STATEMENT OF WORK
Contractor to supply all material and labor for renovation and installation of AHUs listed below, all associated demolition, trash/debris removal, parts, materials, and equipment are the responsibility of the contractors and shall be executed per division 002. All demolition shall be performed without degradation to the remaining items and structures. new ahus shall be installed per local, state, and federal code requirements. contractors shall adhere to division 001 for general requirements, safety, schedule, quality control, environmental management, shop drawings, testing, construction waste management, and sustainable construction requirements.
All AHUs selected for replacement shall be designed per the VA specifications, design guide, infection control guidelines, NFPA / life safety code and NEC. All new controls for AHUs will be Siemens controls. tab must be completed on all buildings for chill water.
An estimate for this work is provided for the project. the estimate includes temporary air handling units, crane services, curbs for RTUs, concrete pads for AHUs, and controls. the estimate is based on utilizing a generator whenever a temporary ahu is required the estimate includes Siemens controls and new control panels. The VA requested fire alarm updates to the workstation with all the AHU replacements.

THIS SECTION IS FOR SOLICITATION PURPOSES ONLY. THIS SECTION WILL BE PHYSICALLY REMOVED FROM ANY RESULTANT AWARD BUT WILL BE DEEMED INCORPORATED BY REFERENCE.
(a) GENERAL INSTRUCTIONS:
1. All proposal preparation cost will be the sole responsibility of the Offeror. The Government will not reimburse any firm for their proposal preparation cost.
2. The price, technical response and past performance of each Offeror will be evaluated independently. Offerors shall separately document each of the three factors. Each of the three offer sections shall therefore be labeled with the Offerors name, business address, and VA Solicitation Number.
3. To assure timely and equitable evaluation of proposals, Offerors must follow the instructions contained herein. Offerors are required to meet all solicitation requirements, including these instructions, the terms and conditions, representations and certifications, and technical and past performance requirements. Failure to meet a requirement may result in an offer being ineligible for award. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale.
The offer shall consist of three (3) separate parts:

• Part II – PAST PERFORMANCE
• Part III – PRICE

In accordance with VHA Directive 7715, Safety and Health During Construction, the offeror shall have no more than three (3) serious, or one (1) repeat or one (1) willful OSHA or any EPA violation(s) in the past three years, and a current Experience Modification Rate (EMR) equal to or less than 1.0. Offeror shall provide (1.) completed OSHA Form 300A for the three (3) year period, (2.) a memorandum statement regarding OSHA and EPA violations, and a (3.) letter from their worker’s compensation insurer disclosing their Experience Modification Rate (EMR) rating. Documentation submitted with the offer must be complete and must demonstrate compliance to be considered acceptable.

a. Past Performance Questionnaires: The contractor shall send out the attached past performance questionnaires to each of their references listed under the Corporate Experience technical factor or any other references that the Offeror deems necessary. The Government will evaluate the quality and extent of Offeror’s performance deemed relevant and recent to the requirements of this solicitation.
b. The references must return the survey directly to the Government Contracting Officer listed on the survey, via email, by the due date for proposals.

a. Complete the SF 1442, Blocks 14, 15, 17, 19, 20A, 20B, 20C and 30. An official having the authority to bind your company contractually must sign and date the SF 1442 Block 30b. One copy of the SF 1442 must bear an original, authorized signature. In doing so, the Offeror accedes to the contract terms and conditions as written in the RFP. All sections of the RFP, excluding Instructions to Offerors and Evaluation Procedures Sections, constitute the model contract.
b. Complete the PROPOSAL ITEM LIST. As part of their proposal, each Offeror shall be required to complete the attached Base Proposal Item Price Breakdown Form. (Solicitation Attachment D)

(c) GENERAL INFORMATION
1. Format for proposal Part I & II shall be as follows:
a. A page is defined as one face of an 8 ½” x 11” sheet of paper containing information.
b. Typing shall not be less than font size 11.
2. DESCRIPTION OF WORK: Contractor shall provide all labor, materials, tools, equipment, and qualified supervision for the replacement of Air Handler Units of Multiple Buildings at the VA Medical Center Salisbury, NC, for project titled 659-22-104, AHU Replacement.
MAGNITUDE OF CONSTRUCTION: Between $5,000,000 and $10,000,000.

