About this file

This document is a justification for a sole source award for generator repair services. The Federal Bureau of Prisons FCC Coleman facility required repair of Generator 8, a Caterpillar Model 3516-DITA, to maintain backup power for critical operations including food storage facilities. The repair value was $118,031.94. Due to the proprietary nature of Caterpillar parts and training, only the manufacturer-authorized service center Ring Power could perform the work. A subsequent award notice shows contract 15B30224Q00000002 was issued to Ring Power on February 8, 2024 for the stated amount, with the Department of Justice Bureau of Prisons as the contracting agency. Failure to immediately repair the generator would have compromised food supplies, vehicle fueling, and waste disposal across multiple institutions.

SINGLE SOURCE OR LIMITED SOURCES JUSTIFICATION

(APPLICABLE TO PURCHASES $3,500 - $150,000)

1. Contracting Activity:

Federal Bureau of Prisons

FCC Coleman, Facilities Dept.

846 N.E. 54th Terrace

Coleman, FL 33521

2. Purchase Request Number:

3. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED:

Provide service of the removal, troubleshooting, repairing, servicing, reinstallation, testing, and calibration of the generator portion of generator #8 at the FPC RUB (GEN-8-1-S-COA), Caterpillar

Model # 3516-DITA; Serial Number: 25Z04357: $118,031.94

4. DESCRIPTION OF SUPPLIES OR SERVICE REQUIRED TO MEET THE AGENCY NEEDS:

POC: Ring Power; Marc Millian; 352-817-1892; Mark.McMillian@RingPower.com. The generator that is offline is a Caterpillar Model 3516-DITA. Caterpillar is proprietary with their manufacturer parts, technicians, and training. Caterpillar eliminates competition by having designated authorized service centers in designated “regions”. Service centers and technicians are prohibited from crossing into other regions. Ring Power is the only Caterpillar authorized service center for our area. Due to the enormous price tag on a new generator, only manufacturer authorized and trained technicians, and manufacturer parts are permitted to be used for repairs to the generator. Attempts to obtain pricing from other service centers have resulted in us being referred back to the local authorized Caterpillar service center – Ring Power. Additionally, this vendor has performed work for FCC Coleman in the past and has performed exceptionally well with high quality work.

5. AN IDENTIFICATION OF THE STATUTORY AUTHORITY PERMITTING OTHER THAN

FULL AND OPEN COMPETITION:

41 U.S.C. 3304(a), (2), as implemented by FAR 6.302-2, “Unusual And Compelling Urgency”:

Time is of the essence and does not permit the use of normal full and open competition procurement procedures. Due to these extreme circumstances, the procurement will be completed under the authority found at FAR 6.302-2, Unusual and Compelling Urgency. Market research was not conducted as it known from previous experience that Caterpillar is proprietary with their training, technicians, and parts.

6. THE NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY CITED DUE

TO THE FOLLOWING:

This generator is the sole back-up power source for the FPC, Garage, Food Service Warehouse, and institution’s lift stations. In the event power is lost from the electric company, which occurred on the morning of February 3, 2024, the FPC will be without power. More importantly, the coolers and freezers holding the food supply for the FPC will not operate and the inmate food supply will spoil.

The Food Service warehouse will not have power, which holds the inmate food supply for the entire complex. Without emergency power, and should the units be without power long enough, the food supply for all five institutions would spoil and be discarded, creating a huge security issue and would completely disrupt the orderly running of all five institutions. Without this repair, the Garage would be without power, including the fuel pumps. Should the power stay off long enough, perimeter patrol vehicles would not be able to refill their engines, so there would be no perimeter patrols, which is a security issue. Finally, without this repair, the sewage lift stations, and the main lift station will not mailto:Mark.McMillian@RingPower.com operate. Without the lift stations operating for a long enough period of time, sewage will begin to back up into each institution, which would affect the orderly running of the institutions.

7. EFFORTS TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL

SOURCES AS IS PRACTICAL:

Time is off the essence and does not permit the use of normal full and open competition procurement procedures. Due to these extreme circumstances, the procurement will be completed under the authority found at FACR 6.302-2, Unusual and Compelling Urgency.

8. DETERMINATION THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE

FAIR AND REASONABLE:

The Contracting Officer anticipates the cost to the Government will be fair and reasonable based upon the competitive pricing received from Ring Power in the past.

9. DESCRIPTION OF MARKET SURVEY;

An electronic survey of the Disaster Response Registry has been conducted and a highly rated contractor known to have previous experience in this type of repairs has been identified.

10. OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN

COMPETITION: Failure to immediately repair this generator will place hardships on the BOP, staff and inmates. This generator is the sole back-up power source for the FPC, Garage, Food Service

Warehouse, and institution’s lift stations. Finally, without this repair, the sewage lift stations, and the main lift station will not operate. Without the lift stations operating for a long enough period of time, sewage will begin to back up into each institution, which would affect the orderly running of the institutions.

11. LIST OF SOURCES THAT EXPRESSED, IN WRITING, AN INTEREST IN THE

ACQUISITION:

None.

12. ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REPMVE OR OVERCOME ANY

BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION FOR THE

SUPPLIES OR SERVICES REQUIRED:

Future acquisitions will be completed when practical.

13. CERTIFICATIONS:

I hereby certify that the supporting data provided by the technical and requirements personnel that for this basis for justification is complete an accurate to the best of my knowledge.
