B-001 - Labor Categories

The labor rates specified herein are fixed hourly rates which include the following: wages, indirect costs (including overhead, fringe benefits and general and administrative expenses), and profit.

The Contractor and/or the Government may request adding to or deleting from the labor categories listed in Schedule B. If categories are added, the parties will negotiate the labor rate of said categories prior to incorporation into the contract.

All new labor rates shall be calculated in the same manner as in the Contractor's cost proposal submitted in response to the solicitation. The profit/fee rate shall be the same as in the Contractor's cost proposal submitted in response to this solicitation.

B-002 - Option Year Increases

The contract employer shall make the determination on FLSA status.

The Service Contract Act (SCA) requires contractors and subcontractors performing services on prime contracts in excess of $2,500 to pay service employees in various classes no less than the wage rates and fringe benefits found prevailing in the locality, or the rates (including prospective increases) contained in a predecessor contractor's collective bargaining agreement. The Department of Labor (DOL) issues wage determinations on a contract-by-contract basis in response to specific requests from contracting agencies. These determinations are incorporated into the contract. The contractor shall comply with applicable SCA provisions at all times.

The Fair Labor Standards Act (FLSA) establishes minimum wage, overtime pay, recordkeeping, and child labor standards affecting full-time and part-time workers in the private sector and in Federal, State, and local governments. Some positions under this contract are under the purview of the FLSA, and others are exempt. It is the contractor’s responsibility to comply with applicable FLSA wage provisions at all times, even if applicable prevailing wages have not been incorporated into the contract.

The contractor shall clearly indicate and label which positions/labor categories are covered by, or exempt from, the FLSA on any and all proposals and on the list of labor categories incorporated into the contract. In accordance with the terms and conditions of the BPA, contract option year hourly rates will be adjusted as follows:

FLSA EXEMPT POSITIONS

The maximum salary hourly rates shall be in accordance with the US Office of Personnel Man- agement (OPM) General Schedule (GS) Locality Pay table for Grades 7 through 15 (steps 1 through 10) and the Executive Schedule (ES)(levels V-I) for the geographical area specified on each call order, found atwww.opm.gov.

If and when the rates on the GS and ES pay tables are adjusted by Executive Order, then the contractor may submit revised rates accordingly. After negotiations with the contracting officer, the salary rate may be adjusted using the same rate adjustments provided by OPM for the GS and ES pay tables. The new rates will be incorporated and in effect after modification to the BPA contract.

The new rates will apply to any new Call Orders issued after modification is complete.

Existing Call Orders rates may be adjusted at the exercise of any subsequent Option Periods. Adjustments to labor rates will not be retro active and will be effective as per the modification signed by the Contracting Officer.

POSITIONS GOVERNED BY WAGE DETERMINATION

As defined by the FLSA and the SCA, certain contract labor categories are required to pay the wage rates established by DOL Wage Determination (WD15-4281, as amended). Contract rates will be adjusted in accordance with the terms and conditions of the amended wage determination.

The contractor shall monitor DOL’s Wage Determinations OnLine website(https://www.wdol.gov/sca.aspx) on a monthly basis for any changes to the applicable wage determination.

If the amended wage determination rates are higher than the current contract rates for applicable labor categories, the Contractor shall provide the updated rates for the overall contract, as well as the rates for each affected call order, by labor category, as a modification request to the contracting officer.

The Contractor shall notify the Contracting Officer of any rate increase, or decrease, claimed within 30 days after a new wage determination is issued. The notice shall contain a statement of the amount claimed and the change in fixed hourly rates, and any relevant supporting data, including payroll records, that the Contracting Officer may reasonably require.

Upon agreement of the parties, the contract hourly rates shall be modified in writing. The Contract- or shall continue performance pending agreement on or determination of any such adjustment and its effective date. New applicable rates will be incorporated to the BPA, and in effect, after fully executed modifica- tion to the BPA. Affected call orders will be modified accordingly to reflect new wage determination rates, and to provide funding for increased rates, as applicable.

(End of clause)

B-003 - Defense Base Act Insurance

If Defense Base Act Insurance is required, it will be ordered at the Call Order Level in accordance with DOSAR 652.228-71. The Contractor shall procure Defense Base Act (DBA) insurance directly from a Department of Labor (DOL) approved insurance provider. Approved providers can be found at the DOL website at http://www.dol.gov/owcp/dlhwc/lscarrier.htm.

