Notice to Offerors of Total Small Business Set-Aside
Responses Upon receipt of Solicitation Package, Interested Vendors shall complete and sign, CUI Agreement Exhibit 0 and return with attachments to Contract Specialist, jong.kim@gsa.gov and Contracting Officer, thupten.tsering@gsa.gov . Interested Vendor shall create a GSA.google email account via GACA Instructions atteched for access to CUI documents.

The GSA Google drive will be the primary project location for the PPI Log, Specifications and Drawings, Photos and any additional information. The Solicitation Attachments will also be uploaded to the Google Drive due to Storage capacity through email and SAM.gov.
I. General Information
I.A. The Solicitation and Contract
(1) This Solicitation is set-aside for Small Businesses in accordance with FAR 19. This Solicitation sets forth requirements for proposals for a Contract to construct the Project described in the attached Agreement. Proposals conforming to the Solicitation requirements will be evaluated in accordance with the Method of Award set forth herein. The Government will award the Contract to the selected Offeror, subject to the conditions set forth herein.
(2) Neither the Solicitation nor any part of an Offeror's proposal shall be part of the Contract except to the extent expressly incorporated therein by the Contracting Officer.
(3) The Offeror's proposal submitted in response to this Solicitation shall constitute a firm offer.
No contract shall be formed unless and until the Contracting Officer has countersigned the SF 1442 submitted by an Offeror, and delivered to the Contractor a copy of the SF 1442 with original signatures together with the Agreement reflecting the Offeror's proposed prices.

I.E. Estimated Price Range
The estimated price range for the Project is between $500,000.00 and $1,000,000.00.
I.F. FAR 52.228-1 Bid Guarantee (SEP 96)
(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.
(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier’s check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States. The Contracting Officer will return bid guarantees, other than bid bonds—
(1) To unsuccessful bidders as soon as practicable after the opening of bids; and
(2) To the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.
(c) The amount of the bid guarantee shall be 20 percent of the bid price or $3,000,000, whichever is less.
(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.
(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.
I.G. FAR 52.236-27 Site Visit – Construction (Feb 95)
(1) The clauses at FAR 52.236-2, Differing Site Conditions, and FAR 52.236-3, Site Investigations and Conditions Affecting the Work, will be included in any contract awarded as a result of this solicitation. Accordingly, Offerors are urged and expected to inspect the site where the work will be performed.

PPI (Pre-proposal Inquiries) cut-off is Wednesday, August 11, 2021 at 5:00 PM PDT. All inquiries must be forwarded to the contract specialist, at jong.kim@gsa.gov with copy to the Contracting Officer, at thupten.tsering@gsa.gov. The PPIs received later than the designated cut-off will not be responded.
I.H. Receipt of Offers
(1) In order to be considered for award, offers conforming to the requirements of the Solicitation must be received at the following office no later than 1:00 pm local time on the following date and at the following address.

Electronic Proposal submission shall be required directly via email to the Contracting Officer (thupten.tsering@gsa.gov) and Contract Specialist (jong.kim@gsa.gov) on or before the RFP Response Due Date. Proposals received after the RFP Response Due Date will be considered late. Additionally, bid guarantees shall also be emailed to the Contracting Officer in accordance with FAR 52.228-1.
Effective April 6, 2020, Class Deviation 2020-05 will allow vendors and sureties to use electronic signatures in lieu of manual signatures on Bonds.
This class deviation also eliminates the requirement for seals on bonds.
(2) Offers sent by commercial package delivery and hand delivery shall be deemed received as of the date and time of delivery to the office designated for receipt of offers.
(3) Offers sent by United States Mail shall be deemed timely if delivered to the address of the government installation designated for receipt of offers on or before the date established for receipt of offers.

II.B. Proposal Format
Offerors are advised that the following proposal preparation instructions are applicable to this Solicitation.
II.B.1. This is an all-electronic solicitation release, including amendments. All documents will be posted on the electronic SAM website at: www.Sam.Gov. Offerors interested in submitting a proposal in response to this Solicitation will be responsible for monitoring this website and the Solicitation link to ensure timely receipt of any amendments or other Solicitation-related information posted therein. Offerors are responsible for downloading all required documents from the SAM websites. Hard copies will not be made available. Sensitive But Unclassified information, such as drawings will be restricted to those Offerors given explicit access afforded by acknowledgement of and compliance with GSA/PBS Order 3490.2 (submit completed GSA/PBS Order 3490.2 acknowledgement form (Exhibit 0) via email to the Contracting Officer prior to receiving technical documents.
