STATEMENT OF WORK (SOW)

Project # 561A4-18-101 Replace Central Chillers Building 136 5/18/2023

1. Contract description.

Project is to provide the Lyons VA Medical Center (VAMC) with 2 new centrifugal chillers, 5 new variable speed pumps, and 4 new rooftop exhaust fans at building 136, Central Chiller Plant.

2. Background.

Project is necessary to update and replace two Chillers and associated equipment that are located in Building 136 at the Lyons Campus. The existing chillers are both past their useful life expectancy.

3. Scope.

This project will remove and replace 2 existing chillers, 5 existing pumps and 4 existing exhaust fans at the Lyons VAMC central chiller plant. By the end of construction, the Lyons VAMC should have the following new pieces of equipment:

· 1 new 700-ton centrifugal chiller (Chiller #2)

· 1 new 1,000-ton centrifugal chiller (Chiller #3)

· 3 new secondary chilled water pumps (pumps # 4, 5 and 6)

· 2 new condenser water pumps (Pumps # 8 and 9)

· 4 new roof mounted exhaust fans (Fans # 1, 2, 3 and 4)

· 1 new automatic transfer switch (ATS #8)

· 1 new manual transfer switch (MTS # 8)

· 2 new pad-mounted transformers (Transformer #5 and 6)

4. Specific Tasks.

A. Site Civil Work to include but not limited to:

· The extent of work includes but is not limited to, trenching and backfilling for new underground electrical, pouring new concrete pads for transformers # 5 and 6, installing new steel stanchions for above grade conduit support and restoring the site to its original conditions.

B. Structural work to include but not limited to:

· The extent of work includes pouring two new 4” thick concrete housekeeping pads for chiller #3 and ATS #8, restoring existing equipment pads and skids due to age, creating new penetrations in the exterior wall to allow entrance of new conduit into the building and providing a new 0.5-ton gantry to help in cleaning the basket strainers at the condenser water pumps.

C. Mechanical work to include but not limited to:

· Remove and replace existing chillers #2 (700-ton Carrier absorption chiller) and #3 (1,000-ton Carrier centrifugal chiller) with new centrifugal units. The new chillers are scheduled to be frictionless bearing type (magnetic bearing compressors) to provide the highest efficiency possible and to eliminate the need for oil which cuts down on maintenance required. The new chillers are selected and designed to operate at AHRI 550/590 standards:

· Chilled water temperature entering the Evaporator (Cooler): 54℉

· Chilled water temperature leaving the Evaporator (Cooler): 44℉

· Condenser Water temperature entering the condenser: 85℉

· Condenser Water temperature leaving condenser: 94.3℉

· For controls, the plan is to integrate the new chillers into the existing building management system (BMS) via a IonWorks open communication protocol. Each willer will be furnished with a set of marine water boxes on the evaporator and condenser section respectively.

· Replacement for pumps # 4, 5,6, 8 and 9 and rooftop exhaust fans #1, 2, 3 and 4. Plan is to remove and replace each pump and fan with an in-kind model. Each unit is selected to provide the highest efficiency possible at their operating conditions. Additionally, each new pump will receive a variable frequency drive (VFD) to enhance overall efficiency. All new pumps and exhaust fans are to be tied into the existing BMS and remain on the same control sequence currently in use.

D. Electrical work to include but not limited to:

· For the new chillers the plan is to provide each unit with a new 480V/3PH electrical service. For chiller #2 this will be achieved by suppling a new pad mounted transformer (transformer #5), a new automatic transfer switch (ATS #8), and a new manual transfer switch (MTS#8). The existing 4,160 volts electrical service will be supplied from the substation breaker L2 and will be fed to transformer #5, where it will step down to 480 volts. From there the service will continue to ATS #8, where two 480V feeds will be supplied; one feed will go to Chiller #2 and one will go back to MTS #8. Chiller #3, the design plan is similar except the only new addition will be a pad mounted transformer (transformer #6) to be fed from the existing ATS #2. Both chillers will have primary power from the existing substation and emergency power from the existing generators.

· New pumps will keep the existing power wiring from the main switchgear and only replace the existing conduit and wire from the switchgear, back to their respective disconnect switch. This will be required to install the new VFD, that each pump motor will receive. All new motors are scheduled to match existing voltage and horsepower to minimize overall change to existing system.

· New roof mounted exhaust fans will keep the existing power wiring up to the roof and to extended it as required to the new fan. Each new fan should receive a new disconnect switch.

E. Energy Efficiency

· Replacement chillers #2 and 3 should meet ASHRAE 90.1 and AHRI 550/590 requirements for energy efficiency. Each chiller will be provided with an integral VFD starter. As for pumps (#4, 5,6, 8 and 9) each one is schedule to come with a VFD for enhanced efficiency.

