140A1622R0069 Questions and Answers

1. Question: Factor 3 – Past Performance (page 58 of 64) states, “The Offeror shall submit past performance information for a maximum of 3 contracts.” It later states, “The Offeror shall submit past performance information for a minimum of 3 contracts that address the Offeror’s past performance, rather than the past performance of the Offeror’s teaming partners, joint venture partners, and/or subcontractors.” Please clarify how many projects are to be submitted for Factor 3 – Past Performance.

Government Response: Maximum of 3 contracts.

2. Question: When considering how many projects the team is to provide for Factor 3 – Past Performance, please note that Factor 3 – Past Performance (page 58 of 64) states, “The past performance information is required for the Offeror and all teaming partners, joint venture partners, and/or subcontractors that: (1) the Offeror expects to perform 20% or more of the services on the proposed effort based on the total proposed price or (2) the Offeror is proposing to perform aspects of the effort that the Offeror considers critical to the overall successful performance of the proposed effort.” Please clarify the total number of projects to submit from the Offeror and/or teaming partners/subcontractors.

Government Response: Maximum of 3 contracts for prime contractor. If you expect to have teaming partners, joint venture partners, or subcontractors that are performing 20% or more of the proposed effort based on the total proposed price, the offer should submit a maximum of 3 contracts for past performance for each of the partners performing 20% or more of the contract.

3. Question: Factor 3 – Past Performance (page 58 of 64) states, “The Offeror shall submit past performance information for a minimum of 3 contracts that address the Offeror’s past performance, rather than the past performance of the Offeror’s teaming partners, joint venture partners, and/or subcontractors.” Traditionally, a Mentor Protégé Joint Venture is considered the Offeror and therefore experience can be included from either partner of the JV and is considered experience from the Offeror (i.e., partners of the JV in aggregate demonstrate the past performance). Please confirm that experience from either partner of the JV entity will be considered as past performance of the Offeror.

Government Response: The mentor of the joint venture is considered the offeror/prime contractor. You can submit the joint venture past performance as part of the prime contractor past performance if it details the prime’s experience versus partners of the joint venture. Past performance from the Protégé will not be considered past performance for the prime contractor. Past performance for the joint venture partner (protégé) can be submitted if they are doing 20% or more of the work.

4. Question: Please confirm the due date for responses is 1 Aug 2022, 3 pm eastern as outlined on page 54 of 64 (as opposed to the date listed in the SF1449).

Government Response: The due date for responses is 28 July 2022, 3pm EDT (as noted in block 8 of the SF1449). The 1 August date was a typo.