II.B.2 This solicitation does not commit the Government to pay any costs incurred in the preparation and submission of the initial and any subsequent proposals or for any costs incurred prior to execution of a formal contract. The Government shall not pay stipends for proposal costs incurred during this Solicitation.
II.B.3 Utilizing the format prescribed below, Offerors are to provide the requested information making every effort to present information clearly and concisely. Lengthy narratives containing extraneous information are discouraged. All information shall be submitted in the English language. Proposals that do not follow these Instructions, or otherwise include documentation that is difficult to read/decipher, may result in disqualification or a lower evaluation rating. Price proposals and technical proposals shall be submitted in separate volumes electronically in the following format.

II. B.4. Proposal Format:
Unless otherwise specified, Proposals shall be submitted by email in MS Word 365 format or PDF format. The Price and Technical proposal shall be submitted as separate electronic volumes ie. Volume 1 Price, Volume 2 Technical. If abbreviations and acronyms are utilized, the Offeror shall provide a legend or table, with the long form of the words that make up the abbreviations and acronyms (e.g. pdf – portable document format; GSA – United States General Services Administration, etc.).
(a) CUI (Controlled Unclassified Information) Marking – Offerors shall mark CUI//SP-PROPIN in bold capitalized black text at the top center of the page and on every page of the proposal.
(b) Schedules shall be submitted by email in an electronic format that can be downloaded in the email, and is fully compatible with, Microsoft Office Project. The elements of the schedule shall be able to be copied and manipulated for analysis by the Government (e.g. no locked or protected cells, worksheets, etc.).
(c) Pricing information shall be provided in an electronic format, to include an importable document format (.pdf) viewable with Foxit PhantomPDF, and a secondary format fully compatible with Microsoft Office Excel 365. The contents of all cells (e.g. text, numbers, formulas, and symbols, etc.) shall be able to be viewed and copied for manipulation/analysis by the Government (e.g. no protected cells, worksheets, or workbooks).
(d) Other documents with text shall be provided in a format that can be uploaded into and is fully compatible with MS Office Word 365. All text should be able to be copied and manipulated for analysis by the Government (e.g. no text images unless it is manufacturer’s product data or logo).
There is no page limitation for Price Proposals. Technical Proposals are limited to 40 pages.
The Table of Contents and tabbed dividers shall not be counted as part of the page total.
Offerors shall clearly number each page sequentially throughout all sections (i.e. page numbering shall not re-start within each tabbed divider/proposal section). Any pages in excess of the 40 page limit specified herein shall not be considered by the Government during evaluation. Proposal text shall be in either Times New Roman, Arial or Courier font, with a minimum font size of 10 point. Proposal submissions shall be by email in electronic format only.
The cover page clearly labeled “Proposal for Fire Alarm and Fire Suppression Replacement for Sumas Land Port of Entry Solicitation No. 47PL0121R0035.”
II.C. Price Proposal
(1) Contents
The Price Proposal shall consist of the SF 1442 and the Agreement, with prices and/or rates indicated for each price element shown on the pricing form included in Section II of the Agreement. Indicate the Base Contract Price, or if no such distinction is made, the Contract Price, in Block 17 of the SF 1442, which must be fully executed by the Offeror.
(2) Qualifications, Exclusions and Conditions
If the Offeror communicates in its proposal any qualifications, exclusions, or conditions to the proposed prices not provided for in the Contract Documents, the Contracting Officer may reject the proposal and exclude the Offeror from further discussions.
(3) Additional Proposal Requirements
a. The offeror shall submit a completed electronic copy of the “Agreement” with all fill-in sections completed.
b. Prices for these CLINs shall be supported by a High Level Specification Itemized Breakdown (CSI) Level 4 format for the major tasks of this project. The Offeror must provide a Completed Cost Breakdown from Prime and All Subcontractors in CSI Level 4 format. The itemized breakdown shall include materials, quantities, unit prices, labor costs (separated into trades), construction equipment, etc. Labor costs shall be identified with specific material placed or operation performed (See Exhibit 1-a)
c. The Offeror shall complete and submit the Representations and Certifications form (C301), with all fill-in areas completed (see Section II.E. Other Information to Submit with Proposal)
II.D. Technical Proposal
The Technical Proposal shall include the information requested below for the non-price factors described in Section VI.