B-008 - TRAVEL COSTS (Time-and-Materials/Labor-Hour)

1. All CONUS and OCONUS travel shall be pre-approved with a request from the Contract Firm to the COR for final approval.

Funds must be available before travel commences. All travel will be in accordance with the Federal Travel Regulation. Travel under this contract is defined as Contractor air and ground transportation, lodging, meals and incidental expenses, and passport/ visa costs.

2. The Contractor shall be responsible for ensuring that all personnel who will be required to travel outside the United States have current and valid passports. The Contractor shall also be responsible for obtaining any visas required for travel to foreign countries under this contract. The Contractor shall make no direct labor charges for obtaining/maintaining passports and/or visas.

3. The Contractor shall be paid allowable travel costs in accordance with FAR 31.205-46.

4. When local travel between the Contractor employee's regular place of performance and other locations is specifically authorized by the COR, transportation expenses shall be allowable costs under this contract. For the purposes of this clause, local travel means travel within a 50 mile radius of the Contractor employee's regular place of performance and does not include daily commuting or associated costs.

5. The Government will reimburse the Contractor for Contractor employee's travel time to or from other authorized work locations; except that for labor categories which are exempt from the Fair Labor Standards Act (FSLA), a reimbursement will be allowed only for travel during the employee's regular working hours. The Contractor will not be reimbursed for time spent in stand down or temporary layovers for the convenience of the Contractor by FLSA exempt contractor employees except as authorized by the Federal Travel Regulations.

6. For travel where use of a personal automobile has been specifically authorized by the COR, reimbursement shall be computed on the basis of actual miles traveled from starting point to destination. Other related miscellaneous expenses, such as tolls and parking fees, incurred in the performance of tasks authorized under this contract, will be reimbursed. Car rentals require advance approval by the COR and will be authorized only when consistent with good business practice. Allowable costs shall not exceed the actual cost of renting a compact automobile (a maximum of one for four Contractor personnel), unless extenuating circumstances (e.g., excess baggage) require other arrangements and subsequent COR approval is obtained.

7. Should any Contractor personnel be requested to perform in any area which has been determined by the Department of State to be a hazardous duty area, hazardous duty premium pay if and to the extent requested and allowed, will be payable at the same rate as would be given to Department of State direct-hire employees pursuant to Chapter 650 of the U.S. Department of State Standardized Regulations (Government Civilians, Foreign Areas).. Hazardous duty premium pay shall not be burdened with any indirect costs (e.g., overhead, G and A) or fee/profit.

8. The Government will pay the Contractor, under the applicable ODC-Travel CLIN(s), for each Contractor employee’s travel time to or from authorized work locations as long as the following are met:

i. Payment of travel time described herein is in accordance with the Contractor’s established travel policy.

ii. Travel time begins no earlier than two (2) hours prior to the scheduled departure time and concludes upon arrival to the initial destination point (e.g., airport) at the place of performance.

iii. The Government will not pay more than eight (8) hours per day per Contractor employee for travel time. See 29 CFR 785.39 Travel away from home community.

iv. The Government will pay for a Contractor employee’s travel time that is outside the employee’s regular working hours, as long as it the travel and duty day do not extend beyond 8 hours.

v. The Government will not pay a Contractor employee for more than the number of hours in the employee’s normal workweek. “Number of hours” includes productive time hours, travel time hours, and paid time off hours (e.g., sick, vacation, holiday), without COR/CO approval.

vi. Exceptions shall be authorized in advance, and in writing by the Contracting Officer.

Travel estimate template is found in Section J and will be used for all travel estimates and must be pre-approved before travel commences.

(FAR).

(end of clause)

Section C - Descriptions/Specifications/Statement of Work

C-001 - Statement of Work

STATEMENT OF WORK FOR GLOBAL SECURITY SUPPORT SERVICES

Background

The U.S. Department of State, Bureau of International Security and Nonproliferation, Nonproliferation and Disarmament Fund (ISN/ NDF) conducts activities around the world in support of: (a) efforts to halt the spread of weapons of mass destruction (WMD), their delivery systems, and conventional weapons systems, and (b) the destruction of existing weapons, delivery systems, and production facilities.

ISN/NDF occasionally learns of certain sites where (WMD), heavy conventional munitions or other dangerous materials are stored.

Often these sites have inadequate measures in place to ensure their security. In such instances, ISN/NDF takes necessary steps to upgrade security at sites that are vulnerable to non-state actor acquisition or proliferation activities. Given the current geopolitical climate, the need to secure these sites adequately is of the utmost urgency to U.S. national security and interests abroad. Consequently, security upgrade work must often be performed with little advance notice.

