About this file

This is a prevailing wage rate requirements exhibit for a construction project by El Paso County Hospital District, operating as University Medical Center of El Paso (UMC) in Texas. The document establishes the prevailing wage rates that must be paid to workers on the Horizon Health Center project, a new outpatient clinic featuring approximately 35 exam rooms and 15 urgent care rooms along with imaging, pharmacy, and laboratory services. The project is located at the intersection of Eastlake Boulevard and Kenazo Avenue on the east side of El Paso, Texas. UMC is seeking a Construction Manager at Risk to provide preconstruction services including cost estimating, constructability review, phasing analysis, and procurement planning, with the potential for a subsequent construction phase agreement contingent upon successful alignment of project budget and Guaranteed Maximum Price terms under an AIA A133 form agreement.

The prevailing wage rate requirements document specifies the minimum compensation levels required for various trades and labor classifications working on this bond-funded capital project. These prevailing wage rates apply to all workers engaged in the construction and related services and represent a significant cost factor in project budgeting and bidder proposals. Compliance with prevailing wage requirements is mandatory and must be reflected in all cost estimates, bids, and pricing submissions. The wage rates are typically based on state and local prevailing wage determinations and are enforced to protect worker compensation standards on publicly funded construction projects in Texas.

EXHIBIT D

PREVAILING WAGE RATE REQUIREMENTS AND COMPLIANCE

Purpose This Exhibit describes prevailing wage rate requirements that apply to this Project and establishes proposer and contractor compliance obligations. These requirements apply to all tiers of subcontractors and all work performed on the Project that is subject to Texas Government Code Chapter 2258 and applicable Owner policy.

Applicable Wage Rates Prevailing wage rates for this Project are those adopted by the Owner and issued with the solicitation package or by addendum. If a Prevailing Wage Rate Addendum is included with the solicitation, it forms part of the Contract documents.

Contractor Responsibilities Pay each worker no less than the applicable prevailing wage rate for the classification of work performed.

Maintain accurate time and payroll records that clearly identify worker name, classification, hours worked, hourly rate, and deductions as applicable.

Flow down prevailing wage requirements to all subcontractors and require subcontractor compliance.

Post prevailing wage information at the Project site in a location accessible to workers, as required by law and Owner policy.

Certified Payroll Submittals The Contractor shall submit certified payroll records for itself and each subcontractor as a condition of payment, in the form and frequency required by the Owner. At minimum, certified payroll shall be submitted at least monthly and with each pay application, if required by Owner. The Owner may require a standardized form or electronic format.

Owner Review and Access The Owner may review payroll records and conduct site interviews to confirm compliance. The Contractor shall provide reasonable access to payroll records, worker classifications, and related documentation for the Project when requested by the Owner.

Noncompliance If the Owner identifies a potential prevailing wage violation, the Owner may require corrective action, including payroll corrections and restitution to affected workers. The Owner may withhold amounts from progress payments as permitted by the Contract and applicable law until compliance is verified.

Questions and Communications Questions regarding prevailing wage requirements shall be submitted in writing to the Point of Contact identified in the solicitation. Verbal guidance is not binding.