FACTOR 1 – Relevant Experience
Relevant Experience for this project is comprised of two parts, each of which must be submitted separately:
Factor 1(A) Relevant Construction Experience of the Proposed Builder; and Factor 1(B) Relevant Design Experience of the Proposed Designer
Description: This factor considers the extent of the Offeror’s relevant experience on fire alarm, fire suppression and electrical projects of similar size (building square feet and dollar value), scope and complexity. The Offeror shall submit a narrative on four (4) relevant projects (two (2) for the Proposed Builder and two (2) for the Proposed Designer), that are similar size, scope and complexity. Offerors are advised that any additional projects submitted over the limit specified herein shall not be considered during evaluation.
For each fire alarm, fire suppression and electrical project presented in relation to this factor, the Offeror must explain how the characteristics of the project relate to the characteristics of this project. The similarity to this project is more important than the quantity of projects presented.
For each project narrative provided, the Offeror shall submit the following data/information as a cover sheet:

“Relevant” is defined as fire alarm, fire suppression and electrical projects similar to the project in this solicitation in size (i.e. square feet and dollar value) and which have a logical connection with the requirements of this solicitation by including similar scope elements and which demonstrate equal or greater overall project complexity associated with them. Specifically, for purposes of this procurement, experience that is considered especially relevant shall include projects with similar facility size – gross square footage between 50,000 square feet - 200,000 square feet, and a construction cost of $1,000,000.00 - $2,000,000.00. The following scope and complexity considerations are also relevant: 1) Similar building facilities projects; 2) Design- Build/collaborative approach projects; 3) Occupied Facilities Construction projects in occupied buildings. An explanation of each of the three types of especially relevant experience is as follows:
Similar Building Facilities. For the purpose of this RFP, fire alarm, fire suppression and electrical projects submitted for this area of experience should demonstrate the Team’s relevant experience with building facilities of similar size (square feet and dollar value) to the project in this Solicitation. Examples include, but are not limited, to such buildings as Police Station, Fire Station and multi-use facilities. The Construction team’s knowledge of federal construction contracting procedures and a successful project in a federal building may afford for a higher rating.
Design Build Projects. For the purpose of this Solicitation, fire alarm, fire suppression and electrical projects submitted for this area of experience should show the Team’s experience working with a fire alarm and electrical design firm on relevant Design-Build projects of similar size (square feet and dollar value) and complexity to the project in this Solicitation. The experience does not need to be with the same Design-Build team as proposed for this project.
However, Offerors that demonstrate previous relevant experience with the same Design-Build team members as proposed for this project may be afforded a higher rating.
Occupied Facilities Construction. For the purpose of this Solicitation, fire alarm, fire suppression and electrical projects submitted for this area of experience should demonstrate the Team’s experience constructing relevant projects of similar size (square feet and dollar value) and complexity to the project in this Solicitation in buildings that were occupied during construction. Projects demonstrating work in occupied facilities that required critical phasing and coordination efforts necessary for success may be afforded a higher rating.. NOTE:
“Occupied” is defined as construction project work occurring within tenant space without the tenants vacating and/or swinging out of the space during work. Work in vacated space adjacent to occupied space will be considered less relevant. Projects should also demonstrate how any work required in tenant occupied space was coordinated to minimize/eliminate disruption).
Submission Requirements: The minimum submission requirements for this factor (for each sub-factor (i.e. for the Proposed Building and for the Proposed Designer) are defined below.
1) A narrative for two (2) relevant projects that are similar in size, scope, and complexity as described above for both the proposed designer and the proposed builder, completed or substantially underway. Only relevant projects at least 75% complete or completed within the past six (6) years from the date proposals are due may be submitted.
Proposals shall clearly state the year of completion or percentage of completion for each project submitted. Offerors shall explain how the information provided is relevant to the proposed acquisition.
