PART I—THE SCHEDULE
SECTION B--SUPPLIES OR SERVICES AND PRICES/COSTS
SCHEDULE OF ITEMS
Schedule of items will be included on individual task orders and competed amongst contractors that have been awarded an IDIQ contract.
Contractor Notes:
1. Contractor must be registered in www.sam.gov in order to submit an offer on this project.
THIS IS A FREE REGISTRATION.
2. All task orders are construction projects which have the following bonding requirements:
20% bid bond for offers over $150,000 required with offer submission. 100% performance and payment bonds for offers over $150,000 upon award. See Section I for details.
4. Awards will be made to multiple contractors. You must submit pricing for all items, including any option items and/or option years to be considered
Intent of Solicitation The purpose of Solicitation 12569R18R0011 is to award three Indefinite Delivery-Indefinite Quantity (IDIQ) contracts for facilities and general construction work. Additional awards, at Forest Service discretion, may be considered depending on Forest Service need and results for proposal evaluations. Associated with this Solicitation is the initial Task Order Pricing Requests for two task orders anticipated to be awarded in conjunction with award of the IDIQ contracts.
Prospective offerors are required to submit quotes for both of the initial task orders advertised with this IDIQ. Future task orders will be competed amongst the IDIQ contract awardees utilizing the procedures identified in Section H of this Solicitation.
AGAR 452.216-73 Minimum And Maximum Contract Amounts (FEB 1988)
During the period specified in FAR clause 52.216-18, ORDERING, the Government shall place orders totaling a minimum of $3,000.00, but not in excess of $5,000,000.00.
The minimum award to each IDIQ contract awardee is $3,000 over the life of the contract. The maximum cumulative award of all IDIQ contract holders is $5 million.
Bonding Bid Guarantee, Bid Bond and Payment Protection requirements shall be identified on each Task Order Pricing Request. Payment for bond premiums in accordance with FAR Clause 52.232-5, Payment Under Fixed-Price Construction Contracts, shall not be in addition to the contract price.
Therefore any prices offered for a Task Order shall include bonding costs.

