Trash Collection and Disposal Boston National Historical Park

ATTACHMENT 001REV01,

Statement of Work

SECTION 1

1.1 GENERAL DESCRIPTION:

The Contractor shall furnish all labor, transportation, equipment, materials, supplies and supervision necessary to collect and dispose of trash, refuse, landscape debris and garbage from Government property.

1.2 LOCATION:

The work is located at Boston National Historical Park, Charlestown Navy Yard, Boston, MA.

The exact locations of containers to be placed in the Navy Yard are identified in Attachment 002.

1.3 PERIOD OF PERFORMANCE:

The Base Contract Performance Period is April 1, 2024 through March 31, 2025.

There will also be four one-year option periods, beginning April 1, 2025.

1.4 CONTITIONS AFFECTING THE WORK:

Offerors are encouraged to visit the site and take steps reasonably necessary to ascertain the nature and location of the work, and the general and local conditions which can affect the work and the cost thereof.

1.5 ORDER OF WORK AND SCHEDULES:

The Contractor shall arrange his work so as not to cause interference with normal conduct of Government business. All work shall be conducted between 5:30 a.m. to 9:30 a.m. at Charlestown Navy Yard. Due to public visitation in these areas, the above schedule must be adhered to unless otherwise requested by the Contracting Officer Representative COR.

1.6 WORK LIMITATIONS:

No additional or extra work shall be done by the Contractor for which he expects compensation without the additional work being ordered in advance and confirmed in writing by the Contracting Officer.

Required services shall be provided on all federal holidays that fall on scheduled pickup days except Thanksgiving, Christmas, and New Years.

1.7 QUALITY OF WORK:

For the facilitation of the business to be conducted herein, first rate quality services are required. Hasty and careless performance of the work will not be accepted. Evidence given of such practices as spillage around the containers, trash falling from the Contractor's truck, and work that is otherwise sloppy and unsatisfactory will be called to the attention of the Contractor who will be required to clean up the areas in question and to initiate immediate action to improve the work and insure satisfactory results.

1.8 DAMAGE OR LOSS OF CONTRACTOR'S PROPERTY, BUILDINGS, AND

EQUIPMENT:

The Government does not assume any liability from fire, theft, accident, or any other cause resulting in damage or loss of Contractor's materials, equipment, personal property or belongings of his employees.

The Contractor shall use equipment and perform work in a manner to prevent damages to the government’s infrastructure facilities, including all landscaped areas, sidewalks, curbs, and streets. The Contractor shall repair any damages caused by the Contractor’s equipment in a timely manner and at no expense to the government.

The Contractor shall save and hold the government harmless from and against all liability, claims and demands on account of personal injuries, or property loss or damages of any kind whatsoever, which arise out of or be in any manner connected with, or are claimed to arise out of or be in any manner connected with the performance of this contract, regardless of whether such injury loss or damage shall be caused by, or be claimed to be caused by, the negligence or other fault of the Contractor, any subcontractor, agent or employee.

1.8 PROTECTION OF GOVERNMENT PROPERTY, BUILDINGS AND EQUIPMENT:

The Contractor shall take all reasonable steps to ensure that the trash pick-up and disposal operations will be carried out so as not to cause a safety hazard to the public and visitors at the work sites. The Contractor shall be responsible for control of pedestrian and vehicular traffic in the work area. Where hazardous operations are conducted by the Contractor, standing signs shall be provided by the Contractor and placed to call Park employees' and visitors' attentions to the fact that the area is affected by such a hazard.

The Contractor is responsible for obtaining all applicable environmental and regulatory permits prior to the Contractor commencing operations.

1.10 SAFETY:

The Contractor shall adhere to all OSHA Safety Regulations.

All drivers must contain valid driver’s licenses. All trucks and other equipment must follow all applicable federal, state, and local laws and regulations. All trucks and other equipment shall be equipped with back up alarms. Trucks must be large enough to collect all dumpster waste.

