About this file
This is a Criminal History Screening Practices Certification form required by Broward County, Florida for vendors seeking contracts valued at $100,000 or more with the county. The certification applies to the HWO Runway 1L-19R Intersection Mitigation project at North Perry Airport, which involves reconstruction and rehabilitation of multiple taxiways including Taxiway P from Runway 10L to Runway 1L intersection, Taxiway P from Runway 1L to Taxiway B, and Taxiway N from Runway 1L to Taxiway B. The scope encompasses mobilization, airfield traffic maintenance, pavement demolition, new subgrade construction, asphalt paving, LED taxiway lighting, and related airfield infrastructure. The project includes a Base Bid covering Taxiway P reconstruction from Runway 10L to Runway 1L, with Optional Group 1 and Optional Group 2 addressing additional taxiway segments. Vendors must complete and return the certification form with their initial submittal or within three business days of the county's request, with failure to comply potentially rendering the vendor nonresponsive.
The certification requires vendors to attest that they have implemented or will implement upon contract award policies and procedures that prohibit inquiry into applicants' criminal histories until candidates are selected as finalists and interviewed for positions within the United States. Alternatively, vendors may certify exemption from this requirement if they are required by applicable federal, state, or local law to conduct criminal history background checks at different times or in different manners, or if the vendor is a governmental agency. Vendors must check only one certification box and provide signatures, printed names, titles, and dates. Non-compliance with Section 26-125(d) of the Broward County Code of Ordinances constitutes material breach of contract and may result in contract termination, debarment, or suspension proceedings under Broward County Administrative Code Chapter 21.

Top of Form The completed form should be returned with the Vendor’s submittal. If not provided with the submittal, Vendor must submit the form within three business days after County’s request. Vendor may be deemed nonresponsive for failure to fully comply within the stated timeframe.
Section 26-125(d) of the Broward County Code of Ordinances (“Criminal History Screening Practices”) requires that a Vendor seeking a contract in the amount of $100,000 or more with Broward County shall certify:
A. Vendor has implemented, or will implement upon award of the contract, policies, practices, and procedures regarding inquiry into the criminal history of an applicant for employment, including a criminal history background check of any such person, that preclude inquiry into an applicant's criminal history until the applicant is selected as a finalist and interviewed for the position.
B. This requirement shall apply only to positions located within the United States that will foreseeably perform work under a contract with Broward County.
C. The failure of Vendor to comply with Section 26-125(d) at any time during the contract term shall constitute a material breach of the contract, entitling Broward County to pursue any remedy permitted under the contract and any other remedy provided under applicable law.
D. If Vendor fails to comply with Section 26-125(d) at any time during the contract term, Broward County may, in addition to all other available remedies, terminate the contract and Vendor may be subject to debarment or suspension proceedings consistent with the procedures in Chapter 21 of the Broward County Administrative Code.
By signing below, Vendor certifies that it is aware of the requirements of Section 26-125(d) of the Broward County Code of Ordinances and certifies the following: (check only one box below).