SECTION C--DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK
Project Location The primary purpose of resulting contracts will be for projects located on the Huron-Manistee National Forest. However, task orders may also be issued for other Forest Service units located within Wisconsin, Minnesota and Michigan. Use of resulting contracts at locations other than the Huron-Manistee National Forest require pre-approval of the Contracting Officer and acceptance by the IDIQ contractors. Specific project areas will be identified on each Task Order.
Scope of Contract The Government intends to make multiple awards of Indefinite Delivery Indefinite Quantity Contracts for facility construction. Construction work will include alteration, modification, and new building construction. Work may be performed at any location within the Huron-Manistee National Forests. Work includes general building and directly associated site work on Forest Service sites and lands throughout the Region.
• Buildings/Structures: Work includes construction of new and alteration of existing structures and building systems; all work including the building, mechanical, electrical, and plumbing trades. Service work on existing structures that is non-altering such as painting, caulking, furnace and water heater repair or direct replacement, electrical repairs, roof repairs, and etc. Reroofing and well drilling will both be considered construction services.
• Demolition: Demolition work shall be of select portions of facilities, or entire structures as part of a new construction task order.
• Utilities: Work includes new utility installation and repair associated with National Forest buildings and structures such as water, electric, solar, sewer, septic tanks, and drain fields.
• Sidewalks: work includes construction, repair, and replacement of sidewalks and slabs as well as hardened paths and all accessories needed to provide for full accessibility.
• Recreational Structures: Construction and repair of miscellaneous outdoor structures such as stairs, boardwalks, viewing platforms, Pavilions, docks and similar stand-alone structures.
• Water Systems: Construction, repair, and maintenance of stand alone water system including wells, associated structures, and piping.
• Landscaping: Landscaping of areas around facilities including minor grading, walkways, gardens, grass, shrub, tree plantings, retaining walls, etc.
• Site Lighting: Installation, repair, and replacement of site lighting including light posts.
• Roads, driveways, parking lots, curb and gutter, etc: Work done in this area will be minor in nature where directly affecting a facility.
• Towers: Work may include disassembly, removal, transportation, maintenance, and repair of radio and fire towers.
• A&E Services: Architectural and Engineering services will be included when awarded as part of a design-build task order. Design work to address areas previous discussed above.
Samples of work excluded from the solicitation and any resulting contract are projects where the primary purpose is general bridge, road, or trail construction or maintenance.
Conformity with Drawings and Specifications Unless working tolerances are specified, all work performed and materials furnished shall be in reasonably close conformity with lines, grades, cross sections, dimensions, and material requirements shown on the drawings, indicated in the specifications, or designated on the ground. "Reasonably close conformity" is compliance with reasonable and customary manufacturing and construction tolerances.
Samples, Tests, Cited Specifications Reference made in the contract to specifications, standards, or test methods adopted by AASHTO, ASTM, GSA, or other recognized National technical associations, shall mean specifications, standards, or test methods (including interim or tentative issues) which are in effect on the date of the solicitation.
Barricades, Warning Signs, and Other Devices The Contractor shall provide, erect, and maintain all necessary barricades, suitable and sufficient lights, danger signals, signs, and other traffic control devices, and shall take all necessary precautions for the protection of the work and safety of the public. Roads closed to traffic shall be protected by effective barricades, and obstructions shall be illuminated during the hours of darkness. Suitable warning signs shall be provided to properly control and direct traffic.
The Contractor shall erect warning signs in advance to any place on the project where operations may interfere with the use of the road or trail by traffic and at all intermediate points where the new work crosses or coincides with an existing road or trail. All road barricades, warning signs, lights, temporary signals, flagmen and pilot car operators and equipment, and other protective devices, except for special devices, shall conform with Part VI of the Manual on Uniform Traffic Control Devices for Streets and Highways, published by the Federal Highway Administration and applicable safety codes.
Necessary warning signs and guards shall be posted during blasting operations to safeguard the public.
Magnitude of Construction The Government's total estimated magnitude of construction for the IDIQ contract is between $1,000,000 and $5,000,000.
AGAR 452.211-72 Statement Of Work/Specifications (FEB 1988)
The Contractor shall furnish the necessary personnel, material, equipment, services and facilities (except as otherwise specified), to perform the Statement of Work/Specifications referenced in Section J.

The attachments to the Statement of Work/Specifications listed in Section J are hereby made part of this solicitation and any resultant contract.
C.1 Sustainable Acquisitions The Contractor shall comply with FAR Part 23 Sustainable Acquisition Policy and all associated laws, rules, regulations, and executive orders referenced therein. Contracts that include the supply of products and for the acquisition of services (including construction) that include the supply of products, require that the products provided are—
(1) Energy-efficient (ENERGY STAR® or Federal Energy Management Program (FEMP)-designated); (applicable if FAR Clause 52.223-15 is included)
(2) Water-efficient; (applicable if FAR Clause 52.223-15 is included)
(3) Biobased; (applicable if FAR Clause 52.223-2 is included)
(4) Environmentally preferable (e.g., EPEAT®-registered, or non-toxic or less toxic alternatives); (applicable if FAR Clause 52.223-13,14, or 16 are included)
(5) Non-ozone depleting; (applicable if FAR clause 52.223-11,12,20, or 21 are included), and/or
(6) Made with recovered materials (EPA-Designated products) (applicable if FAR clause 52.223-9 or 17 is included).
(b) The required products in the contract actions for services include products that are—
(1) Delivered to the Government during performance;
(2) Acquired by the contractor for use in performing services at a Federally-controlled facility; or
(3) Furnished by the contractor for use by the Government.

