Section 1. Project Summary and Background

PROJECT REQUEST

The City of Detroit Office of Contracting and Procurement (OCP) on behalf of the General Services Department (GSD) – Landscape Design Unit and Building, Safety Engineering and Environmental Department (BSEED), Environmental Affairs (EA) is seeking competitive proposals from qualified Respondents to render technical and professional expertise (“Services”) as set forth in this RFP. The qualified Respondent to provide oversight and documentation of response activities necessary to mitigate unacceptable exposure risks associated with impacted shallow soil and fill materials and satisfy due care obligations related to the proposed expansion and park improvements at Martin Luther King Park and renovations at Williams Park in Detroit, Wayne County, Michigan.

BACKGROUND/DESCRIPTION OF ENVIRONMENT

The City of Detroit General Services Department maintains all parks, playgrounds and recreation centers and various public spaces within the City limits.

The City plans to develop the site into a linear park along Martin Luther King Boulevard with active and passive spaces. Based on current site conditions and foreseeable property use, Direct Contact (DC) is a relevant/ complete exposure pathway and, therefore, it is the City’s main goal to mitigate this unacceptable exposure pathway. Volatilization to indoor air criteria was also exceeded, however, no structures are planned at this time. If the site plan changes to include structures, an evaluation for the VIAP will be required in the future. Specifically, the City’s objectives are to:

• Mitigate unacceptable exposure concerns to ensure due care compliance

The Respondent is to provide support and oversight for the environmental mitigation activities for this project.

The Respondent must document all response actions and activities performed to ensure compliance with applicable environmental requirements and due care obligations throughout construction.

SITE LOCATION AND BACKGROUND

The site is 2.01 acres and includes 22 vacant and undeveloped parcels (Table 1). It is in a mixed-use commercial and residential area. The site is northwest to southeast in orientation, bounded by residential properties to the east, W Grand Boulevard to the south, Bethune Avenue to the north, and Rosa Parks Boulevard to the west. The parcels historically extended to the west but have been redeveloped as a portion of Rosa Parks Boulevard. According to the historical documents, parcels on the site were first developed prior to 1915 for commercial and residential use. Buildings on the site were found to have been used as clinics, offices, a sanatorium, and storefronts. Other historical uses included dry cleaning, auto repair, and machining. The site has remained vacant since the late 1960s (Tetra Tech 2024). The former buildings on the site were demolished between 1967 and 1997. Rosa Parks Boulevard was expanded to include the western portion of the parcels between 1961 and 1977. The parcels have largely remained vacant ever since. The City of Detroit intends to develop these parcels into a linear park. Tetra

Tech, Inc performed a Phase I Environmental Site Assessment dated July 10, 2024. Thirteen RECs (13) were identified. No HRECs were identified, however 1 CREC was identified for the site. The report is included in Appendix A. Additional investigation was recommended. Tetra Tech Inc. performed a Phase II ESA to investigate the Recognized Environmental Conditions (RECs) on April 1, 2025. The primary concern regarding reuse at the MLK Parcels site is the potential presence of and exposure to contamination from previous property uses and identified RECs. The field activities included efforts to provide sufficient data to evaluate potential remediation and reuse for active recreational purposes. The Phase II ESA included ISM soil sampling and discrete soil boring sampling. A Due Care Plan outlining steps to minimize exacerbation of identified contamination and to mitigate unacceptable exposure of hazardous substances to site workers and residents, acts of third parties and exposure during redevelopment activities. However, since the DCP was drafted there have been changes to EGLE guidance regarding use of background when fill soils are present. The reports are attached.

To accomplish the project objectives, the selected Consultant will be responsible for implementing the SOW for the Subject Property in one phase. The SOW includes the following activities:

Task 1 – Kickoff Meeting & Site Visit: City representatives from BSEED-EA and GSD will coordinate and schedule a kickoff meeting with the selected Consultant to: a) discuss the project budget and schedule; and b) clearly delineate the scope of services and project objectives based on readily available site information, recent site assessment reports and City’s knowledge of the current site conditions. Key BSEED-EA and GSD staff will attend the kickoff meeting with the selected Consultant.

