About this opportunity

The Commonwealth of Kentucky, through the Kentucky Transportation Cabinet (KYTC), Division of Purchases on behalf of the Division of Maintenance, is soliciting bids for High Performance Cold Mix asphalt in a one-time procurement under RFB 22-273. The procurement seeks to supply High Performance Winter Asphalt Cold Mix suitable for stockpiling and use in patching operations during cold and damp weather on asphalt or concrete pavements, with a total quantity of 2,200 tons distributed across 12 districts throughout Kentucky. Bidders must submit unit pricing per ton on an F.O.B. Destination Freight Prepaid basis, with pricing inclusive of all labor, materials, equipment, and delivery costs, and must bid all line items within a selected district to be considered for award. The solicitation employs a best value scoring methodology allocating 95 points to price and 5 points to delivery performance, with vendors required to guarantee delivery within 30 days or face rejection as non-responsive; late deliveries beyond the contracted due date incur liquidated damages of 1 percent per day. Only high performance cold mix from pre-approved liquid asphalt suppliers—including UPM Cold Mix, QPR Cold Mix, K-Link, EZ Street Asphalt, Jasa HP, and Seaboard Asphalt Bond-X—will be accepted, and the product must maintain adhesive qualities for at least one year in uncovered stockpiles and remain workable at temperatures above -15°F, with a one-year warranty against distress. Electronic bids must be submitted through the Kentucky eProcurement system by December 1, 2021, at 1:30 p.m. Eastern Time; the deadline for written questions is November 23, 2021, at 4:00 p.m., with Commonwealth responses issued by November 24, 2021; the tentative award date is December 10, 2021, with online bid readings conducted at 3:00 p.m. Eastern Time on the closing date.

Kentucky resident bidders are eligible for reciprocal preference, and qualified bidders including Kentucky Correctional Industries, Kentucky Industries for the Blind, and certain nonprofit agencies receive preferences of 20 percent and 15 percent respectively of maximum points; however, no specific set-asides for disadvantaged enterprises are identified in the solicitation. Vendors must provide plus or minus 10 percent of the requested quantity for each county and are paid only for actual amounts delivered within the specified tolerances. All responding entities must complete and submit the Annual Affidavit (effective August 2020) affirming compliance with Kentucky campaign finance laws, sales and use tax registration requirements, and absence of state tax delinquencies or jurisdictional boycott involvement. Payment will occur within 30 working days of receipt of goods and proper invoices, with penalty payments of 1 percent per month assessed for payments exceeding this timeframe. The contract value is contingent upon submitted unit pricing multiplied by the actual quantities delivered across the district locations; no incumbent vendors or budget range is specified in the solicitation documents.
