About this file

This is a Standard Specifications document for Mt. San Antonio College establishing the substitution procedures and product options for contract work. The document outlines the comprehensive process for requesting substitutions of specified materials, equipment, and products throughout the project lifecycle, with distinct procedures for requests submitted prior to bid receipt versus those submitted after contract award. Substitution requests submitted before the bid deadline must be received a minimum of 14 days prior to bid opening, while post-award requests are limited to specific circumstances including regulatory non-compliance, product discontinuation, unavailability due to scheduling constraints, performance or fit issues discovered after award, manufacturer unsuitability declarations, or situations deemed in the District's best interest. All substitution requests require submission of six copies using the District's official Substitution form (Section 0430) and must include comprehensive documentation encompassing the statement of cause, product identification, manufacturer information, reference projects, maintenance and replacement material availability, regulatory approvals, product data and drawings, fabrication and installation procedures, product samples, itemized quality comparisons, coordination requirements, schedule impact analysis, cost information, and certification of equivalence or superiority to specified products.

The District and Architect maintain sole discretion in all substitution determinations, which are final and require no documentation or justification. Decisions on substitution requests must be rendered within 10 days of receipt, with the specified product required if no decision is made within the allocated timeframe. The entity requesting substitution bears the burden of proof for merit and is responsible for obtaining all required regulatory approvals prior to submittal, with all associated costs reimbursable to the District regardless of acceptance or rejection. Upon approval, substitutions submitted prior to bid opening are formalized through addendum, while post-award approvals are issued as Change Orders. Submitting entities represent that proposed substitutions meet or exceed specified quality levels, provide equivalent warranties, require no additional District costs for coordination or installation, and waive claims for cost increases or schedule extensions. Incomplete submittals, inadequate warranties, vague documentation, or failure to meet specified requirements result in automatic rejection, and substitute products cannot be included in bids or ordered for installation without written acceptance.
