About this opportunity

The Utah Division of Purchasing is publishing a Notice of Intent to Award a Contract Without Engaging in a Standard Procurement Process for Contract 266127 Extension & Funds Increase, with a challenge period ending October 7, 2026. The state claims sole source, significant transitional costs, or circumstances making standard procurement impractical as justification for non-competitive award. The specific rationale is detailed in supporting files that must be reviewed before pursuing or challenging the award intent.

Vendors may challenge the non-competitive determination by submitting documentation demonstrating alternative competing sources, comparable or superior products meeting or exceeding specifications, or cost comparisons related to transitional expenses. All vendors must certify compliance with Utah Code 63G-27 et seq., which prohibits economic boycotts and boycotts of the State of Israel, and must maintain this certification throughout the contract term.

The notice indicates that additional legislative appropriations may be added to awarded contracts if supplemental funding is provided by the legislature. Specific contract term, incumbent contractor information, pricing terms, set-asides, scope of work, and funding amounts are not detailed in the notice itself and require review of attached documentation. Vendors with questions should contact the Division of Purchasing directly.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that: - there is only one source for the procurement item; - transitional costs are a significant consideration in selecting a procurement item; or - the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
