About this file

This document is a Sole Source/Brand Name Justification for a contract under the Simplified Acquisition Threshold (SAT). It details the rationale for using other than full and open competition for a contract with the University of Colorado, Denver (UCD) Magnetic Materials Laboratory to provide critical measurements of magneto-elastic and magneto-thermal hysteretic properties of Navy steels.

The justification explains that the Magnetic Materials Laboratory at UCD, led by Dr. Stephen Gedney, has unique capabilities and is the sole provider capable of the specialized measurements required to support the development of computational models related to the underwater electromagnetic signatures of naval ships and submarines. Dr. Gedney is an internationally recognized expert in this field and built the lab under a Defense University Research Instrumentation Program (DURIP) grant, making him the sole subject matter expert with this capability. Funding this contract with UCD is critical for providing the Navy the necessary knowledge in stress-induced magnetization of Navy steels.

NSWCCD Sole Source/Brand Name Justification SAT rev 1 Effective September 2021

USE OF OTHER THAN FULL AND OPEN COMPETITION LESS THAN

SIMPLIFIED ACQUISITION THRESHOLD MEMO

FROM:

CODE: 7550

SUBJECT: Sole Source/Brand Name Justification / Limited Source Justification for Use of Other than Full &

Open Competition for an Acquisition under the Simplified Acquisition Threshold (SAT)

I. BACKGROUND

1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available.

2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.

3. This memorandum is derived from Enclosure 3, Department of Navy Simplified Acquisition Procedures Guide (April 2018) and is only applicable to acquisitions under the SAT.

II. DESCRIPTION OF ITEM OR SERVICE (include manufacture/sole source name and address) This contract is for the Magnetic Materials Laboratory, University of Colorado, Denver for a one-year period from June 16, 2024 – June 15, 2025, to provide critical measurements of magneto-elastic and magneto-thermal hysteretic properties of Navy steels. Accurate measurements are needed so that physics-based magneto-elastic models can be developed and implemented in a computational framework, MAGSTROM. This framework is critically required to support analysis, design, and threat assessments through the development of computer models related to underwater electromagnetic (UEM) signatures of naval ships and submarines.

MANUFACTURER: Dr. STEPHEN GEDNEY ADDRESS: Department of Electrical Engineering, University of Colorado, Denver, 1200 Larimer Street, Denver, CO 80204

POC: Dr. Stephen Gedney, Stephen.gedney@ucdenver.edu;

III. BASIS FOR DETERMINATION FOR USE OF OTHER THAN FULL & OPEN COMPETITION

A. BRAND NAME:

Item required must be a brand name product, or feature of a product, particular to one manufacturer.

1. Restrictive Rights: The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required.

2. Exclusive Licensing Agreements: The item or service is only available from the Original Equipment Manufacturer (OEM).

3. Other Reasons:

B. SOLE SOURCE (select all that apply)

1. Restrictive Rights: The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required.

2. Exclusive Licensing Agreements: The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.

3. Other Reasons: Measuring the magneto-elastic and stress-induced magnetization properties of Navy Steels is critically important as it dictates the Navy’s ability to confidently predict the magnetic signature of Navy vessels in general and submarines in particular. These properties as well as their measurement and characterization are very specifically needed by the Navy. The Magnetic Materials Laboratory at the University of Colorado, Denver built under the Defense University Research Instrumentation Program (DURIP) program is unique in the nation for its capabilities for the detailed, controlled, and precise measurements of these properties.

As such, the Magnetic Materials Laboratory is the only entity built for the express purpose of developing measuring techniques and making high precision measurements for the characterization of magneto-elastic and stress-induced magnetization properties of Navy Steels. Professor Stephen Gedney is not only an internationally recognized expert in the very specialized fields of magneto-elastic and stress-induced magnetization properties of Navy Steels but also has developed unique capabilities for incorporating these specialized measurements into practical computational models. Furthermore, Professor Gedney built the Magnetic Materials Laboratory under the DURIP program and is therefore the sole subject matter expert with the capability for the measurement and characterization of the properties that the Navy is interested in. Taken together, funding the Magnetic Materials Laboratory is critical for providing the necessary knowledge in the field of stress-induced magnetization to the Navy.

IV. CERTIFICATIONS & APPROVALS

A. Technical/Requirements Certification: I certify that the facts and representation under my cognizance, which are included in this justification, are complete and accurate to the best of my knowledge and belief.

B. Certification/Approval per FAR 13.501: Upon the basis of the above justification, I hereby approve the solicitation of the proposed procurement(s) described herein using other than full and open competition, pursuant to the authority of 10 U.S.C. 2304(c).