All trucks and equipment used to haul debris shall be equipped with a tailgate that will effectively contain the debris during transport. All equipment shall follow load capacity regulations. No capacity can exceed 100% of the measured allowable load capacity. The Contractor is responsible for ensuring all loading and transport equipment complies with federal, state, and local laws.

The Contractor, prior to use, shall inspect all equipment to ensure the safety of the equipment, in accordance with the manufacturer’s operating instructions, OSHA, and all federal, state, and local rules and regulations.

1.11 DEFICIENCIES, CORRECTIVE ACTIONS:

If deficiencies are identified, the Government reserves the right to correct those deficiencies using one or in some cases a combination of the following:

Stop Unsafe Work: The government authorized representative may immediately stop work on the job affected by a safety hazard, until it is corrected.

Issue Stop Work Order: If the Government’s agent determines the deficiency is serious, the Government representative and issue a stop work order.

The Government may discuss corrective actions with the Contractor to prevent future occurrences.

The Government will notify the Contractor in writing of any observed noncompliance of any Federal, State, or local law and/or regulation. Upon receipt of notice, the Contractor shall immediately inform the Government of proposed corrective action and take such action. If the Contractor fails or refuses to comply promptly, the Government may issue an order stopping all or part of the work until satisfactory corrective action has been taken. No part of the time lost due to any such stop orders shall be made the subject of a claim for extension of time, or for excess costs or damages by the Contractor.

SECTION 2 PERSONNEL, MATERIALS AND EQUIPMENT

2.1 CONTRACTOR'S OFFICE AND REPRESENTATIVE:

The Contractor shall assign a responsible representative who will serve as the primary contact with the Contracting Officer and the Contracting Officer's Representative (COR). This person shall be responsible for correcting any deficiencies in contract performance. The Contractor's representative shall be authorized to provide sufficient personnel and/or equipment to correct deficiencies in accordance with the terms of the contract.

2.2 ADEQUATE AND COMPETENT SUPERVISION:

This shall be provided at all times, for all work done by the Contractor's employees to assure performance and accomplishment in strict accordance with the terms of this contract.

Supervisory responsibilities shall include but not be limited to the following:

(A) To provide an adequate labor force including immediate replacements for personnel dismissed for cause or leaving employment of their own volition.

(B) To train personnel properly on performing work in accordance with Trash Removal tasks and methods outlined herein.

(C) To prevent general carelessness in Trash Disposal operations, abuse of facilities, and instruct employees to abide by safety rules and regulations for the protection of Government employees, visitors, and themselves.

(D) To instruct employees to turn in found items for Government safekeeping.

2.3 SUPPLIES, MATERIALS, AND EQUIPMENT:

(A) Except as otherwise specified herein, the Contractor shall furnish all supplies, materials, and equipment, (i.e., the containers identified in 3.2 below), necessary for performance of the work.

(B) The containers shall be watertight and fire retardant with lids and/or doors that can be tightly closed and locked if necessary. The Contractor will be responsible for the maintenance and repair of the containers at no cost to the Government.

(C) All vehicles and equipment shall be operated by qualified and licensed operators and so as not to harm human health or the environment. Contractor to ensure that liquids leaking from waste are captured and contained on the truck and spillage of such liquids to the streets is prevented. All vehicles shall meet environmental emission requirements and be subjected to inspection.

(D) The Contractor shall have the ability to dispose of ALL trash, yard waste, and other debris at a location that allows for the Park to place all the generated waste in the designated dumpsters adhering to federal, state, and local rules and regulations.

2.4 PERSONNEL ATTIRE:

Contractor's personnel performing work under this contract shall be dressed in attire that is as neat and clean as is practical for the accomplishment of their duties. Removal of shirt or sweater is permissible provided an undershirt is worn.

2.5 PAYMENTS:

Payments will be made monthly in arrears for services satisfactorily rendered during the preceding month in accordance with the Contract Schedule and the Prompt Payment Act.