The U.S. Department of State, Bureau of Political-Military Affairs, Office of Weapons Removal and Abatement (PM/WRA) oversees the Department of State’s Conventional Weapons Destruction (CWD) efforts with the mission of reducing the threats posed to civilian security by at-risk, illicitly-trafficked, and indiscriminately-used conventional weapons and explosive remnants of war. CWD is defined as a set of explosive remnant of war (ERW) programs that includes humanitarian mine action (HMA), battle area clearance (BAC), small arms and light weapons (SA/LW) destruction—to include destruction of at-risk munitions, and man-portable air defense systems (MANPADS)—as well as large-caliber weapons and munitions, stockpile and cache reduction, and physical security and stockpile management (PSSM).

Scope

Under this Blanket Purchase Agreement (BPA), the Contractor will provide specialized subject matter expertise, including logistical support and planning, analytical services, design services, security systems materials, systems installation services, systems support services at foreign munitions/munitions systems sites, and CWD services. The general types of services are listed below.

Site survey

The Contractor will travel to foreign areas to collect information needed to develop a conceptual security plan. The Contractor will provide a report of each visit, and if directed, a written concept of operations appropriate for the specific location and associated security considerations.

Concept design

Using the results of the site survey, and other input documents and personal evaluations, the Contractor will produce a design concept that addresses the full protection of the target storage area and if needed the removal of the WMD, heavy munitions, or other dangerous material to a safer site. Any design concept must include general timelines, and an estimated full narrative budget supported by narrative details. In addition, the concept must address the following concerns:

- Adversary Assumptions

- Detection

- Delay

- Entry Controls

- Alarm Control and Display

- Assessment

- Response

- Regulatory and Standards Compliance

- Safety

- Site survey equipment

- Any Previously Unaddressed Risks

Detailed design

When directed by the Government, the Contractor will produce detailed security system designs for designated target storage areas.

Depending on circumstances, the Government may direct the Contractor to incorporate the results of a previously completed concept design, or to develop a completely new design. All designs must conform to appropriate recognized U.S. and international standards, such as: Underwriters Laboratories, U.S. Military standards for munitions storage areas, International Atomic Energy Agency (IAEA) for nuclear materials security, American National Standards Institute (ANSI), etc. The design packages will include detailed pricing and delivery information, and will cover the following types of security subsystems:

- Interior and Exterior Intrusion Detection

- Automated Entry Control

- Identification/Badging

- Biometrics (retina/fingerprint scanners)

- Custom secure storage solutions for high-consequence materials

- Alarm Control and Display Systems

- CCTV Systems with both visible and IR illumination

- Delay Devices, such as security doors, vaults, vehicle barriers, high security fences, etc.

- Site survey support kits

Supply and Support

When directed by the Government, the Contractor will provide complete security systems and deliver them to designated locations.

The Contractor will install and test the systems, and if directed, will train operators, maintainers, and responders in their use. The support requirement may also include systems, logistics, and advising on the types of weapons of mass destruction stored on-site and appropriate security solutions to mitigate threats as well as providing a sustainability package, such as site survey equipment and life support systems that will enable operation of the designated environment twenty-four hours per day.

Rapid Response

When directed by the Government, the Contractor will produce and ship within twenty-four hours of such direction, basic systems to provide temporary security solutions. These systems will provide limited protection at remote locations or manned locations when time is of the essence, and there is no opportunity to perform a formal site survey or concept design. These systems will be capable of installation by a one- or two- person team. They may be supplemented or replaced by more sophisticated systems using the design services described above following completion of a rigorous site assessment/survey and concept design.

Conventional Weapons Destruction

When directed by the Government, the Contractor will provide supplies and services for worldwide CWD activities, including but not limited to strengthening partners’ physical security and stockpile management (PSSM) capacity; explosive hazard survey, clearance, and risk education; emergency response; and activities that strengthen partner CWD capacity. While implementing these activities, the Contractor shall adhere to the International Mine Action Standards (IMAS) and National Mine Action Standards (NMAS) as well as applicable PSSM standards.

Section D - Packaging and Marking

D-002 - MARKING OF REPORTS

All reports delivered by the Contractor to the Government under this contract shall prominently show on the cover of the report:

(a) Name and business address of the Contractor;

(b) Contract number and delivery order number, if applicable;

(c) Date of report; and

(d) Program office(s).
