1.1 The A/E shall provide the Services for the Project, customarily furnished in accordance with generally accepted architectural or engineering practice and standards of care, consistent with the terms of this Agreement.
1.2 The A/E agrees that, consistent with the standard of care applicable to this agreement, it will identify, interpret, and apply the design requirements of applicable laws, regulations and ordinances; the applicable announcement issued pursuant to Columbus City Code Chapter 329;
and the City’s standards of Design and Construction. The A/E shall, in conjunction with the City, act as the “Engineer”, as defined in the City of Columbus Construction and Material Specifications, recent edition (which is incorporated by reference as if attached).
1.3 The A/E shall not be responsible for and shall not have control or charge of construction means, methods, techniques, sequences, procedures, or scheduling used by a Contractor to comply with the Contractor’s obligations under its Contract for the Project or for safety precautions and programs in connection with the Contractor’s Work on the Project.
1.4 The A/E shall not be responsible for or have control or charge over the acts or omissions of Contractors or Subcontractors, any of their agents or employees, or any other persons performing any work on the Project.
1.5 The A/E shall render interpretations and decisions in connection with a Contractor’s responsibilities under the Contract Documents and submit recommendations to the City for the City’s enforcement of the Contractor’s contract as necessary.

1.8.1 By appropriate written agreement, the A/E shall require each Subconsultant, to the extent of the Subconsultant’s portion of the Services, to be bound by the terms of this Agreement, and to assume toward the Subconsultant all of the obligations and responsibilities that the A/E assumes toward the City.
1.8.2 The A/E shall not retain any Subconsultant on terms inconsistent with this Agreement.
1.8.3 All agreements between the A/E and Subconsultant shall identify the City as the agreement’s intended third-party beneficiaries.

1.8.5 The A/E shall obtain the City’s written approval before engaging any Subconsultant not named in the Agreement. The A/E shall not employ any Subconsultant against whom the City has a reasonable objection. The City’s approval or disapproval of any Subconsultant, however, will not relieve the A/E of the A/E’s full responsibility for performance of the services.

1.8.8 The A/E hereby assigns to the City each Subconsultant’s agreement provided that the assignment is effective only after the City terminates this Agreement and only for those agreements that the City accepts by notifying the A/E and Subconsultant in writing after approval by appropriate City officials. The City may re-assign accepted agreements. If the City assumes assignment of a Subconsultant agreement, the City reserves the right to modify the terms and conditions to bring the contract into conformance with City contracting requirements.
1.9 Approval or Disapproval of A/E’s Services
1.9.1 The City may disapprove any portion of the Services.