SECTION 3 DETAILED SERVICE

3.1 TYPES OF MATERIALS TO BE DISPOSED OF:

Generally, materials to be disposed of will consist of, but not limited to, office rubbish, household rubbish, leaves, tree branches, landscape debris, insulation, boxes, cans, crockery, rags, rubber, leather, wood, sawdust, glass, and metal items such as tin, iron, steel, etc. Other materials may be empty latex paint cans, packing materials, waste excelsior, and sand blast grit and residue. Items of rubbish and refuse will vary greatly in size; however, the majority of items will be combustible. Larger pieces of wood and construction materials may be disposed of in the 30-yard roll-off container.

DISPOSAL AND TRANSFER:

The Contractor shall dispose of refuse to officially licensed federal, state, or local disposal facilities only. No dumping of waste shall be made to drains, sewers, open lands, quarries, rivers, channels, swamps, or other locations not officially licensed. Contractor is responsible for ALL disposal fees, permits and licensing requirements.

3.2 COLLECTIONS:

Navy Yard location:

1) 8 Yard Containers -- Contractor shall be required to provide and maintain four (4) 8-yard steel containers with top or side hinged covers or doors. The location of these containers will be identified by the COR during the site visit and the attached site maps.

Pick-up of each of these four containers shall be three times per week on Mondays, Wednesdays, and Fridays, including all Federal holidays except Thanksgiving, Christmas, and New Years. Pick-up time MUST be PRIOR to 9:30 a.m., but no earlier than 5:30 a.m.

2) 15 Yard Container -- Contractor shall be required to provide and maintain one (1) 15-yard dump trailer/roll-off for the collection of landscape/yard debris. The location of this container will be identified by the COR and attached site map. Pick-up of this container shall be determined by the Contractor or on-call from the National Park Service as the container becomes full to the limit that the collection vehicle can safely transport it for exchange.

Contractor shall routinely inspect the 15 Yard Container to ensure that the Government can always utilize it and notify the COR when a pick-up will be completed. Pick-up shall be PRIOR to 9:30 a.m., but no earlier than 5:30 a.m. Historical data depicts an average of 10-15 pick-ups per year, however this contract has no limitation as to the number of pick-ups that may be required, and Contractor is obligated to ensure the Government can always utilize the dumpster.

3) 30 Yard Container -- Contractor shall be required to provide and maintain one (1) 30-yard dump trailer/roll-off. The location of this container will be identified by the COR and attached site maps. Pick-up of this container shall be determined by the Contractor or on-call from the National Park Service as the container becomes full to the limit that the collection vehicle can safely transport it for exchange. Contractor shall routinely inspect the 30 Yard Container to ensure that the Government can always utilize it and notify the COR when a pick-up will be completed. Pick-up shall be PRIOR to 9:30 a.m., but no earlier than 5:30 a.m. Historical data depicts an average of 10-12 pick-ups per year, however this contract has no limitation as to the number of pick-ups that may be required, and Contractor is obligated to ensure the Government can always utilize the dumpster.

The Government reserves the right to notify the Contractor to have the containers removed or relocated due to Park events, safety issues, or any other need that may arise. The Contractor will be notified with sufficient time to make the arrangements. These options shall be included within the boundaries of the contract at no extra charge to the Government.

3.3 SANITARY CONDITIONS:

The Contractor shall dispose of the trash in such a manner as not to cause conditions detrimental to public health or to constitute a public nuisance. The Contractor shall assume full responsibility for compliance with all Federal, State, local, rules, and regulations governing removal and disposal of waste materials. Due care must be exercised to prevent leakage or scattering of waste to the grounds of Boston National Historical Park and the pick-up area must be left in a clean and sanitary condition. The Contractor will be responsible for the removal of trash or spillage which occurs on the Park grounds as a result of the waste removal equipment used by the Contractor.