2) Narrative summaries of the submitted projects that demonstrate the Offeror’s capabilities, technical expertise, and experience managing complex projects with reference to considerations of timeliness and technical success.
a. Limit the submittal for each fire alarm, fire suppression and electrical project example to two (2) pages each using the Project Experience Form attached (Exhibit 2). **NOTE: Any pages in excess of the one (1) page per project example limit (excluding back page instructions) will not be considered for evaluation purposes.
b. Include for each project how the project relates to this Solicitation project as well as how the project pertains to the noted area of experience.
c. The Offeror must clearly identify for which, if any, of the relevant types of experience area(s) (as defined above under “Description”) each fire alarm, fire suppression and electrical project example pertains for both the proposed builder and the proposed designer (i.e. Project A may qualify and be listed for similar building facilities, design build project and occupied building construction while Project B may qualify and be listed only for similar building facilities and Occupied Facilities Construction). Offerors shall ensure the Project Experience Matrix includes both the projects submitted for the Proposed Builder and the projects submitted for the Proposed Designer.

FACTOR 2 – Technical Competence: Key Personnel
Key personnel proposed as the Design-Build Team shall demonstrate requisite experience necessary to perform the requisite design and construction services of the fire alarm and fire suppression replacement project in this Solicitation on relevant construction projects of similar size (square feet and dollar value), scope and complexity to the project in this solicitation. See description of “relevant” under II.C.1.
Description: This Factor considers the Key Personnel proposed by the Offeror; consideration shall be given to the demonstrated experience and qualifications of the proposed staff and how the Offeror proposes to organize the Project Team. Proposed team members shall be evaluated as to qualifications and experience in all areas necessary to effectively perform the required work. It is expected that the proposed key team members will be the individuals who perform work under this contract. Any changes to the proposed key team members after award MUST be approved in writing by the Contracting Officer and shall only be approved upon demonstration of “equal or better” qualifications when the new individual is compared to the minimum qualifications and experience of this Solicitation as well as the level of qualifications and experience of the original proposed individual.
1. Construction Project Manager (CPM) – The CPM shall have a minimum of five (5) years’ experience in the field of construction management and/or inspection of construction projects of similar size and scope to that of this project, as well as demonstrate construction experience in Industrial spaces as well as office buildings. The CPM shall demonstrate the following experience in the interdisciplinary management and coordination of the numerous disciplines and trades surrounding Design-Build occupied facility construction projects ($500,000.00 - $2,000,000.00). The CPM shall have experience with computer-based scheduling software, such as Microsoft Project, Primavera, other similar software and have the ability to interpret schedules generated from this system. In addition to scheduling software, the CPS shall demonstrate experience with electronic project management applications inclusive of various modules such as budget tracking, Schedule of Values (SOV) input, Request for Information (RFI) submittal/response functionality, etc.
2. Fire Alarm System Designer (FAS Designer) - The FAS Designer shall be a current NICET
Fire alarm certified Level IV and/or an active licensed Washington State Fire Protection Engineer. The FAS Designer shall have a minimum of seven (7) years of esign/construction experience in relevant fields of trade (i.e. fire and life safety system design and fire/life safety design reviews). The FAS Designer must be able to read and interpret complex building construction drawings. Copies of certifications and licensing will be reviewed for validity. Certifications or licenses that are found not to be current will result in a rating below that required for award.
3. Superintendent - The Project Superintendent shall have no less than five (5) years’ experience as a project superintendent on construction projects of similar size and dollar value or larger to the project in this solicitation. The experience should demonstrate building construction knowledge, the ability to manage complex projects and coordination between multiple subcontractors, as well as be consistent with the type of construction provided for in this solicitation.
The Superintendent shall have field experience coordinating day-to-day site issues relating to materials, labor, and equipment utilization on government or commercial projects, demonstrated experience inclusive of knowledge and management of all aspects of design and construction phases within a design build project, as well as demonstrated experience managing projects of similar size and technical complexity in occupied facilities
4. Contractor Quality Control System Manager (CQCSM) - The CQCSM shall be an individual within the on-site work organization who shall be responsible for overall management of
Contractor Quality Control (CQC) and have the authority to act in all CQC matters for the
Contractor. The CQCSM shall have a four-year (i.e. B.S., B.A.) degree in Construction
Management (or a related field such as Architecture or Engineering) with a minimum of five
(5) years in Fire Sprinkler AND Fire Alarm construction experience in work of comparative size, value and technical complexity to the project in this solicitation. This CQCSM shall be on the site at least once a week during construction (and additional visit as the contractor see fit) and must be an employee of the prime contractor(s) or if a subcontractor be granted authority in writing to function in the capacity as would a prime contractor employee serving in the same capacity. In addition, the CQCSM shall be on the site at least once a week for a coordinated site inspection with the GSA PM and/or GSA CM during construction. This visit must be coordinated by the contractor and government representative.
