About this file

This is a GRAMA Claim of Business Confidentiality form issued by the Utah State Board of Education in connection with a Request for Statement of Qualifications (RFSQ) for Child and Adult Care Food Program (CACFP) financial review services. The Utah State Board of Education seeks one or more experienced contractors to provide financial document review and ensure compliance with CACFP program requirements. The solicitation is issued under the Utah Procurement Code and applicable administrative rules, specifically Administrative Rule R277-122-6 for Small Purchases of Professional Service Providers and Consultants. The current all-inclusive budget for this project is limited to $250,000.00 for multiple professional service providers, with a current budget allocation of $36,000.00. Vendors are prohibited from communicating regarding this RFSQ with conducting procurement unit staff, evaluation committee members, or other associated individuals except the USBE procurement officer overseeing the solicitation.

The GRAMA Claim of Business Confidentiality form is a template document that allows companies submitting proposals to assert claims protecting sensitive business information, including trade secrets, non-public financial statements, specific employee contact information, and customer or client lists. Companies may claim business confidentiality under Utah Code Section 63G-2-305 if the information would reasonably be expected to result in unfair competitive injury or impair the government entity's ability to obtain necessary information in the future, and if the submitting company has a greater interest in prohibiting access than the public has in obtaining access. The form requires companies to identify which categories of information require protection and provide a concise statement of reasons supporting the confidentiality claim.
