Performance Work Statement Compliance Testing of all Yellowstone National Park
Under Ground Fuel Storage Tanks Background
Yellowstone National Park is situated approximately 60 miles South of Livingston, MT 59047.
The Park is comprised of two main loops, known as, Lower loop and Upper loop. Storage tanks containing petroleum products are located throughout the park in both loops (Maps linked in Section 15).
1. Description of Work In carrying out work under this contract, the awarded Contractor shall furnish the personnel, services, equipment, tools, materials, vehicles, facilities supervision, and other requirements necessary for all inspecting and testing of regulated underground fuel storage tanks spelled out within this Performance Work Statement.
The Contractor shall be immediately capable of addressing and interpreting all aspects of applicable Federal, State regulations, and industry standards related to the testing and inspecting of underground fuel storage tanks.
Yellowstone National Park has an inventory of underground storage tanks, these tanks store petroleum products and are equipped with tank gauging and release detection systems. In order to maintain compliance with Federal, State, and local tank regulations, it is necessary to periodically conduct integrity testing, containment testing, evaluation of tank gauging and release detection systems, and DEQ compliance evaluations.
2. Objectives The objective of this work is to conduct integrity testing, compliance evaluations, containment testing, evaluation of specific (ATG) automatic tank gauging and release detection systems.
A list of underground storage tanks which shall require integrity testing and containment testing in accordance with Montana and Wyoming DEQ Administrative Codes is provided.
In addition, integrity testing, containment testing, and operational compliance inspection and documentation of other specific tank systems may be necessary depending on condition of tanks, tank monitoring systems, and suspected problems or leaks. All operational compliance inspections on underground storage tanks shall be conducted and documented in accordance with State and Federal Bureau of Underground Storage Tank Regulations requirements.
3. Service Delivery Summary
Objective Performance Standard Monitoring Method The contractor shall deliver inspection report for all regulated underground fuel storage tanks not later than the morning of the final day of the period of performance.
-Inspections must meet Montana and Wyoming DEQ Administrative Codes.
-The COR will periodically monitor the Contractor’s performance and review all inspection checklists for completeness and accuracy.
-The NPS will review the final inspection reports for accuracy and completeness prior to the contractor’s distribution to Montana and Wyoming DEQ Offices.
4. General Contractor Requirements The Contractor shall furnish all labor, materials, equipment, and supplies necessary to complete the requirements of this SOW within the schedule specified below. All costs incurred in completion of this SOW will be borne by the Contractor.
5. Government provided information
a) All park service monthly testing documents.
b) Tank construction type
c) Yellowstone National Park shall provide a Licensed Class A operators as a technical expert for access and tank orientation.
6. Deliverables
Documentation of work performed under this scope:
a) The awarded contractor shall follow all State and Federal regulations for testing and inspection of regulated underground fuel storage tanks.
b) Documentation of work performed shall be submitted to the (COR) Contracting Officer
Representative.
c) The full report shall include:
1. Operators’ annual inspection report for all facility (see attached table)
2. All forms and data completed in accordance with attached table.
3. All the Federal and State required information as per attached table.
d) The awarded contractor shall provide one electronic copy of all generated inspection reports to Yellowstone National Park COR.
e) The awarded contractor shall submit electronically to the respective state’s DEQ in accordance with State regulations and requirements. Each state DEQ must provide acceptance. If an Office rejects a submission, then the contractor is responsible for resubmission. Proof of acceptance from the respective state's DEQ is to be provided to the COR by the contractor.
7. Contractor Qualifications All work under this scope shall be performed by an experienced individual(s) with demonstrated knowledge of underground fuel storage tank systems. The awarded contractor shall possess all necessary license and certification for both Wyoming and Montana to perform work as an underground storage tank (UST) testers and inspectors. Evaluation of Veeder-Root and other Automatic Tank Gauging (ATG) and release detection systems shall be performed by an individual knowledgeable of these systems. Prior to start of work, the contractor will work with the appointed COR to assure the NPS that all necessary licenses and/or certifications are possessed. The respective state DEQ Offices may reject data submitted by a contractor that does not possess all required licenses and/or certifications to perform this work.
8. General Provisions All reports, maps, photographs, notes and other work developed in the performance of this contract shall be and remain the sole properties of the Government and may be used by the Government on any other work without additional compensation to the contractor. The contractor agrees not to assert any rights and not to establish any claim with respect thereto. The contractor agrees to furnish all retained materials on the request of the contracting officer. The contractor shall be responsible for the accuracy and validity of the material presented in their reports.
9. Scheduling The Contractor shall schedule all work to be performed in advance with the COR to ensure regulatory compliance dates are met. The Contractor shall obtain approval from the COR for all schedules of work to be performed. Schedules may have to be modified in the case of incidents or emergencies, to include natural hazards, furloughs, or similar circumstances.
10. General Instructions to the Contractor The following conditions shall be observed by the Contractor - Any work performed in/around Yellowstone National Park shall be coordinated with the National Park Service YNP COR. The awarded contractor’s POC shall coordinate all activities on behalf of the contractor prior to mobilization.
The contractor shall abide by all applicable YNP traffic laws.
11. Hours of Operations The Contractor will have access to perform services during normal working hours.
Normal working hours at YNP are typically 7:00AM – 4:00 PM Monday through Friday. Contractors shall submit a request, in writing, to the Contracting Officer and Contracting Officer Representative for any work planned for weekends or federal holidays. Authorization must be received from the Contracting Officer prior to performing the requested weekend or holiday work.
Unless otherwise required by the Government, the Contractor shall not have access to Government facilities on the following Federal holidays:
New Year’s Day, Martin Luther King’s Birthday, President’s Day, Memorial Day, Juneteenth, Independence Day, Labor Day, Columbus Day, Veterans’ Day, Thanksgiving Day, and Christmas Day. If the holiday falls on Sunday, it is observed on Monday. If the holiday falls on Saturday, it is observed on Friday.
12. Safety Program Requirements
NOTE: The Contractor will implement a safety program plan that ensures protection of Government personnel and property. Routine and recurring surveillance to ensure the safety requirements of this contract are enforced. The safety plan must be submitted prior to start of work but may be submitted after award.
13. Mishap Notification
The Contractor shall notify Ron Burke 406-224-7671 ronald_burke@nps.gov the designated Government Representative COR (Contracting Officer's Representative) one hour after all mishaps or incidents at or exceeding $2,000 (material + labor) in damage to DOI property entrusted by this contract, even if the Government is wholly or partially reimbursed. This notification requirement shall also include physiological mishaps/incidents. A written or email copy of the mishap/incident notification shall be sent within three calendar days to the COR, who will forward it to Safety Office.
• Mishap notifications shall contain, as a minimum, the following information:
• Contract, Contract Number, Name and Title of Person(s) Reporting
• Date, Time, and exact location of accident/incident
• Brief Narrative of accident/incident (Events leading to accident/incident)
• Cause of accident/incident, if known
• Estimated cost of accident/incident (material and labor to repair/replace)
• Nomenclature of equipment and personnel involved in accident/incident.
• Corrective actions (taken or proposed)
• Other pertinent information

Payment for the performance of this work is contingent on all data being accepted by the respective state's DEQ.