Lubricants that are designed for use on the fifth wheel of tractor trailer trucks onto which the semi-trailer rests and pivots. 71% - Minimum Biobased Content.
e Gear Lubricants Products, such as greases or oils, that are designed to reduce friction when applied to a toothed machine part (such as a wheel or cylinder) that meshes with another toothed part to transmit motion or to change speed or direction. 58% - Minimum Biobased Content.
f Fuel Conditioners Products formulated to improve the performance and efficiency of engines by providing benefits such as removing accumulated deposits, increasing lubricity, removing moisture, increasing the cetane number, and/or preventing microbial growths within the fuel system. 64% - Minimum Biobased Content.
g Erosion Control Woven or non-woven fiber materials manufactured for use on construction, demolition, or other sites to prevent wind or water erosion of loose earth surfaces, which may be combined with seed and/or fertilizer to promote growth. 77% - Minimum Biobased Content.
h 2-Cycle Engine Oils Lubricants designed for use in 2-cycle engines to provide lubrication, decreased spark plug fouling, reduced deposit formation, and/or reduced engine wear. 34% - Minimum Biobased Content.

2.1.1 SUMMARY

2.1.2 SAFETY MEETING
A. Prior to commencing construction, representatives of the Contractor, including the Superintendent, shall meet with the Government to review the Contract's safety and health requirements.
B. The Contractor's safety and health program shall be reviewed, and implementation of safety and health provisions pertinent to the Work shall be discussed.
2.1.3 COMPLIANCE WITH REGULATIONS
A. Contractor Responsibility: The Contractor shall assume full responsibility and liability for compliance with all applicable codes, standards and regulations pertaining to the health and safety of personnel during execution of the Work. The Contractor shall have written safety and health programs in compliance with 29 CFR Parts 1910 and 1926.
2.1.4 SUBMITTALS
A. Safety and Health Programs: The Contractor shall submit, for approval, copies of the project safety and health programs, as applicable to the work scope, or required as a result of the safety meeting, including but not necessarily limited to the following:
1. Occupational Noise Exposure.
2. Fall Protection.
3. Personnel Protective Equipment.
4. Control of Hazardous Energy.
5. Electrical Safety Related Work Practices.
6. Lead.
7. Respirator Protection.

PART 2 - PRODUCTS
2.2.1 PERSONNEL PROTECTIVE EQUIPMENT
A. Special facilities, devices, equipment and similar items used by the Contractor in execution of the Work shall comply with 29 CFR Part 1910, Subpart I and other applicable regulations.
PART 3 - EXECUTION
2.3.1 EMERGENCY SUSPENSION OF WORK
A. In accordance with FAR 52.236-13, when the Contractor is notified by the Government, of noncompliance with safety or health provisions of the Contract, the Contractor shall immediately, correct the unsafe or unhealthy condition. In accordance with FAR 52.236-13 if the Contractor fails to comply promptly, all or part of the Work will be stopped by Government notice. The Contractor shall not be allowed any extension of time or compensation for damages in connection with a work stoppage for unsafe or unhealthy conditions.
2.3.2 PROTECTION OF PERSONNEL
A. The Contractor shall take all necessary precautions to prevent injury to the public, occupants, or damage to property of others.
2.3.3 ENVIRONMENTAL PROTECTION
A. Dispose of solid, liquid and gaseous contaminants in accordance with local codes, laws, ordinances and regulations.
B. Comply with applicable federal, state and local noise control laws, ordinances and regulations, including but not limited to 29 CFR 1910.95 and 29 CFR 1926.52.

The Contractor shall be required to (a) commence work under this contract within 10 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than the stated completion time as identified in the task orders. The time stated for completion shall include final cleanup of the premises.
52.211-13 Time Extensions (SEP 2000)
Time extensions for contract changes will depend upon the extent, if any, by which the changes cause delay in the completion of the various elements of construction. The change order granting the time extension may provide that the contract completion date will be extended only for those specific elements related to the changed work and that the remaining contract completion dates for all other portions of the work will not be altered. The change order also may provide an equitable readjustment of liquidated damages under the new completion schedule.