SELECTION CRITERIA: Technical Capability, Past Performance, and Price will be the evaluation factors utilized to determine the successful proposal. All evaluation factors other than price, when combined, are significantly more important than price alone.
SDVOSB SET-ASIDE AND REQUIRED REGISTRATION AT VETBIZ: This procurement is 100% set-aside for Service-Disabled, Veteran-Owned Small Business (SDVOSB). Offers are solicited only from SDVOSB concerns and offers received from concerns that are not from SDVOSB concerns shall not be considered. See FAR Clause 52.219-27, VAAR Clause 852.219-10 and 804.1102. All SDVOSB must be certified by the Center for Veterans Enterprise (CVE) at www.vetbiz.gov, to be eligible to participate.
TUBERCULOSIS PRE-CONSTRUCTION RISK ASSESSMENT: In accordance with VHA Directive 2011-036, CEOSH Construction Safety Guidebook, 2012 1.1.1 VHA Policy, CDC 2005 Guidelines for Preventing the Transmission of Mycobacterium tuberculosis in Health-Care Settings.
(a) The contractor must provide written certification that all contract employees assigned to the work site have had a pre-placement tuberculin screening within 90 days prior to assignment to the worksite and have been found to have negative TUBERCULOSIS screening reactions. Contractors will be required to show documentation of negative TUBERCULOSIS screening reactions for any additional workers who are added after the 90-day requirement before they will be allowed to work on the work site.
NOTE: This can be the Center for Disease Control (CDC) and Prevention and two-step skin testing or a Food and Drug Administration (FDA)-approved blood test.
(b) Contract employees manifesting positive screening reactions to the tuberculin must be examined according to current CDC guidelines prior to working on VHA property.
(c) Subsequently, if the employee is found without evidence of active (infectious) pulmonary TUBERCULOSIS, a statement documenting examination by a physician must be on file with the employer (construction contractor), noting that the employee with a positive tuberculin screening test is without evidence of active (infectious) pulmonary TUBERCULOSIS.
(d) If the employee is found with evidence of active (infectious) pulmonary TUBERCULOSIS, the employee would require treatment with a subsequent statement to the fact on file with the employer before being allowed to return to work on VHA property.
RESIDENT ENGINEER: All reference to "Resident Engineer" and “Contracting Officer’s Technical Representative” in the solicitation/specifications and drawings will be changed to "Contracting Officer’s Representative".
GENDER: Wherever masculine gender is used in the solicitation and contract documents, it shall be considered to include both masculine and feminine.
CONTRACTOR RESPONSIBILITY: Contractor shall be required to complete all contract work and schedule a final inspection within the specified contract performance period. Should the Contractor fail to complete the contract work (including scheduling of the final inspection), and it is determined by the Government to be a Contractor-caused delay, the Contractor shall be in default status. If the Government determines it to be in the best interest of the Government to allow the Contractor to continue to perform contract work, the Contractor shall provide equitable consideration to the Government for additional time granted for completion of contract work. Such agreement shall not be deemed a waiver of the Government’s right to terminate this contract in the event the Contractor fails to complete the contract work (including scheduling of the final inspection) on or before the completion date.
TRAINING: Effective July 1, 2005, all employees of the general contractor and subcontractors shall have the 10-hour OSHA certified construction safety course and/or other relevant competency training, as determined by the COTR with input from the ICRA (Infection Control Risk Assessment) team. The General Contractor’s competent person shall have completed the 30-hour OSHA certified construction safety course. Documentation of training shall be submitted to the Contracting Officer for review and approval prior to any work being performed. There shall be no exceptions to this requirement.
KEYS: All keys provided the Contractor for use during the project shall be returned to the Contracting Officer's Representative (COR) at completion of the work or upon request. No keys shall be reproduced by the Contractor. There shall be a charge of $10.00 for each key that is lost or not returned to the COR. Payment shall be made to the VA Medical Center, Salisbury, North Carolina upon receipt of a Bill of Collection.
PREPARATION OF BIDS/OFFERS/PROPOSALS: Neither the VAMC nor the NCO 6 CAS will pay for any costs incurred in preparation and submission of bids or proposals.
PRIVACY AND CONFIDENTIALITY: Contractors to the Department of Veteran Affairs may be unintentionally exposed to sensitive information. Information may be overheard, seen on documents or electronic devices, or observed that could potentially violate the privacy and confidentiality of our veterans, employees, volunteers, and their families. Regulations such as, but not limited to the Health Insurance Portability and Accountability Act of 1996 (HIPAA), Freedom of Information Act (FOIA) and Privacy Act of 1974 have been enacted to protect sensitive information from being improperly disclosed. Information should not be divulged or released to anyone unless specifically authorized by this contract or its’ attached documents in accordance with the contracted services. Failure to comply with applicable statutes and regulation can result in the termination of this contract and civil and criminal penalties, including fines and imprisonment. All suspected or actual breeches of privacy and confidentiality should be reported immediately to the Contracting Officer, Contracting Officer’s Representative (COR) or the Facility Privacy Officer.
NOTE: All computer connections will be made by VA personnel. The contractor will not have access to IT equipment rooms in general. When access is required for cable pulling, etc., the contractor shall be accompanied by a member of Facility Management Service or OI&T staff during the entire tenure of the access. Requirements for this access will be minimal.
VETS 100: Title 38, USC Section 4212(d) and Public Law 105-339, requires that federal contractors report, at least annually, the number and category of veterans who are within their workforce. Submission of the VETS 100 reporting information can be done electronically at: http://www.dol.gov/vets/vets100filing.htm. Award cannot be made unless the awardee has filed their VETS 100 report. Therefore, all bidders/offerors are encouraged to file every year.
SYSTEM FOR AWARD MANAGEMENT (SAM): Federal Acquisition Regulations require that federal contractors register in the System for Award Management (SAM) database at http://www.beta.sam.gov and enter all mandatory information into the system. Award cannot be made until the contractor has registered. Contractors are encouraged to ensure that they are registered in SAM prior to submitting their bid.
CONTRACTOR NORMAL WORK HOURS: The contractor work hours are from 8:00 am to 4:30 pm, Monday through Friday, excluding federal holidays. Federal holidays that fall on a non-work day –Saturday or Sunday-the holiday usually is observed on the Monday if holiday in on Sunday or on Friday if holiday is on Saturday. If the contractor desires to work an alternate schedule or on holidays a written request must be furnished to the COR. All federal holidays are observed as non work days. Federal holidays can be found on the following web site: http://www.opm.gov/policy-data-oversight/snow-dismissal-procedures/federal-holidays/#url=2013. These days will be identified during preconstruction.
A Determination of Responsibility will be accomplished for the apparent awardee prior to processing the award. The above information, along with other information obtained from Government systems, such as the OSHA and EPA online inspection history databases will be used to make the Determination of Responsibility. Failure to affirm being within the guidelines above or submit this information will result in a determination of “Non-Responsibility” for the bidder/offeror. NOTE: Any information received by the Government that would cause for a negative Determination of Responsibility will make the bidder/offeror ineligible for award.
This requirement is applicable to all subcontracting tiers, and prospective prime contractors are responsible for determining the responsibility of their prospective subcontractors.
2.1 EVALUATION FACTORS FOR AWARD

