Summary: CEEC Modular Building Procurement - Attachment A Bid Specifications
This is a Request for Proposals (RFP) bid specifications document issued by the University of Massachusetts Amherst for the design, prefabrication, site assembly, and installation of modular building units for a new Center for Early Education and Care (CEEC) facility. The project involves construction of a 12,800 square-foot modular building comprising four preschool classrooms, six toddler classrooms, children's bathrooms, storage rooms, administrative offices, a gross motor room, kitchen, entrance, corridors, and supporting services. Responsive proposals must be submitted electronically through the BuyWays portal and must include technical non-price proposals, price proposals, preliminary drawings and specifications, bid deposits, required certifications, and other documentation outlined in the RFP. All construction work, including modular unit installation, interior works, site work, inspections, and occupancy permit acquisition, must be completed no later than July 16, 2027, with facility operations commencing in September 2027. The University will award the contract within 60 days of the proposal due date, with an option to extend up to 45 additional days by mutual agreement. The successful contractor must execute the contract within 10 business days of award notification.
The RFP requires a firm, fixed price proposal that includes all materials, labor, services, performance and payment bonds, and insurance. A bid security of five percent of the proposal price, submitted as a bid bond or certified check, is mandatory. The University will give preference to modular buildings manufactured in Massachusetts, followed by buildings manufactured elsewhere in the United States, with out-of-country manufacturing as the least preferred option, provided all other considerations are equal. Prevailing wage rates apply to all on-site construction work. The evaluation committee will assess non-price proposals using a 300-point rating system based on criteria including contractor references for similar projects, conformance to building layout and specification requirements, project schedule realism and detail, construction safety practices, warranty value and longevity, and code compliance certifications. The contractor is responsible for all permitting, site preparation, utility connections, foundation construction, and related site work, with no charges to the University for water or electricity use during construction. All employees working on the project must complete a minimum 10-hour OSHA-approved construction safety and health course prior to commencing work.

UNIVERSITY OF MASSACHUSETTS AMHERST
REQUEST FOR PROPOSALS
New Center for Early Education and Care
UMA 27-07
Part I. General Information
Pursuant to M.G.L. c. 149, § 44E(4), the University requests proposals from qualified contractors for the design, prefabrication, site assembly/installation and all services required to complete and deliver modular building units ready for use and occupancy.
All proposals submitted in response to this Request for Proposals (RFP) shall be subject to all contract terms and conditions set forth in Part IV, "Contract Terms." Any contract awarded because of this procurement shall incorporate these terms and conditions.
The University will consider awarding only those proposals that are both responsive and submitted by responsible contractors.
• A responsive proposal is one that fully complies with the requirements outlined in Parts
II and III of these Bid Specifications.
• A responsible contractor is a contractor that demonstrably possesses the skill, experience, capability, financial capacity, and integrity necessary to successfully and faithfully perform the work required under this procurement.
Proposals are to be submitted no later than the deadline stated in this Request for Proposals (RFP) document, and the technical non-price proposal documents will be opened at that time. Every proposal must be submitted electronically in the BuyWays portal as multiple individual files uploaded in response to the respective questions in accordance with all submission requirements set forth on in this RFP and all the attachments. Late proposals will not be accepted.
Each responsive proposal from a responsible contractor will be evaluated solely according to the criteria set forth in Part V “Evaluation Criteria” Below. Each non-price proposal will be assigned a rating of highly advantageous, advantageous, not advantageous, or unacceptable with respect to each criterion, and the reasons for each rating will be set forth in writing. A composite rating for each non-price proposal will be set forth in writing, along with the reasons for the rating.
The Evaluation Committee will determine the most advantageous proposal from a responsible and responsive offeror, taking into consideration the non-price proposal ratings and proposal price. If the contract is awarded to an offeror that did not submit the lowest price, the evaluation committee will set forth a written explanation of the reasons for the award.
In determining the most advantageous proposal, the University shall give preference, other considerations being equal, first to modular buildings manufactured within Massachusetts, and second to modular buildings manufactured outside of Massachusetts but within the United States.
Proposals will not be opened publicly but will be opened in the presence of one or more witnesses at the time stated in this RFP. The contents of proposals shall remain confidential and shall not be disclosed to competing offerors until the completion of the evaluation. At the opening of proposals, the University shall prepare a register of proposals for public inspection.
An offeror may correct, modify, or withdraw a proposal by written notice uploaded to the BuyWays portal prior to the time set for the opening of proposals. After the opening, a contractor may not change the price or any other provision of the proposal in a manner prejudicial to the interest of the University or to fair competition. The University shall waive minor informalities or allow the offeror to correct them. If a mistake and the intended offer are clearly evident on the face of the document, the University shall correct the mistake to reflect the intended correct offer and so notify the offeror in writing, and the offeror may not withdraw the offer. The University may permit an offeror to withdraw an offer if a mistake is evident on the face of the document, but the intended correct offer is not similarly evident.
The University reserves the right to cancel this procurement at any time before a contract is executed and approved, in which event the University will reject all proposals received in response to this RFP.
The contract will be awarded as expeditiously as possible but no later than sixty (60) days after the proposal’s due date. The time for the award may be extended for up to forty-five (45) additional days by mutual agreement between the University and the most advantageous proposer.
The successful proposer/contractor must execute the contract within ten (10) business days from the date of notification of award under this RFP. The contractor must complete all construction work, (including the installation of all modular units, interior works, site works, inspections, and obtaining the occupancy permit), no later than July 16, 2027. The University aims to start operations at the new facility in September 2027 for the 27/28 school year, with August 2027 designated for commissioning and moving the CEEC program from the existing location to the new facility.