G.1 DESIGNATION OF CONTRACTING OFFICER'S REPRESENTATIVE
The contracting Officer will designate a Contracting Officer's Representative(COR) at the time of award.
The COR is responsible for administering the performance of work under this contract. In no event, however, will any understanding, agreement, modification, change order, or other matter deviating from the terms of this contract be effective or binding upon the Government unless formalized by proper contractual documents executed by the Contracting Officer prior to completion of the contract.
On all matters that pertain to the contract terms the contractor must communicate with the Contracting Officer. Whenever, in the opinion of the Contractor, the COR requests effort outside the scope of the contract, the Contractor should so advise the COR. If the COR persists and there still exists a disagreement as to proper contractual coverage, the contracting officer should be notified immediately, preferably in writing if time permits. Proceeding with work without proper contractual coverage could result in nonpayment or necessitate submittal for a contract claim.
G.2 GOVERNMENT-FURNISHED PROPERTY
The Government will provide the following item(s) of Government property to the Contractor for use in the performance of this contract. This property shall be used and maintained by the Contractor in accordance with the provisions of the "Government Property" FAR clause contained elsewhere in the contract.
Any Government Furnished property will be identified on individual task orders.
G.3 INVOICING
The "Submit Invoice-to" address for USDA orders is the Department of Treasury's Invoice Processing Platform (IPP). All invoices are to be submitted online via the electronic Invoice Processing Platform. This is a mandatory requirement initiated by the U.S. Department of Treasury and you can find more information at this website https://www.ipp.gov/index.htm.
Your company must register at https://www.ipp.gov/vendors/enrollment-vendors.htm to establish an account in order to submit an invoice on this project.
G. 4. ORDERING PROCEDURES - Issuance of Task Orders
Task Orders will be issued in accordance with FAR 52.216-18, FAR 52.216-19, FAR 52.216-22 and AGAR 452.216-73.
The majority of task orders issued under this IDIQ will be for the Huron-Manistee National Forest. However, task orders may also be issued for other Forest Service units located within Region 9. Warranted Contracting Officers from the Lake States Acquisition Team are authorized to place task orders against this contract within their delegated warrant authority. All task orders are subject to the terms and conditions of this contract.
The Task Order Issuance process will begin with a Task Order Pricing Request. This request will address specific requirements of a project, schedule of items, specific supplemental specifications within the Scope of the Work, specific site locations, etc. The Task Order Pricing Request:
a) will be issued by email. The Contractor is responsible for checking their email for task order issuances as no other notice will be provided.
b) will be issued during the performance period of this contract.
c) will be issued to those individuals awarded a contract under this program of work.
d) will include the required due date, specific instructions for the submission for quotes, and other information deemed appropriate.
e) will be competitive in nature. All contractors who are awarded a contract will be required to submit a quote on every task order. If a contractor cannot meet the “Desired Start Date” and the “Contract Completion Time” identified by number of calendar days referenced on the task order, an alternate schedule can be submitted by the contractor and will be considered for award.
f) The Contractor is encouraged to visit the site prior to quoting on the project.
The following procedures will be utilized to provide awardees a fair opportunity in accordance with FAR Part 16.505(b). Method for selecting a contractor for task order award will be as shown in “a” through “c” below.
a) Exceptions to the fair opportunity process as provided by FAR 16.505(b)(2). If a Fair Opportunity Exception applies, the task order quote request will be issued to one contractor.
b) The Government will determine the best value based on price, timeframe, and past performance. Single or multiple awards may be made for individual task orders, as specified on the task order. The Contracting Officer selects contractor based upon the following:
1. Price – Prices from the Request for Task Order Pricing will be evaluated for reasonableness. Contractors cannot exceed the maximum price quoted as shown in their master IDIQ contract awarded schedule, however, the Contractor may provide lower pricing. The Task Order pricing should include all associated costs for requested work. Award may be made to other than the lowest price offer based on timeframes and past performance.
2. Timeframe – Each Request for Task Order Pricing will include a government requested period of performance. Alternate timeframes for each individual task order may be suggested by the Contractor if unable to meet the government requested period of performance.
3. Past Performance - Performance on earlier task orders will be evaluated for quality and timeliness. This is a critical factor not only for each task order but also as consideration to exercise the option periods. Positive past performance will assure continued ability to receive task orders.
c. Once an award decision is made, the Contracting Officer will email the awarded task order to the successful Contractor and the COR. Work shall not begin until a pre-work meeting is held and a Notice to Proceed is issued. Each task order will include:
1. The Contract Number
2. The Task Order Number.
3. Authorized signature of warranted Contracting Officer
4. Detailed description of the task or service to be performed.
5. Firm fixed price of the project.
6. Detailed description of required submittals.
7. Map or other descriptions of the project location.
8. Designation of the Contracting Officer’s Representative.
9. Government furnished property, if provided.
10. Applicable Davis Bacon Wage Determination.
d. The Contracting Officer will notify unsuccessful contractors of the final award decision.
G.5 FINAL PAYMENT - RELEASE OF CLAIMS
The Government shall pay the final amount due the Contractor under this contract after—
(1) Completion and acceptance of all work;
(2) Presentation of a properly executed invoice; and
(3) Presentation of release of all claims against the Government arising by virtue of this contract, other than claims, in stated amounts, that the Contractor has specifically excepted from the operation of the release.