(a) The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(b) BASIS FOR CONTRACT AWARD: This is a competitive Best Value Tradeoff (Tradeoff) source selection in which technically acceptable competing Offerors will be assigned a Past Performance Confidence Assessment Rating and will then be evaluated for Price fairness and reasonableness. All evaluation factors other than price, when combined, are significantly more important than price alone. The government reserves the right to award a contract to other than the lowest priced offer if the lowest priced Offeror is determined to have a performance confidence assessment of "Satisfactory Confidence" or lower. In that event, the Source Selection Authority shall make an integrated assessment best value award decision, where the perceived benefits of the higher priced proposal, and the rationale for tradeoffs, shall be documented in the contract file in accordance with FAR 15.406.
(c) By submission of its offer, the Offeror accedes to all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements. Failure to meet a requirement may result in an offer being determined unacceptable. The evaluation process shall proceed as follows:
PART I – TECHNICAL CAPABILITY
Offers will first be evaluated for responsiveness to the solicitation requirements, by the Contracting Officer, without regard to evaluation of specific technical capability, past performance or price factors. Exchanges may occur to identify/confirm missing documentation and a determination will be made regarding whether the Offeror should/can be allowed to submit any missing/deficient documentation. Responsive offers will be provided to the Technical Evaluation Board (TEB) for the next evaluation stage. The technical capability of all offers will be evaluated on strengths and weaknesses. General Qualifications, Corporate Experience, Key Personnel Qualifications, Quality Control Plan sub-factors will be evaluated equally.
NOTE: Offerors that do not receiving ratings of Satisfactory or higher for all technical sub-factors will not be evaluated for Past Performance and will not be considered for award (i.e., fail to meet minimums as defined by attached Specifications). General Qualifications, Corporate Experience, Key Personnel Qualifications, Quality Control Plan sub-factors will be weighted equally, and all areas must have SATISFACTORY rating or better. The Technical capability sub-factors ratings of SATISFACTORY or better will be required in order to be considered for award.