Submittal Requirements. Provide the names and qualifications of the Key Personnel proposed for this project in the form of resumes (see Exhibit 3 - Key Personnel Resume form).
Only one individual for each key position shall be submitted.
The resumes must clearly present the separate credentials of each proposed key team member, and must provide a concise summary of each individual’s separate duties and responsibilities as proposed for this project. Resumes for each individual must include educational qualifications, if applicable, and three (3) to five (5) project examples demonstrating the individual’s experience. Project examples shall be actual projects, not references to contractual vehicles (i.e. indefinite quantity indefinite delivery contracts, blanket purchase agreements, etc.) or groups of projects for a particular owner (i.e.“Various construction projects for GSA PBS Region 10”). Any projects submitted beyond this limit shall not be considered.
Projects shall be relevant examples of similar size, scope and complexity (allowance will be made for larger projects). Resumes must also include copies of current certifications and licenses applicable to this project. Any additional resumes provided will not be considered.
Standard for Evaluation: Technical Competence: Key Personnel will be rated on an “acceptable” or “unacceptable” basis using the ratings in Table A-2:

FACTOR 3 – Management & Technical Approach
This Factor and its Subfactors are concerned with the Offeror’s understanding of the project technical requirements and the management approach.
Description: This factor is concerned with the Offeror’s understanding of the project requirements and the management/technical approach for all aspects of the project including design, construction, demolition, and completion. Consideration shall be given to the ability of the Offeror to manage project risks, control budget, timeliness, and overall project quality.
Submission Requirements: The Offeror shall submit a written plan addressing the following:
Subfactor A: Management Approach
1) Offerors shall provide an organization chart for their team for this project showing organizational positions – only key personnel names are required. This chart shall show lines of authority within the project team, between the project team and its corporate organizations, and between the project team and the Government.
2) Offerors shall identify what they believe are the most significant risks associated with this project. Such risks should include matters that jeopardize performance within budget and schedule limitations, problems created by working on an occupied building with severely limited site access, and change orders. Offerors shall provide a description of how they propose to manage and mitigate those risks. Offerors shall describe examples of successfully managing similar risks on previous projects. Offerors shall also describe their long-range plans for securing and maintaining the resources necessary to complete the project.
3) Offerors shall provide a Design and Construction Quality Control Plan (QCP) tailored to
THIS Project. The QCP shall contain the Offeror’s methodology for controlling quality during both design and construction. The Plan shall also demonstrate the Offeror’s understanding of the high level of quality expected due to the nature of the historically significant building and the means by which the Design-Build Contractor will attain the quality throughout both the design and construction portions of the Work.
4) Offerors shall provide a Management Plan for the Project that explains how the various team members will work together and the methodology and processes for managing this entire Project. The Plan shall describe the process during design for solving the technical, functional, and constructability issues while maintaining the design intent and obtaining approvals. The Plan shall discuss the method of coordination with GSA. The Plan shall refer to the use of schedules and cost control systems. The Plan shall also discuss how the Offeror will ensure that Government and other necessary permits and approvals are received for this Project in a timely manner so that the completion date of the construction is not delayed.
Subfactor B: Technical Approach
1) Offerors shall describe their approach to managing and delivering a project of the magnitude and complexity of THIS project under budgetary and time constraints. The description shall include a discussion of the offeror’s approach to managing the project to meet or exceed performance criteria, on schedule, and within budget. Resources discussed should include key manpower, availability of personnel having current security clearance, equipment and material. Discussion should indicate if these resources will come from in-house or from major subcontractors for foundations, selective demolition, structural, mechanical and electrical portions of the work. Offerors should include discussions of how the schedule for the project will be met while, at the same time, managing any changes that may occur.