G.6 INCIDENTAL PAYMENT ITEMS
The intent of the contract is to provide for the complete performance of the project described in the contract. Unless otherwise provided, the Contractor shall furnish all labor, materials, equipment, tools, transportation, and supplies and perform all work required to complete the project in accordance with drawings, specifications, and provisions of the contract. Payment for contract work will be made only for and under those pay items included in the Schedule of Items on each individual task order. All other work and materials will be considered as incidental to and included in the payment for items shown.

SECTION H--SPECIAL CONTRACT REQUIREMENTS
H.1 EQUIPMENT CLEANING
All soil moving equipment shall be thoroughly cleaned to make it free of soil, noxious weed seeds, vegetative matter or other debris that could contain or hold seeds prior to being delivered to the project site. Equipment shall be considered free of soil, noxious weed seeds and other such debris when a visual inspection by the C.O.R., prior to the equipment being delivered to the site, does not disclose such material present. Disassembly of equipment components is not required. The Contractor shall notify the Forest Service at least five (5) working days prior to moving each piece of soil moving equipment onto the project site, unless otherwise agreed.
The Contractor shall thoroughly clean all soil moving equipment prior to moving them off a project site or between work areas on a project site that are known to be infested with noxious weed species of concern and other work areas, if any, that are free of noxious weed species of concern. Areas known to be infested with specific noxious weed species of concern to the Forest Service shall be noted in the Schedule of Work. The Contractor and the Forest Service shall agree on the methods of cleaning, location for the cleaning and control of off-site impacts, if any.
When new areas of infestation of noxious weeds of concern to the Forest Service are identified on the project site by either the Forest Service or Contractor they shall be promptly reported to the other party.
H.2 CONTRACTOR PERFORMANCE ASSESSMENT REPORTING SYSTEM
(a) General. This contract is subject to Federal Acquisition Regulations (FAR), Agriculture Acquisition Regulations (AGAR), and Forest Service Acquisition Reference (FSAR) that require past performance evaluations to be completed and entered into the Contractor Performance Assessment Reporting System (CPARS).
(b) Contact Information. Upon award, the name and email address of the Contractor Representative responsible for reviewing the CPARS evaluations will be required.
(c) Assessment. Upon completion of the work associated with the contract/delivery orders, or at the end of the year if the contract exceeds one year, an evaluation will be initiated by the Contracting Officer in the CPARS system and the Contractor Representative will receive an auto-email from CPARS with instructions for review of the evaluation. The contractor will review the government’s evaluation and either concur or disagree and route the evaluation back to the Contracting Officer (Assessing Official). If the evaluation recevied contractor concurrence, it will be finalized by the Assessing Offical. If there is disagreement, further discussion will be intiated prior to finalization.