b. Project owner and name and telephone number of owner’s contact person.
c. Indicate your firm’s role as a prime contractor or subcontractor, etc.
d. Project Prime Contractor and Major Subcontractors and name and telephone number of contact person(s).
e. Project Statistics including start and completion dates (original vs. actual) for design and construction; cost (with brief explanation of what is included in the cost); square footage; and any awards (prizes) received.
f. Confirmation that the prime contractor and subcontractors are licensed for the work being performed in the state where the project is located, where specified, or otherwise in the state from which the contractor or subcontractor originates. Work requiring license in the State of North Carolina includes all Contractors, HVAC, Plumbing, Electrical work, and Asbestos/lead Project Monitoring.

1. CRITERIA: Offeror must provide a plan to implement the requirements of Contract Clause 52.246-12, Inspection of Construction, and specifications. The plan shall identify personnel, procedures, control, and instructions. A finalized, more detailed Quality Control Plan (QCP) will be required to be submitted and approved after contract award, which include the identification of all contract submittals, tests, records, and forms.
2. MINIMUM STANDARD OF ACCEPTABILITY: The minimum standards of acceptability are met when the Offeror provides:
a. A description of the quality control system, including a chart showing lines of authority and acknowledgement that the Quality Control (QC) Manager shall implement the three-phase control system for all aspects of work specified. The Quality Control Manager shall report to the project manager or someone higher in the Contractor’s organization. Project Manager in this context shall mean the individual with responsibility for the overall management of the project including quality and production. The proposal provides a Quality Control approach that effectively addresses the internal processes to identify and prevent deficiencies in the quality of construction. This approach shall also show the plans for implementation ensuring the compliance of regulatory and Specification statutes are strictly adhered to. The approach shall also clearly address the QC organizational lines of authority and the Offeror’s approach to monitor corrective actions ensuring successful and timely problem resolution. The detailed QC approach shall identify how quality inspections will meet the minimum requirements of the Specifications. The QCP shall effectively address how the Offeror will correct identified discrepancies found during QC checks and the process to provide resolution to the CO/COR for any discrepancies identified in the Specifications or design. The QCP shall include the Offeror’s method for identifying subcontractors to meet the specific requirements of all trades specifications included in the project, see each specification section for QC details.
PART II – PAST PERFORMANCE
Next, the Government will evaluate the Offeror’s demonstrated past performance of recent and relevant projects for those Offerors that received Satisfactory or better technical ratings for all technical sub-factors, in order to determine the Offeror’s ability to perform the contract successfully and help determine responsibility. Past performance information shall include, but not be limited to: evaluation of past performance of the firm having experience in construction or renovation of hospitals, quality, timely performance, management effectiveness, and safety. An overall Past Performance Confidence Assessment Rating will be assigned, but each past performance reference will first be evaluated for “recency” and “relevancy”. Therefore, the following ratings tables will be used. “Recent” past performance is defined as projects completed within the last five years, from the date of issuance of solicitation. Past Performance references meeting the “minimum threshold” criteria, but not related to hospital renovations, will be rated “Somewhat Relevant”. Past Performance references meeting the “minimum threshold” criteria, which included hospital renovations will be assigned a relevancy rating based on the below rating definitions, with regard to the tasks outlined in the Specification of similar scope and complexity.

Past Performance of subcontractors may be used, but future unavailability of the subcontractor to perform work may result in contract termination.
B. EVALUATION AND PERFORMANCE CONFIDENCE ASSESSMENT RATING: The Government will consider and evaluate the Offeror's past performance information, to include the completed past performance questionnaire surveys and the Past Performance Information Retrieval System (PPIRS), which are deemed recent and relevant for the requirements of this RFP, including evaluation of the Offeror’s adherence to period of performance/time of construction and construction according to contract specifications and design without deficiencies. The Government may also use information submitted by the Offeror, to included references, and other sources such as other Federal Government offices to include the Past Performance Information Retrieval System (PPIRS), and commercial sources, to assess performance. “Recent” past performance is defined as projects completed within the last five years, from the date of issuance of solicitation.
C. Relevance ratings and Performance Confidence Assessment ratings will be assigned, as defined in the above tables.
NOTE: The contractor shall send out the attached past performance questionnaires (Solicitation Attachment) to each of their references listed under the Experience technical factor or any other references that the Offeror deems necessary.