Task 2 – File Review – All previous investigations and other available documentation will be reviewed. Under this task, the selected Consultant will conduct a review of project-related environmental due diligence (EDD) documents to be provided by the City. EDD documents available for review include Phase I ESA, Phase II ESA and Due Care Plan reports prepared by other consultants on behalf of the city. A review of these documents will provide the Consultant with an understanding of the historical property uses/operations, site assessment activities previously completed at the Subject Property and current site conditions.

Task 3 – Environmental Construction Management Plan/Fugitive Dust Plan: Consultant will update the Due Care Plan based on the changes to EGLE guidance on use of background for fill soils as an element of due care compliance and environmental response activities during construction. The subject property meets the definition of a “facility” as defined in Part 201 based on sampling conducted as part of previous environmental investigations. The sampling identified volatile organic compounds (VOCs), polynuclear aromatic hydrocarbons (PNAs), and metals contamination in soil samples collected from the subject property. Based on the exposure pathway evaluation, the residential direct contact (including soil ingestion) was considered relevant to assessments of risk and the site requires mitigation.

The purpose of the ECMP is to specify methods for management of environmentally contaminated soils on the subject property. The procedures and guidelines in this ECMP will be developed to ensure that contaminated soils encountered during construction will be managed in a manner which:

(1) conforms to Federal, State, and local solid waste and environmental response laws; (2) protects workers and the general public from unacceptable exposure to the residuals; (3) provides notification to third parties; and

(4) reduces the potential for exacerbation of environmental conditions at the subject property.

The plan will describe in detail field methodologies and procedures for conducting the response activities and include a site-scaled map(s) depicting excavation and emplacement of soil locations showing relevant site features and implementation schedule. A fugitive dust plan will be included as a separate attachment.. The plan will be submitted to the City for review and approval, prior to initiating the remediation activities.

Depths of cuts for the various park elements are as follows (refer to the park plan):

• Concrete depth: 8"• Asphalt paving depth: up to 12"
• Playground surfacing depth: 16"• Shelter footing depth: 48"
• Playground equipment posts: 48"• Fence footing depth: 48"
• Tree Planting depth: up to 30"• Bioswale(s) depth: 30" - 48"

The scope of services for the proposed ECMP will include the following tasks:

• Review and summarize the information compiled during Tetra Tech’s Phase I and II ESAs and DCP.

• Review proposed construction plans provided by the city.

• Prepare an ECMP which clearly details the activities to be undertaken during the construction work for the project that will be provided to the construction contractors to guide appropriate response actions.

• Attend up to two project meetings via Teams with the City and project contractors to discuss the draft report. A separate meeting may be held with EGLE to discuss changes to the use of statewide and regional background information where fill is present that may affect response actions.

Task 4 – Environmental Oversight of Remediation activities during construction - Consultant will provide up to 8 hrs of onsite oversight each week to document excavations and/or backfill emplacement, elevation survey, etc.

Task 5 – Due Care Plan – A final due care plan will be drafted for the future operation of the park based on the site plan. Soil management will be outlined as well as, operations, maintenance and monitoring requirements.

Task 6 – Letter Report, Due Care Compliance Documentation - To demonstrate compliance with Section 20107a(1), exacerbation, due-care, and reasonable precautions are to be considered and evaluated. The Consultant will draft a final report documenting these considerations and all due care activities undertaken throughout the duration of the remediation. The report will include but is not limited to all relevant data, reports, excavation and backfill information including backfill source review, information, truck tickets, manifests, photos, surveys, field notes, etc. Backfill must meet the COD Backfill protocol. All sources are to be approved by Environmental Affairs.

It is understood that the selected consultant will prepare and adhere to a site-specific Health and Safety Plan (HASP) outlining all required safety precautions. This plan will not be submitted to the city for review. All subcontractors will also have their own HASP.
