors. If the SDVOSB General Contractor is not self-performing the work, subcontractors shall be SDVOSB Certified. – VA response Yes Additional questions

2. Solicitation page 43 says 85% limit on subcontracting identifying this as a General Contract, page 10 says 75%, identifying this as a trade contract. Please clarify which controls. – General construction. In the case of a contract for general construction, the contractor will not pay more than 85% of the amount paid by the government to it to firms that are not certified SDVOSBs listed in the SBA certification database as set forth in 852.219-73 or certified VOSBs listed in the SBA certification database as set forth in 852.219-74. Any work that a similarly situated certified SDVOSB/VOSB subcontractor further subcontracts will count towards the 85% subcontract amount that cannot be exceeded. The cost of materials is excluded and not considered to be subcontracted.

3. Instructions to Offers Paragraph A states a maximum EMR of 1.0. Please clarify if this is a hard limit to render the offer nonresponsive, or an evaluation factor which may be used as part of an evaluation of an offeror. – Please follow the instructions, conditions, and other statements to bidder/offerors on page nine (9).

4. The solicitation clearly refers to a Phase I and Phase II proposal. However, we are unable to determine the contents of the Phase I proposal, as the solicitation only indicates filling in an offer. Given the description on the face of the solicitation document, we infer that there would be a separate submission for Phase I which does not involve pricing. Please clarify the Phase I response requirements. – See 4.29 Design Build Specification
