About this file

This is a Claim of Business Confidentiality document submitted to the Utah Division of Purchasing by a Conducting Procurement Unit asserting that certain information related to a non-competitive contract award should be treated as confidential business information. The document supports a Notice of Intent to Award a Contract Without Engaging in a Standard Procurement Process, indicating that the procuring agency has determined that awarding the contract through standard competitive procurement is impractical or not in the best interest of the state. The claim asserts that the business information contained in the related procurement files meets the statutory definition of confidential information and should be protected from public disclosure under Utah law.

The document does not contain specific details regarding products, services, quantities, pricing, or contract terms, as its sole purpose is to establish the confidentiality status of underlying procurement documentation. The claim serves to shield proprietary or sensitive business information submitted by the potential contractor or the procuring agency from public record requests while the procurement decision is under review by the Division of Purchasing. This filing is procedurally required when a procurement unit seeks to withhold commercially sensitive information during non-competitive award justifications.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
