About this file
This file contains bond templates for the City of Lewisville, Texas, related to the Valley Vista & Poydras Drainage Improvements project (Project No. G2306). The project scope consists of removing and replacing storm drain pipe, storm drain inlets, storm drain junction boxes, and associated street paving repairs along Camelot Drive, Little Den Drive, Cassion Drive in the Valley Vista Addition, and Poydras Street area south of High School Drive. The document includes three standardized bond forms: a Performance Bond, a Payment Bond, and a Maintenance Bond. The Performance Bond guarantees that the principal contractor will faithfully perform the contract work in accordance with the plans and specifications. The Payment Bond ensures that all claimants supplying labor and materials to the contractor or subcontractors will be paid. Both bonds are executed pursuant to Chapter 2253 of the Texas Government Code and contain provisions that the surety's obligations are not affected by changes, extensions of time, alterations, or additions to the contract terms or work performed.
The Maintenance Bond requires the principal to guarantee the project against defects caused by faulty or defective materials, workmanship, or design for a period of two years from the date of acceptance by the City. The City must notify the principal in writing of any defects and allow a reasonable correction period. If defects are not corrected, the City may contract for repairs, with the principal and surety jointly and severally liable for all costs, expenses, and damages, including engineer fees, legal costs, and interest accruing at six percent per annum if legal proceedings are commenced. The principal and surety must also pay all costs and expenses incurred by the City, including attorney's fees, in collection proceedings. All goods and services provided to the City must be compliant with the Americans with Disabilities Act and its regulations.
