| Technical or Price | Solicitation Section #, Title & Page # | Question or Recommendation | Gov Response |
| Technical | Statement of Objectives, section 2 - Scope, pages 5&6 | Mid-trim and premium level trim for Standard and Pursuit vs VIP configurations. What elements of the trim constitute Premium vs mid trim? | Mid Trim is comensurate with Chevrolet "LS" trim, while Premium Trim is commesurate with Chevrolet "LT" trim package. |
| Technical | Statement of Objectives, Section 3 -Period of Performance, Page 6 | How many properties are required for Phase 9 and what level of vehicle is required, as well as the duration of testing to be completed in Phase 9. Can you provide more details regarding the testing that the governnet will perform during Phase 9? This impacts our build timing plans, the vehicle build count, and we want to comprehend this testing in our overall development plan timing. | One first article of each configuration shall be provided. First Articles will undergo vehicle characterization, max effort braking, steering and handling, and speed and acceleration testing. Durability testing will consist of 15,000 miles, 35% highway, 35% paved roads in traffic conditions, 15% Gravel, 15% unimproved/dirt roads. This will be completed in 150 days after receipt of the vehicles, unless failures occur. Any required repairs will cause day for day slips in testing. |
| Technical | Statement of Objectives, Section 3 -Period of Performance, Page 6 | How many properties are required for Phase 10? Since all are Level D protection, is a single property sufficient for Phase 10 testing? What level of property can be utilized for Phase 10 testing? Does it need to be the latest intent or could it be one of the earlier builds? It would have the latest intent protection package, but does the chassis/rest of the vehicle need to be latest intent? | One asset is required for survivability testing for each armored cell design. If only one design is used across the variants then one design can be submitted, provided analysis can demonstrate continuity. The latest chassis is required in order to provide a full system response to testing. |
| Technical | Program Objectives, contractor personnel, page 8 | What specific parts of the program are driving the Top Secret requirement - is the threat and testing the only portion? What specifically requires handling as Top Secret during the development phase? The SOO identified Secret level requirements. | TS is required due to the armor vulnerabilities and capabilities. |
| Technical | Program Objectives for the Governent, Achieve a forward-facing solution, page 9 | Are the Phase 9 and Phase 10 prototypes the physical properties that meet this requirement? | Yes, the prototypes provided for phases 9 and 10 will validate that requirements have been met and will establish the baseline configuration for production. |
| Technical | Program Objectives for the Governent, Achieve a forward-facing solution, page 9 | To verify our assumption, the line stating that the prototype will carry OEM warranty and maintenance packages when produced means we design and the develop vehicle under the expectation of OEM warranty for the production phase. The prototypes do not have any warranty expectations. Is this accurate? | This is accurate. Prototypes may require manufacturer support during prototype testing in order to complete testing and establish quality and reliability metrics. Production vehicles are expected to carry the full OEM warranty. |
| Price | Anticipated Award Type, page 2 | Can you provide more clarity on the following statement: The government contemplates entering into a combincation FFP and T&M type contract. In particular, can you clarify what portion of the contract pricing is Firm Fixed Price vs Time and Material. Our current assumption is the time and material covers the labor, and the firm fixed price covers the material and cost of vehicle. Is this accurate? | Offerors are encouraged to quote FFP for as many items as can be accurately estimated. For example, Any Project Management (PM) support can likely be quoted as FFP, since it is typically a known quantity. |
Labor can be proposed as full time employees (FTEs) or Part time employees (PTE) on either a FFP or LH CLIN basis, with or without extra "additional hours" LH CLINs to cover any additional hours that might be needed.
Materials, if known with a relative amount of certainty, can be quoted as FFP, or can be treated as ODC CLINs as "not to exceed" billable based on actuals.
Finally, Travel and ODCs can be quoted as CLINs with a "not to exceed" amount, to be charged against based on actuals.
