About this file
This document is an ADOT (Arizona Department of Transportation) Confidentiality and Trade Secrets attachment for a solicitation (No. BPM006654), which outlines the state's procedures for handling proprietary or confidential information submitted as part of a response to a public records request. The document involves the Arizona state government, specifically the Arizona Department of Transportation, and provides a standardized form for vendors to declare whether their solicitation response contains trade secret or proprietary information.
The attachment details a process for vendors to identify and protect sensitive information during the procurement process, with specific criteria for what qualifies as a trade secret. Vendors must choose whether their response contains proprietary information, with the understanding that most submitted materials are subject to public disclosure under Arizona public records law. The form requires vendors to explain how their information meets trade secret definitions, including being a unique formula, method, or process that derives economic value from its confidentiality. By completing this form, vendors agree to indemnify the state and cooperate if their confidentiality designation is challenged, and they acknowledge that their entire offer may be shared with evaluation committees during the procurement process.
