JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

Pursuant to the Federal Acquisition Regulation (FAR) 6.302-1 (c) (1) as well as the Bureau of Prisons Acquisition Policy (BPAP) 6.304(b), the Federal Bureau of Prisons (FBOP) has determined that the procurement to Replace Lift Station Bar Screen at the Federal Correctional Institution in Butner North Carolina, meets the criteria established for other than full and open competition. This limitation on competition is justified as supported by the following information:

1. IDENTIFICATION OF THE AGENCY AND THE CONTRACTING ACTIVITY:

Department of Justice Federal Bureau of Prisons FCC Butner 1000 Old NC Highway 75 Butner, NC 27509

2. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED:

This action is for acquisition of replacement of existing Huber Lift Station Bar Screen and Press to Huber Lift Station Bar Screen and Wash Press for the Federal Correctional Complex (FCC Butner) in Butner North Carolina.

3. DESCRIPTION OF SUPPLIES AND SERVICES REQUIRED TO MEET THE

AGENCY’S NEEDS (INCLUDING ESTIMATED VALUES)

FCC Butner has a requirement for the provision of all materials necessary to replace the complex Sewage Lift Station Bar Screen and Press. This action covers only the Huber Lift Station Bar Screen and Press. The Lift Station Bar Screen and Press have an estimated value of $140,000.00.

4. IDENTIFICATION OF THE STATUTORY AUTHORITY PERMITTING OTHER

THAN FULL AND OPEN COMPETITION:

41 U.S.C. 253(c) (2), as implemented by FAR 6.302-1 (c)(1), “Only one responsible source and no other supplies will satisfy agency requirements. Application for “brand-name description”. It is determined that the procurement of replacement of the Sewage Lift Station Bar Screen and Press at FCC Butner, meets the criteria established for other than full and open competition for the product required.

5. DETERMINATION THAT PROPOSED MANUFACTURE’S UNIQUE

QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE OF THE

AUTHORITY CITED:

The existing Sewage Lift Station Bar Screen at FCC Butner has been rebuilt twice already in ten years. The lift station has several problems with it at this time. It is feared that this lift station could fail at any time. This sewage station serves all five Institutions at FCC Butner. The existing lift station bar screen and press are was made by Huber. The pit at the lift station was built to house a Huber bar screen. After research it has been determined that other manufacture bar screens would not fit into the space that the Huber currently fits into. The pit would have to be modified, all electrical and plumbing would have to be changed. Any work like this could cause shutdown of the sewer lift station. Which would require FBOP to have someone to come in and pump out the manhole prior to the pit and we would have to have all waste water hauled offsite. This would be a added cost to the government. The purchase of the Huber bar screen and wash press would fit into the existing location with minimal impact and changes.

The impact of failure of the lift station

6. EFFORTS TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY

POTENTIAL SOURCES AS PRACTICAL:

It is not the intention to limit the prospective contractors solicited to bid on this project, only that the new upgraded system should interface with the existing system equipment and peripherals that are to remain. The procurement will solicit from more than one source for the acquisition.

In accordance with FAR 5.102(a)(6) and 11.105(a)(3), this approved JOFOC will be posted with the solicitation at www.fbo.gov.

7. DETERMINATION THAT THE ANTICIPATED COST TO THE GOVERNMENT

WILL BE FAIR AND REASONABLE:

The Contracting Officer anticipates the cost to the Government will be fair and reasonable. More than one company has expressed interest in quoting on the requirement for the Huber system.

8. DESCRIPTION OF MARKET RESEARCH:

The FBOP has researched other manufactures of bar screens and wash presses. It has been determined that other manufactures bar screens would not fit into the pit the same way the Huber does.

9. OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN

COMPETITION:

To upgrade all existing peripherals and systems to remain would not only cost more, but would also require much more time than presently allotted for an upgrade utilizing the same manufacturer. The existing pit was designed for the Huber bar screen dimensions. Any change of size would cause undo work to fit a bar screen into the pit.

10. SOURCES THAT EXPRESSED, IN WRITING, AN INTEREST IN THE

ACQUISITION:

No other sources expressed in writing an interest in the acquisition.

11. ACTIONS TAKEN BY THE AGENCY TO REMOVE OR OVERCOME BARRIERS

TO COMPETITION:

FCC Butner will continue to monitor the market trends in the industry to seek competition or sources that may be able to meet the minimum needs of the Government and its lift station bar screen replacement. Should opportunities arise in the future; FCC Butner will take appropriate action.