| Price | n/a | Is the DOS providing any funding assistance for the development of this vehicle? If yes, what is the amount and its terms? | DOS is funding this effort, using existing commercial designs and modifying them for Government use. Any commercial design work prior to this project will not be reimbursed. |
| Price | F. Performance, Period of Performance, Page 17 | What is the annual volume of units that will be purchased from this solicitation? | This solicitation is for prototype development. Production, if sought, will be pursued under a subsequent requirement/solicitation. |
| Price | F. Performance, Period of Performance, Page 17 | DOS indicates that the contract term is 3 years (one base year and two optional years), can this RFP be revised to provide a longer term to 8 years? | If more time is needed to develop prototypes, please indicate this to the CO via email as soon as possible, including rationale for the extended period. The Government may consider flexibility in project timeline. Production is not intended to be a part of this requirement, only modification of commercial chassis for Government use resulting in a prototype. |
| Technical | C. Statement of Objectives, III. Scope, Page 5 | DOS indicates that FMVSS compliance is preferred, but not required. If crash testing not required, and one potentail supplier crash tests and the other does not crash test, will this be a basis on the award? | Where preferences are indicated, the Government has a preference for one condition over another. In the case of competition, the presence of a preferred feature may result in a higher evaluation rating for the offer that includes it. Please note that the Government also reserves the right to issue multiple awards as a result of this solicitation. |
| Technical | C. Statement of Objectives, III. Background, Page 7 | Ford Motor Company understands it must be the prime contractor and will oversee modifications of this vehicle by an armoring upfitter at their facility, Ford believes that this is this acceptable. Just checking, DOS is this acceptable? | This is acceptable. The Government encourages small business subcontracting. Note, the prime contractor is responsible for any work performed by its subcontractor(s). |
| Price | F. Performance, Period of Performance, Page 17 | What is the latest acceptable date for delivery of the first vehicle? | The Government anticipates the project to take up to 3 years, but offerors may indicate a different time schedule with accompanying rationale for discussion. See Row 11 above. |
| Technical/Price | Proposal content requirements, Formatting requirements, section vi, page 89, Proposal organization instructions - L.A.2.a.ii.c and d, page 92, and L.B.1.a, page 94 | The RFP states: The non-price volumes shall not include any price information. However, we are asked to provide items in the Technical Volume such as: Total dollars for work estimated to be subcontracted or performed by another entity; Total dollars estimated for work to be performed by the prime; Payment schedule for the project (in the SOW). Can you please clarify that complying with each ask in Section L of the Technical Volume does not violate the initial statement about non-price volumes including any procing information. | The Government confirms that complying with these sections does not violate the directive to keep pricing information out of the technical volume. To clarify: do not imbed complete pricing information within the technical volume. Partial information, such as high-level subcontracting breakdowns, milestone schedule for payments (can be expressed in terms of % of quoted price assigned to milestone dates), etc. are not considered "pricing information" for the purposes of this RFP. |
| Price | Section F. Performance - Deliverables - Example f Deliverables pg 17 - RFP Master | In the case the contract is proposed using FFP for all work with the exception of ODC, is there a Labor expenditure or Total Task expenditure reporting requirement? Or are these examples of deliverables considered more applicable to a T&M type of contract pricing? | If a solution is quoted as FFP, the expenditure items referenced will not be applicable in the resultant contract, if awarded. |
| Technical | Safeguarding of information | the RFP states, in part, that “All documents and records (including photographs) generated during the performance of work under this contract shall be for the sole use of and become the exclusive property of the Government.” This statement conflicts with the general principle in government contracting that contractor-generated technical data shall be owned by the contractor and licensed by the government and puts contractor intellectual property at risk. Please clarify the of documents and records to which this requirement is intended to apply | This language was included in error, and has been removed. |
| Technical | Safeguarding of information | the RFP states, in part, that “All documents are to be controlled and disseminated on a strict need to know basis. Reproduction is prohibited without express written approval of the Government.” Please clarify what the government means by “all documents.” For instance, can you confirm that documents reflecting the offeror’s pre-existing technical information and other intellectual property will not be subject to this restriction? | This language was edited to clarify that this refers to classified documents only: "All classified documents are to be controlled and disseminated on a strict need to know basis. Reproduction of classified material is prohibited without express written approval of the Government." |
| Technical | FAR 52.227-18 | The RFP’s “Permits and Licenses” references FAR 52.227-18—Rights in Data – Existing Work. Please clarify the specific works to which this clause will be made applicable | This language was included in error, and has been removed. Only "Rights in Data - General" applies. |
| Technical | FAR 52.222-62 | The RFP incorporates FAR 52.222-62, Paid Sick Leave Under Executive Order 13706. Please confirm that this clause will not apply to the contract if all of the workers on the contract are exempt under the Fair Labor Standards Act and, therefore, not subject to the requirements of the Service Contract Act. | If Service Contract Labor Standards statute and FAR clause 52.222-41 do not apply to the resultant award, clauses 52.222-62 and 52.222-41 will not apply or be included in the resultant award. |
| Technical | FAR 52.225-1 | The RFP incorporates both FAR 52.225-1, Buy American—Supplies (May 2014) and FAR 52.225-5, Trade Agreements (Oct 2019). Typically, per FAR 25.2201(c)(1), FAR 52.225-5 is only incorporated when FAR 52.225-1 is not applicable. Please consider removing FAR 52.225-5, Trade Agreements (Oct 2019) from the solicitation, assuming this acquisition falls within the exception at FAR 25.401(a)(2) for acquisitions of arms, ammunition, or war materials, or purchases indispensable for national security or for national defense purposes, or within the exception for research and development at FAR 25.401(b)(5), because this contract contemplates development effort, which is an exception to the Trade Agreements Act. | FAR 52.225-5 is hereby removed, and a clarification regarding FAR 52.225-1: while this RFP is for services, the intent of incorporating this clause to the RFP is to emphasize that the prototype designed under an award resulting from this specific RFP should be designed in a manner which facilitates compliance with the Buy American statute, should the prototype be reproduced in later production for Government use. |
| Price | F. Performance, Period of Performance, Page 17 | How many prototype vehicles are required including all phases? | Four prototypes are required; one standard configuration, one pursuit configuration, one VIP configuration, and one VIP-executive configuration. |
| Price | F. Performance, Period of Performance, Page 17 | Is it acceptable for the first prototype to be delivered in the 3rd Quarter, 2022? | All four prototypes will be a product of Phase 6 and will tested in Phases 7-10. |
| Price | B. Supplies or Services Prices / Costs, Payment and Ceiling, Page 3 | Please advise how the development costs are reimbursed. Is the awardee paid upfront or quarterly? Or and other terms for reimbursement? | Payments may be scheduled to coincide with each milestone of the project; i.e. the Phases shown under SOO Section III: Period of Performance. Offerors are encouraged to propose a payment schedule that coincides with the proposal's project schedule so that payment is made after milestones and/or deliverables are met. Advance payments are not authorized for this requirement. |