2) Most importantly, the narrative shall identify the Offeror’s proposed approach for phasing and coordination of construction to minimize impact on the tenant population and fire/life/safety concerns. (Existing fire alarm system must remain fully operational until a new system has passed confidence testing by GSA/Authority Having Jurisdiction).
3) The Offeror shall provide a comprehensive and fully developed Critical Path Method
(CPM) project schedule (with a minimum of 25 activities in the CPM network and no page limit). The proposed schedule will run from the contract award date, bonds/insurance/security clearances, initial NTP, design phases, submittals, material ordering/lead time, demolition, construction, quality assurance reviews, key project meetings, acceptance testing, substantial completion, punch list item completion, warranty, retesting, closeout, etc. The network logic shall be linked, and the logic shall show the general management approach to designing and constructing and commissioning of the systems related to the Project. Float time between activities shall be calculated and identified.
a. Within each construction activity's time bar, indicate estimated completion percentages in not more than 10 percent increments and as work progresses, place marks in the bars to indicate actual completion percentages.
b. Phasing: Arrange schedule to show how sequence of work is affected by requirements for phased completion, work by separate contractors, work by Government, Government-furnished items, coordination with existing work, limitations of continued occupancies, non-interruptible services, partial completion for occupancy, site restrictions, provisions for future work, seasonal variations, environmental control, and similar provisions of the project.
c. Individual Work Stages: Show significant stages for each category or unit of work, including where applicable, but not necessarily limited to, submittals, purchases, mockups, fabrication, sample testing, delivery, installation, testing, adjusting, curing, start-up and placement into final use and operation.
d. Input November 1, 2021 for start date in the CPM Project Schedule. This is for the evaluation purpose only, and the Government does not commit to this start date.
4) Offeror shall identify what make, model and type of replacement fire alarm and fire suppression system that they plan to utilize for this project, as well as devices. The Offeror shall provide manufacturer’s product data that describe equipment key characteristics, equipment benefits (expandability, ease of maintenance, and other features), life cycle information (estimated life of the system, number of years manufacturer’s support before the system components become obsolescent or obsolete.

FACTOR 4 – Past Performance
Description: This factor considers the past performance of the Offeror and proposed subcontractors for key trades in performing construction contracts, with regards to considerations such as technical success and customer satisfaction. This factor also considers the quality of the Offeror’s performance in carrying out the work required, specifically, workforce management, and scheduling. References must be submitted for the projects presented in relation to the Factor 1 – Past Experience. The Offeror must provide the name, title, company name, current address, phone number, and current fax number for each reference. The DB Reference Questionnaire (Exhibit 4) will be used to annotate contact and responses to verify information provided in relation to the Offeror’s past performance. Offeror may also provide copies of CPARS (ACASS, CCASS, and CPARS) and PPIRS evaluations for relevant projects (Final ratings will be verified in PPIRS) identified in Factor 1.
Submittal Requirements: In accordance with FAR 42.1503(e), past performance will be evaluated using the Past Performance Information Retrieval System (PPIRS), as well as DB
Reference Questionnaires, other information available to the Contracting Officer. All performance ratings for contracts completed (or at least 75% complete) within the past six (6) years from the date proposals are due shall be considered. If an Offeror does not have past performance available in PPIRS, the DB Reference Questionnaire (Exhibit 4) or other Government sources may be used. A lack of past performance information will result in a neutral rating during evaluation. Government databases will be checked and previous customers may be contacted as references. Offerors shall complete Blocks 1 through 11 at the top of the DB Reference Questionnaire (Exhibit 4) for each of the projects to be submitted. The Offeror shall submit the partially completed DB Reference Questionnaire (Exhibit 4) to the Project’s Owner for completion and submission either back to the Offeror or directly to the GSA.
Completed forms shall be signed and dated by the reference completing them and shall be submitted to the Contracting Officer identified on this Solicitation as part of the technical proposal or directly by the customer. In the case where the Project’s Owner is sending the completed questionnaire to the Contracting Officer, the Offeror shall submit the partially completed questionnaire, along with correspondence to/from the Project’s Owner to show that due diligence has been performed.
The Government reserves the right to contact the evaluator on previous Government or private sector work to verify the Offeror’s construction/design performance or the validity of the questionnaire.
