About this opportunity

The Idaho Transportation Department has requested an exemption from competition to procure HVAC support and maintenance services for its existing Delta building automation system, with the exemption-review comment period closing September 2, 2026. The sole-source intent — contingent on discretionary approval by the Idaho Division of Purchasing Administrator — is the primary filter for bidders assessing competitive viability.

ITD seeks continuous commissioning, automatic fault detection, and ongoing maintenance, monitoring, and technical support for the Delta platform controlling HVAC equipment and integrated building systems. Required services include system operation, diagnosis, modification, and preservation of the existing Delta infrastructure without replacement. The awardee must provide factory-level technical support, system diagnostics, engineering assistance, software and firmware support, manufacturer-level escalation, and documentation of current ISO 9001:2015 certification or equivalent quality-management standards. The platform supports BACnet/SC for integration and expansion.

The anticipated total cost is $3.272 million as a one-time purchase. The proposed supplier is ATS Delta. ITD's exemption justification centers on compatibility and transition risk: switching vendors would create substantial operational exposure, including loss of proprietary programming, controller and field-equipment incompatibility, recreation of graphics and databases, loss of historical operating data, additional commissioning requirements, potential HVAC downtime, staff retraining, and increased lifecycle costs. ITD asserts that maintaining the existing Delta platform through the current provider ensures forward and backward compatibility for future software releases, controller replacements, and system expansions while reducing risks from unsupported software and incompatible updates.

The Division of Purchasing is inviting suppliers to submit information supporting or contradicting the exemption claim prior to September 2, 2026. Submissions may be made via IPRO or emailed to purchasing@adm.idaho.gov. The Administrator's decision is discretionary and not subject to appeal.

In the interest of transparency, DOP is offering suppliers the opportunity to review this requested exemption and provide relevant information. The decision remains discretionary, and suppliers have no right to appeal the Administrator's decision. Suppliers are invited to provide information that may help the DOP Administrator make a decision regarding this requested exemption from competition.
