About this file
This is a Pennsylvania Commonwealth contract template for services, specifically applicable to a Bridge Engineering Software Services opportunity. The contract is executed between the Commonwealth of Pennsylvania, acting through the designated Agency, and the selected Contractor following a competitive Request for Proposals (RFP) process. The Contractor's proposal was determined to be the most advantageous to the Commonwealth based on evaluation factors outlined in the RFP, and the selected Contractor shall provide engineering, computer software support, and computer software development services as detailed in the RFP, Final Negotiated Technical Proposal, and the Contractor's Technical Submittal.
The contract establishes a comprehensive order of precedence for all contractual documents, including the Contract Terms and Conditions, Final Negotiated Technical Proposal, Cost Submittal, Small Diverse Business (SDB) Submittal, Veteran Business Enterprise (VBE) Submittal, Diverse Business (DB) Submittal, the RFP with all appendices and addenda, and the Contractor's Technical Submittal. The Contractor is obligated to meet and maintain commitments to small diverse businesses, veteran business enterprises, and diverse businesses as outlined in their respective submittals, with quarterly utilization reporting required through the Department of General Services' Bureau of Diversity Inclusion and Small Business Opportunities (BDISBO) PRiSM system within ten business days after each calendar quarter. For Diverse Business commitments specifically, the Contractor must submit monthly DB Status Reports (Form EO-402) to pd-non-ecms-db@pa.gov within five business days of each calendar month. The contract requires approval from the Office of Chief Counsel, Office of General Counsel, Office of Attorney General, and the Comptroller Operations before execution.