Offerors shall submit a list of all customers (including current point of contact, phone number, and electronic address) to whom a DB Reference Questionnaire was provided (1 page). A reproducible DB Reference Questionnaire form is provided at Exhibit 4. No more than eight (8) DB Reference Questionnaires (Exhibit 4) total for the Design/Build Team shall be submitted (i.e.
both the Builder and the Designer together). DB Reference Questionnaires shall be submitted for all projects identified in FACTOR 1 for which a Relevant Experience form (Exhibit 2) was submitted. Additional surveys will not be considered. To be considered, the surveys must be completed by the customers (signed and dated) and emailed directly by the customer to the Contracting Officer identified at I.C or with the technical proposal, for receipt no later than the time and date proposals are due. Surveys submitted directly by Offerors or those received after the date/time proposals are due may not be considered. The Government reserves the right to contact the identified references provided in an Offeror’s proposal should a survey not be received by the date proposals are due or to verify information provided by an owner on a Survey.
***NOTE: Each survey shall include the following designation (email subject line, include this designation either in the subject line or as the first line of the email body):

Firms are advised that DB Reference Questionnaires (Exhibit 4) may not be completed by members of the proposed Design-Build Team for this Solicitation (i.e. Design-Build Prime BCD Corporation cannot provide a DB Reference Questionnaire (Exhibit 4) for XYZ Company if BCD Corporation is teaming with XYZ Company for purposes of submitting a proposal under this Solicitation).

II.E. Other Information to Submit with Proposal
(1) Representations and Certifications
Offerors are reminded their SAM registration status must be “Active”, at the time their offer is submitted, to be considered for award (see 52.204-7). Offerors submitting a proposal in response to this Solicitation shall complete electronic Annual Representations and Certifications in conjunction with required Entity registration in System for Award Management (SAM), accessed via System for Award Management. Offerors shall also submit with their proposal, the Annual Representations and Certifications (FAR 52.204-8), using the attached Offeror’s Representations and Certifications (C301).
(2) Qualifications of Offerors
Subcontracting Limitation: In accordance with FAR 52.219-14(c)(4) Construction by Trade Specialty Contractors, Offerors who are planning on teaming with a subcontractor(s) must proved a statement that they will perform at least 25 percent of the cost of the contract, not including the cost of materials, with its own employees.
II.F. Requirements of Joint Venture Offerors
(1) All offers submitted by joint ventures must include a copy of an executed joint venture agreement (with original signatures) which fully discloses the legal identity of each member of the joint venture, the relationship between the members, the form of ownership of each member, and any limitations on liability or authority for each member.
(2) An authorized representative of each member of the joint venture must sign the SF 1442 accompanying an offer regardless of any agency relationship established between the members.
(3) In the case of corporations that are joint venture members, the corporation secretary must certify that the corporation is authorized to participate in the joint venture, either by so certifying in the joint venture agreement, or by submitting a separate certification to the Government. The https://www.sam.gov/ joint venture must also provide a certificate that identifies a principal representative of the joint venture with full authority to bind the joint venture.
(4) Representations and certifications, financial information, and past performance information must be submitted for each member of the joint venture.
III. General Provisions
III.A. Availability of Funds
Issuance of this Solicitation does not warrant that funds are presently available for award of a Contract. Award of the contract shall be subject to the availability of appropriated funds, and the Government shall incur no obligation under this Solicitation in advance of such time as funds are made available to the Contracting Officer for the purpose of contract award.
III.B. Requests for Clarification or Interpretation
The Government will attempt to answer all requests for clarifications or interpretations of the
Solicitation Documents prior to the date set for receipt of offers, but do not warrant that all such requests will be answered within 5 calendar days. Prospective Offerors should make such requests not less than 14 calendar days prior to the date set for receipt of offers.
III.C. Notice to Small Business Firms
A program for the purpose of assisting qualified small business concerns in obtaining certain bid, payment, or performance bonds that are otherwise not obtainable is available through the Small Business Administration (SBA) (Small Business Administration). III.D. Information Concerning the Disclosure of Solicitation Results
This acquisition is being conducted under the provisions of FAR Part 15 as a negotiated procurement. In accordance with FAR 3.104 and FAR 15.207, after receipt of proposals, no information regarding the identity of those submitting offers, the number of offers received, or the information contained in such offers will be made available until after award except as provided by FAR 15.503.
