About this file
This is a Utah Government Records and Management Act (GRAMA) Business Confidentiality Claim form issued by the Utah State Archives Office of the Government Records Ombudsman in conjunction with a Request for Statements of Qualifications (RFSQ) from the State of Utah Division of Purchasing for Natural Resources Law Enforcement Professional Services. The procurement seeks qualified companies to relocate an inground hydropad from Huntington State Park to Kanab under Administrative Rule R33-105 for Small Purchases of Professional Service Providers and Consultants. The form establishes the process by which prospective vendors can submit confidentiality claims to protect trade secrets and commercial financial information from public disclosure under Utah Code Section 63G-2-305. Vendors submitting proposals must include both redacted and non-redacted versions; the Division of Purchasing will not perform redactions on behalf of claimants who fail to provide a redacted copy.
The small purchase threshold for this project is $100,000.00, and prospective vendors are explicitly instructed not to include pricing information in their qualifications submissions. Confidentiality claims must include a concise statement of reasons supporting protection and must be submitted with the information requested to be protected. The claim form requires vendor contact information, details about the specific records subject to confidentiality protection identified by page and paragraph, and the reasons for each confidentiality request. Per GRAMA requirements, submission of a confidentiality claim does not guarantee that information will be classified as protected if the governmental entity receives a subsequent public records request.

Office of the Government Records Ombudsman Utah State Archives
Business Request for GRAMA Business Confidentiality Claim
Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