52.204-21 Basic Safeguarding of Covered Contractor Information Systems (Jun 2016)
(a) Definitions. As used in this clause– “Covered contractor information system” means an information system that is owned or operated by a contractor that processes, stores, or transmits Federal contract information.
“Federal contract information” means information, not intended for public release, that is provided by or generated for the Government under a contract to develop or deliver a product or service to the Government, but not including information provided by the Government to the public (such as on public websites) or simple transactional information, such as necessary to process payments.
“Information” means any communication or representation of knowledge such as facts, data, or opinions, in any medium or form, including textual, numerical, graphic, cartographic, narrative, or audiovisual (Committee on National Security Systems Instruction (CNSSI) 4009).
“Information system” means a discrete set of information resources organized for the collection, processing, maintenance, use, sharing, dissemination, or disposition of information (44 U.S.C. 3502).
“Safeguarding” means measures or controls that are prescribed to protect information systems.
(b) Safeguarding requirements and procedures.
(1) The Contractor shall apply the following basic safeguarding requirements and procedures to protect covered contractor information systems. Requirements and procedures for basic safeguarding of covered contractor information systems shall include, at a minimum, the following security controls:
(i) Limit information system access to authorized users, processes acting on behalf of authorized users, or devices (including other information systems).
(ii) Limit information system access to the types of transactions and functions that authorized users are permitted to execute.
(iii) Verify and control/limit connections to and use of external information systems.
(iv) Control information posted or processed on publicly accessible information systems.
(v) Identify information system users, processes acting on behalf of users, or devices.
(vi) Authenticate (or verify) the identities of those users, processes, or devices, as a prerequisite to allowing access to organizational information systems.
(vii) Sanitize or destroy information system media containing Federal Contract
Information before disposal or release for reuse.
(viii) Limit physical access to organizational information systems, equipment, and the respective operating environments to authorized individuals.
(ix) Escort visitors and monitor visitor activity; maintain audit logs of physical access;
and control and manage physical access devices.
(x) Monitor, control, and protect organizational communications (i.e., information transmitted or received by organizational information systems) at the external boundaries and key internal boundaries of the information systems.

(xi) Implement subnetworks for publicly accessible system components that are physically or logically separated from internal networks.
(xii) Identify, report, and correct information and information system flaws in a timely manner.
(xiii) Provide protection from malicious code at appropriate locations within organizational information systems.
(xiv) Update malicious code protection mechanisms when new releases are available.
(xv) Perform periodic scans of the information system and real-time scans of files from external sources as files are downloaded, opened, or executed.
(2) Other requirements. This clause does not relieve the Contractor of any other specific safeguarding requirements specified by Federal agencies and departments relating to covered contractor information systems generally or other Federal safeguarding requirements for controlled unclassified information (CUI) as established by Executive Order 13556.
(c) Subcontracts. The Contractor shall include the substance of this clause, including this paragraph (c), in subcontracts under this contract (including subcontracts for the acquisition of commercial items, other than commercially available off-the-shelf items), in which the subcontractor may have Federal contract information residing in or transiting through its information system.
52.215-8 Order of Precedence—Uniform Contract Format (OCT 1997)
Any inconsistency in this solicitation or contract shall be resolved by giving precedence in the following order:
(a) The Schedule (excluding the specifications).
(b) Representations and other instructions.
(c) Contract clauses.
(d) Other documents, exhibits, and attachments.
(e) The specifications.
52.216-18 Ordering (Oct 1995)
(a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the Schedule. Such orders may be issued from Contract Award through a period of 5 years from date of contract award.
(b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control.
(c) If mailed, a delivery order or task order is considered “issued” when the Government deposits the order in the mail. Orders may be issued orally, by facsimile, or by electronic commerce methods only if authorized in the Schedule.
52.216-19 Order Limitations (Oct 1995)
(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than $5,000.00, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract.
