15. ANTI-POLLUTION LEGISLATION

15.1 On October 26, 1972, House Bill Number 1969 was enacted into law. This Act (No. 247) became effective on November 25, 1972. It requires that Bidders on construction contracts for the Commonwealth

00 21 13 - 10 02.26.2026 of Pennsylvania be advised of those provision of Federal and State statutes, rules and regulations dealing with the prevention of environmental pollution and the preservation of public natural resource that affect the Project on which bids are being received.

15.2 The Bidder shall thoroughly acquaint itself with the terms of the listed statutes, rules and regulations.

No separate or additional payment will be made for such compliance. In the event that the listed statues, rules and regulations are amended or if new statutes, rule or regulations become effective after date of receipt of bids, upon receipt of documentation which causes the Contractor to perform additional work, the Owner may issue a change order or deviation request setting forth the additional work that must be undertaken.

15.3 This change order or deviation request shall not invalidate the Contract.

15.4 It is the responsibility of the Contractor to determine what local ordinances, if any, will affect its work.

They shall check for any county, city, borough or township rules or regulations applicable to the area in which the project is being constructed and, in addition, for any rules or regulations of other organizations having jurisdiction, such chambers-of-commerce, planning commissions, industries or utility companies who have jurisdiction over lands which the Contractor occupies. Any costs of compliance with local controls shall be included in the price bid, even though documents of such local controlling agencies are not listed herein.

16. EROSION CONROL

16.1 The Contractor shall comply with all rules and regulations of Chapter 102, Title 25 of

Pennsylvania Soil Erosion and Sedimentation Control.

16.2 The plan shall be maintained at site and shall indicate how the Contractor plans to control erosion caused by storm water and prevent silt and sedimentation being distributed off site.

16.3 Control shall be provided by channels, dikes, sedimentation basins, protection of stockpiled or uncontrolled soil or any other means necessary, all in accordance with the requirements of the

Pennsylvania Department of Environmental Protection.

17. PUBLIC WORKS CONTRACTS

17.1 In consideration of the funds awarded and activities funded under this Contract which involve construction, reconstruction, alteration, repair, improvement, or maintenance of a building, structure, or improvement (“The Work”), the Contractor agrees to comply with all applicable federal, state and local laws, regulations and requirements to the extend such requirements are applicable to the funding sources actually utilized for the Project.

17.2 Without limiting the foregoing, and only to the extent applicable, the Contractor shall comply with the requirements of the following, as amended:

00 21 13 - 11 02.26.2026

A. Northampton County Department of Community and Economic Development Community

Development Block Grant (CDBG) requirements, including all applicable federal regulations and any Sub-grantee Agreement requirements incorporated into the Contract Documents;

B. The American Rescue Plan Act of 2021, Public Law 117-2, and all applicable rules, guidance, and requirements promulgated thereunder by the United States Department of the Treasury;

C. Any other federal, state, county, or local statutes, regulations, funding conditions, or program requirements expressly identified in the Contract Documents or incorporated by Addendum.

17.3 The Contractor acknowledges that additional requirements associated with the funding sources may be included in the Contract Documents, including but not limited to labor standards, material sourcing requirements, reporting obligations, and recordkeeping provisions. Compliance with such requirements shall be included in the Contract Sum, unless otherwise provided in the Contract Documents.

17.4 Nothing contained herein shall be construed to require compliance with any statute, regulation, or funding condition that is not applicable to the Project or for which an exemption or waiver has been lawfully granted.

18. SEVERABILITY

18.1 Should any section or any part of any section of the Contract be rendered void, invalid, or unenforceable by any court of law, for any reason, such a determination shall not render void, invalid, or unenforceable any other section or part of any section of the Contract.

19. AMERICANS WITH DISABILITIES ACT

19.1 During the term of the Contract, the Contractor agrees as follows:

A. Pursuant to federal regulations promulgated under the authority of The Americans with Disabilities

ACT, 28 C.F.R. § 35.101 et. Seq., as amended, the Contractor understands and agrees that no individual with a disability shall, on the basis of the disability, be excluded from participation in the

Contract or from activities provided for under the Contract. As a condition of accepting and executing the Contract, the Contractor agrees to comply with the General Prohibitions Against

Discrimination, 28 C.F.R. § 35.130, as amended, and all other regulations promulgated under Title

II of The Americans with Disabilities Act, as amended.

B. The Contractor shall be responsible for and agrees to indemnify, defend, and hold harmless the Owner from all losses, damages, expenses, claims, demands, suits, and actions brought by any party against the Owner as a result of the Contractor’s failure to comply with provisions of the Act.

20. HEALTH AND SAFETY

20.1 Bidders shall comply with the provisions of the Occupational Safety and Health Administration, Federal Act 91-596 of December 29, 1970, as amended, and with any other safety and health regulations for the district in which the Work is performed.
