B-001 - Labor and travel Costs
LABOR:
The labor rates specified herein are fixed daily rates which include the following: wages, indirect costs (including overhead, fringe benefits and general and administrative expenses), and profit.
The Government may request adding to or deleting from the labor categories listed in Exhibit 1 - Ref: SOW.
All new labor rates shall be calculated in the same manner as in the Contractor's cost proposal submitted in response to the solicitation or after award as requested by the Government. The profit/fee rate shall be the same as in the Contractor's cost proposal submitted in response to this solicitation.
The contractor affirms that all employees will be paid at or above the rates submitted and accepted by the Department.
The contract employer shall make the determination on FLSA status.
The Service Contract Act (SCA), when applicable, requires contractors and subcontractors performing services on prime contracts in excess of $2,500 to pay service employees in various classes no less than the wage rates and fringe benefits found prevailing in the locality, or the rates (including prospective increases) contained in a predecessor contractor's collective bargaining agreement. The Department of Labor (DOL) issues wage determinations on a contract-by-contract basis in response to specific requests from contracting agencies. These determinations are incorporated into the contract. The contractor shall comply with applicable SCA provisions at all times.
The Fair Labor Standards Act (FLSA), when applicable, establishes minimum wage, overtime pay, recordkeeping, and child labor standards affecting full-time and part-time workers in the private sector and in Federal, State, and local governments. Some positions under this contract are under the purview of the FLSA, and others are exempt. It is the contractor’s responsibility to comply with applicable FLSA wage provisions at all times, even if applicable prevailing wages have not been incorporated into the contract.
The contractor shall clearly indicate and label which positions/labor categories are covered by, or exempt from, the FLSA on any and all proposals and on the list of labor categories incorporated into the contract.
The contractor shall furnish all personnel, management, supervision, transportation, equipment, materials and subcontract items or services as necessary to perform various support services as stated in this document.
Work ordered under this contract is to be performed using facilities and materials provided by the Government as indicated below to the extent available. In the event that Government resources are not available to meet requirements cited, contractor acquired materials; services, equipment or temporary facilities may be included on the Contractor’s proposal for that task order as Other Direct Costs (ODCs).
TRAVEL:
1. All CONUS and OCONUS travel shall be pre-approved with a request from the Contract Firm to the COR for final approval. Funds must be available before travel commences. All travel will be in accordance with the Federal Travel Regulation. Travel under this contract is defined as Contractor air and ground transportation, lodging, meals and incidental expenses, and passport/ visa costs.
2. The Contractor shall be responsible for ensuring that all personnel who will be required to travel outside the United States have current and valid passports. The Contractor shall also be responsible for obtaining any visas required for travel to foreign countries under this contract. The Contractor shall make no direct labor charges for obtaining/maintaining passports and/or visas.
3. The Contractor shall be paid allowable travel costs in accordance with FAR 31.205-46.
4. When local travel between the Contractor employee's regular place of performance and other locations is specifically authorized by the COR, transportation expenses shall be allowable costs under this contract. For the purposes of this clause, local travel means travel within a 50 mile radius of the Contractor employee's regular place of performance and does not include daily commuting or associated costs.
5. The Government will reimburse the Contractor for Contractor employee's travel time to or from other authorized work locations; except that for labor categories which are exempt from the Fair Labor Standards Act (FSLA), a reimbursement will be allowed only for travel during the employee's regular working hours. The Contractor will not be reimbursed for time spent in stand down or temporary layovers for the convenience of the Contractor by FLSA exempt contractor employees except as authorized by the Federal Travel Regulations.
6. For travel where use of a personal automobile has been specifically authorized by the COR, reimbursement shall be computed on the basis of actual miles traveled from starting point to destination. Other related miscellaneous expenses, such as tolls and parking fees, incurred in the performance of tasks authorized under this contract, will be reimbursed. Car rentals require advance approval by the COR and will be authorized only when consistent with good business practice.
Allowable costs shall not exceed the actual cost of renting a compact automobile (a maximum of one for four Contractor personnel), unless extenuating circumstances (e.g., excess baggage) require other arrangements and subsequent COR approval is obtained.
7. Should any Contractor personnel be requested to perform in any area which has been determined by the Department of State to be a hazardous duty area, hazardous duty premium pay if and to the extent requested and allowed, will be payable at the same rate as would be given to Department of State direct-hire employees pursuant to Chapter 650 of the U.S. Department of State Standardized Regulations (Government Civilians, Foreign Areas).. Hazardous duty premium pay shall not be burdened with any indirect costs (e.g., overhead, G and A) or fee/profit.
8. The Government will pay the Contractor, under the applicable ODC-Travel CLIN(s), for each Contractor employee’s travel time to or from authorized work locations as long as the following are met:
i. Payment of travel time described herein is in accordance with the Contractor’s established travel policy.
ii. Travel time begins no earlier than two (2) hours prior to the scheduled departure time and concludes upon arrival to the initial destination point (e.g., airport) at the place of performance.
iii. The Government will not pay more than eight (8) hours per day per Contractor employee for travel time. See 29 CFR 785.39 Travel away from home community.
iv. The Government will pay for a Contractor employee’s travel time that is outside the employee’s regular working hours, as long as it the travel and duty day do not extend beyond 8 hours.
v. The Government will not pay a Contractor employee for more than the number of hours in the employee’s normal workweek. “Number of hours” includes productive time hours, travel time hours, and paid time off hours (e.g., sick, vacation, holiday), without COR/CO approval.
vi. Exceptions shall be authorized in advance, and in writing by the Contracting Officer.

H - 004 - Telework/Alternate Work Schedule
Telework/Alternate Work Schedule Policy - Telework is an alternate work arrangement that gives contractor employees the opportunity to conduct all or some of their work away from the primary workplace to accommodate both core and situational telework employees within the Department. It has no effect on the hours an employee works. The location of telework is normally the employee’s primary residence. Work from any other place must be approved by the COR before teleworking.
A contractor employee's participation in an AWS, flextime, or telework is voluntary and subject to COR approval.
The COR may cancel or adjust the telework arrangement by providing written notice to the contractor.
When Holidays fall within the same pay period the holiday will affect the schedule. Full-time employees on flexible work schedules are entitled to 8 hours of pay when they do not work on a holiday. For a full-time employee on a variable day or variable week schedule, the employee must make arrangements to work extra hours during other regularly scheduled workdays, or use annual leave, credit hours, or compensatory time off in order to fulfill the 80-hour biweekly work requirement.
This decision is not subject to dispute nor does it give rise to a claim under the contract.
The initial eligibility criteria are the same as that for Federal Employees and are listed at 3 FAM 2362.2. At any time with prior notification a contractor employee’s AWS can be terminated or modified for operational considerations related to workload demands.
All contractor personnel engaging in telework must complete the U.S. Department of State Contractor Telework Agreement, DS-5150 and GO Access for Contractors form.