F. Tie-In Points (Electrical, HVAC, Plumbing, Fire Protection, Etc.)

· All Tie-in points are to be reviewed by the VA FMS staff and respective VA shop supervisors or designated shop appointee.

G. Asbestos/ Hazardous Materials

· There is a small amount of asbestos containing material (ACM) in the flashing for the rooftop exhaust fans. Contractor to abate per specifications.

H. Further information- for furthermore in-depth instructions, refer to the specifications and Construction drawings.

5. Performance Monitoring (if applicable).

Work shall be coordinated with facility thru the Contracting Office Representative (COR). COR will monitor the contractor work performance on daily basis and the contractor is required to submit daily’s progress report to the COR. Contractor submission requirements

· Daily logs are due daily but at the latest Monday following the completion of the work week.

· Project Managers and Supervisors from the selected contractor are to attended weekly or bi-weekly meetings. Timeframe to be determine by COR based on contractor performance.

· Certified payroll to be submitted weekly/biweekly depending on payroll frequency.

6. Security Requirements.

General Contractor’s employees shall not enter the project site without appropriate security badge. They may also be subject to inspection of their personal effects when entering or leaving the project site.

No photography of VA premises is allowed without written permission of the Contracting Officer except as specifically required by the scope of the work.

VA reserves the right to close or shut down the project site and order General Contractor’s employees off the premises in the event of a national emergency. The General Contractor may return to the site only with the written approval of the Contracting Officer.

e. Inspection and Acceptance Criteria.

The COR is responsible for certifying that the work done under the contract is performed to time and standard. They are also responsible to assure the inspection and acceptance of products provided incidental to services.

9. Risk Control Contractor shall take all measures for safety & infection control and provide all material necessary for protecting existing equipment and property in affected areas of construction against dust and debris, so that equipment and affected areas to be used in the Medical Centers operations will not be hindered.

Contractor shall permit access to Department of Veterans Affairs personnel and patients through other construction areas which serve as routes of access to such affected areas and equipment. Coordinate alteration work in areas occupied by Department of Veterans Affairs so that Medical Center operations will continue during the construction period.

10. Place of Performance.

Minimize interference of construction activities with flow of Medical Center traffic, keep roads, walks and entrances to grounds, to parking and to occupied areas of buildings clear of construction materials, debris and standing construction equipment and vehicles.

11. Period of Performance.

Contractor to start immediately after receiving the NTP, estimate completion time is 365 calendar days.

(b) If bid exceeds $150,000 a bid bond must be submitted. A bid guarantee is required in an amount not less than 20 percent of the bid price but shall not exceed $3,000,000. 2.1 52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO SURVEILLANCE SERVICES OR EQUIPMENT (NOV 2021) The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it ‘‘does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument’’ in paragraph (c)(1) in the provision at 52.204–26, Covered Telecommunications Equipment or Services—Representation, or in paragraph (v)(2)(i) of the provision at 52.212–3, Offeror Representations and Certifications–Commercial Products and Commercial Services. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it ‘‘does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services’’ in paragraph (c)(2) of the provision at 52.204–26, or in paragraph (v)(2)(ii) of the provision at 52.212–3.

(a) Definitions. As used in this provision— Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204–25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition. (1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115–232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to—

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

2.3 52.222-5 CONSTRUCTION WAGE RATE REQUIREMENTS—SECONDARY SITE OF THE WORK (MAY 2014) (a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Construction Wage Rate Requirements, of this solicitation.

(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.

(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.

(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.

2.4 52.225-10 NOTICE OF BUY AMERICAN REQUIREMENT—CONSTRUCTION MATERIALS (MAY 2014)

(a) Definitions. "Commercially available off-the-shelf (COTS) item," "construction material," "domestic construction material," and "foreign construction material," as used in this provision, are defined in the clause of this solicitation entitled "Buy American—Construction Materials" (Federal Acquisition Regulation (FAR) clause 52.225-9).

(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.

(c) Evaluation of offers.

(1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR 52.225-9.

(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.

(d) Alternate offers.

(1) When an offer includes foreign solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.

(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR 52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.

(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested—

(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or

(ii) May be accepted if revised during negotiations.

2.5 52.228-1 BID GUARANTEE (SEP 1996)

(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.

(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States. The Contracting Officer will return bid guarantees, other than bid bonds—

(1) To unsuccessful bidders as soon as practicable after the opening of bids; and

(2) To the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.

(c) The amount of the bid guarantee shall be 20% percent of the bid price or , whichever is less.

(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.

(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.
