About this file

The document is a Certificate of Liability Insurance for Deere & Company, issued by multiple insurance carriers including National Union Fire Insurance Company and AIU Insurance Company. The certificate covers insurance for Deere & Company and is specifically related to a contract with the State of Arizona (ADOT) for Landscape & Utility Vehicles, Trailers & Equipment. The insurance provides coverage from 11/01/2022 to 11/01/2023 and includes various liability protections such as Commercial General Liability, Automobile Liability, and Workers' Compensation.

The contract appears to be for landscape and utility vehicles, with John Deere dealers responsible for delivering, setting up, and performing services for equipment sold under the contract. The insurance policies provide multiple layers of coverage, including $2,000,000 per occurrence for Commercial General Liability, $4,000,000 aggregate, $3,000,000 for Automobile Liability, and $2,000,000 for Workers' Compensation. Notably, Deere & Company indicates they do not carry primary product liability insurance, instead relying on excess coverage from Chubb/Ace Property & Casualty with a $10M deductible, and suggesting their substantial corporate assets ($90 billion) serve as financial backing for potential obligations.

Reference: Insurance Requirements

John Deere Dealers will be delivering, setting up and performing any requested services for the equipment sold under this contract. John Deere dealerships are not sub-contractors but independently owned and operated businesses and maintain their own insurance. The dealers’ insurance coverage will be evidence by their own certificate of insurance (COIs). The dealers will submit COIs should the need arise for equipment sold off this contract.

Deere & Company (“Seller”) does not carry primary product liability insurance. Such coverage is purchased only on an excess basis from Chubb/Ace Property & Casualty and contains a deductible of $10M per occurrence. In support of this corporate policy, Seller has total assets of approximately $90 billion as evidenced in Seller’s 2022 Annual Report. As insurance certificates merely evidence financial ability to meet legal obligations, and because it is not unusual for corporations of Seller’s size to carry such large deductibles for product liability, the Seller requests the State (“Buyer”) agree to accept Seller’s assets and well-known financial strength as ample qualification to meet its obligations to Buyer and forego the requirement for an insurance certificate.
