About this file
This document is an exhibit related to federal immigration compliance requirements for the Maricopa County Department of Transportation (MCDOT), specifically addressing immigration law adherence for contractors and subcontractors. The exhibit mandates strict compliance with federal, state, and local immigration laws, particularly referencing Arizona Executive Order 2005-30, and applies to employees performing services under the contract.
The exhibit outlines significant financial and operational penalties for non-compliance, including compensation reductions of $10,000 for initial violations and $50,000 for subsequent violations within a two-year period. Repeated violations can result in contract termination, suspension of work, removal of contractors, and potential debarment for up to one year. MCDOT retains the right to conduct random audits and request evidence of compliance, with contractors required to provide documentation within ten working days of a request. The agency will accept compliance demonstrations consistent with the Federal Immigration and Nationality Act's employment verification provisions.

Text version
Federal Immigration and Nationality Act (Reference to Arizona Executive Order 2005-30)
The contractor, including all subcontractors, shall comply with all federal, state and local immigration laws and regulations, as set forth in Arizona Executive Order 2005-30, relating to the immigration status of their employees who perform services on the contract during the duration of the contract. The Agency (MCDOT) shall retain the right to perform random audits of contractor and subcontractor records or to inspect papers of any employee thereof to ensure compliance.
By submission of a bid, the contractor warrants that the contractor and all prosed subcontractors are and shall remain in compliance with all federal, state, and local immigration laws and regulations relating to the immigration status of their employees who perform services on the contract. The Agency may, at its sole discretion, require evidence of compliance from the contractor or subcontractor. Should the Agency request evidence of compliance, the contractor or subcontractor shall have ten (10) working days from receipt of the request to supply adequate information. The Department and Agency (MCDOT) will accept, as evidence of compliance, a showing by the contractor or subcontractor, that it has followed the employment verification provisions of the Federal Immigration and Nationality Act as set forth in Sections 274A and 274B of that Act, including implementation of regulations and agreements between the Department of Homeland Security and the Social Security Administration's verification service. The contractor shall include the requirements of this provision in all subcontracts for this project.
Failure to comply with the immigration laws or to submit proof of compliance constitutes a material breach of contract. The Agency will recue the contractor's compensation by $10,000 for the initial instance of non-compliance by the contractor or a subcontractor. Should the same contractor or subcontractor commit subsequent violations within a two (2) year time period from the initial violation, the contractor's compensation will be reduced by $50,000 for each violation. The third instance by the same contractor or subcontractor within a two (2) year period may result, in addition to the $50,000 reduction in compensation, in removal of the offending contractor of subcontractor, suspension of work in whole or in part or, in the case of a third violation by the contractor, termination of the contract for default in addition, the Department may debar a contractor or subcontractor who has committed three (3) violations within a two (2) year period for up to one (1) year. For purposes of this paragraph, a violation by a subcontractor does not count as a violation by the contractor.
Any delay resulting from a sanction under this subsection is a non-excusable delay. The contractor is not entitled to any compensation or extension of time for any delays or additional costs resulting from a sanction under this subsection.
