Except as provided herein, all terms and conditions of the document referenced in Item 9 A or 10A, as heretofore changed, remains unchanged and in full force and effect .

1. In the SOW under Equipment Requirements/General Provisions there is the following statement "In order to be considered for IDIQ award, prospective contractors shall provide evidence of federally required aircraft maintenance."

Can you specifically list what documents your looking for or provide examples?

ANSWER: Even though Government personnel will not be transported in Contractor aircraft under the specifications of contracts awarded through this solicitation, the Government remains concerned with the safety of its Contractor pilots. Therefore, the Government requires current proof of compliance with CFR 43 and CFR

91. These CFR regulations require that an airworthiness certificate, registration certificate, operating limitations, and weight and balance information be carried aboard each aircraft. The CFR regulations also require records of all aircraft inspections and maintenance be kept up to date and logged. The Government may ask to see proof of this documentation at any time if there are concerns that aircraft under contract are not airworthy.

Under this solicitation, the Government requires that Vendors provide evidence of compliance with CFR 43 and

91. Vendors can comply by including a copy of the airworthiness certificates and most recent record of annual inspection and maintenance of aircraft being proffered for use as part of their proposal.

2. In SOW under Herbicide Application Line (13) states "Aerial application shall not occur when sustained wind speeds exceed 5 miles per hour in the unit(s) being treated."

Would you consider changing this to reflect the wind limits on the herbicide label or a max wind speed of 10 mph? Many of the herbicides that will be utilized such as Milestone and Plateau state to avoid applications below a certain wind speed in order to minimize drift, Milestone is 2mph, Plateau is 3. This means applications can only be made when the wind speed is between 3mph and 5mph without being either off label or out of contract compliance.

ANSWER: The Government (a) requires that Contractors follows herbicide label direction for minimum wind speeds to avoid drift caused by inversions and (b) may choose to impose more restrictive sustained wind speed requirements than the States in which operations are conducted. It is important for Contractors to read individual task orders carefully.

However, the key word here is “sustained”. The National Oceanic and Atmospheric Administration, National Weather Service defines sustained wind speeds as observed average wind speeds sustained over a minimum period of two minutes. Wind gusts are defined as generally lasting 20 seconds or less and are usually about 30% stronger than the average sustained wind speeds.

The purpose of limiting sustained wind speeds to less than ten miles per hour is to ensure that herbicides are deposited correctly and evenly within treatment units and to avoid wind-caused drift of herbicides outside of treatment areas. This is most critical along buffered areas such as stream courses, private lands, or other sensitive sites (e.g. Sensitive plant populations that are susceptible to herbicide injury). We recognize that ridgetops and areas where slopes change aspects are often gusty areas. Contractors need to factor wind speed and direction and treatment parameters into their daily applications. We do encourage our contractors to spray strategically by treating gusty areas during times that are less windy. Likewise, it is perfectly acceptable to switch to a unit with a different aspect and better wind conditions if it becomes too windy in the current unit. It is required that the Contractor monitor wind conditions during spray operations and stop spraying if conditions are outside the requirements. Contractors are expected to communicate with the COR about changing conditions so that adjustments can be made if necessary.

Note that wind speeds collected at a landing zone/staging area will not be accepted as proof of wind speeds in treatment units. Neither is it acceptable to record wind speeds and directions collected at landing zones/staging areas on daily treatment records. It is the responsibility of the pilot to monitor wind speed and direction and to communicate changing weather and wind information to the COR during spray operations.

3. In SOW under Soil Amendment/Mulching Line 5, states "Aerial application shall not occur when sustained wind speeds exceed 5 miles per hour in the unit(s) being treated."

The wind limit of 5pmh is exceedingly limiting, especially during the time of year when mulching and seeding occur (late fall through late winter) Providing the material being applied stays within the treatment area and contract specifications are attained is such a restrictive wind limitation necessary?

The timeliness of project completion could be negatively impacted by this limitation.

Aerial seeding, Line 4, same issue

ANSWER: Please refer to the definition for sustained wind speed under Question 2. The Government may not have the same degree of concern with regard to wind speed for seeding and mulching as it does for herbicide application. However, wind direction remains important. Note that there are no minimum wind speed restrictions associated with seeding and mulching, although there could be with other soil amendment applications. This wind limitation may be relaxed depending on the task order and type of application being applied. It is important that expensive products are applied within designated treatment units and that the product does not land outside treatment units. Contractors need to factor wind speed and direction and treatment parameters into their application. Good Contractor and COR communication is important when determining acceptable wind speeds and directions. It is required that the Contractor monitor wind conditions during operations and cease applications if conditions are outside the requirements. Contractors are expected to communicate with the COR about changing conditions so that adjustments can be made if necessary.
