About this opportunity
The West Virginia State Police is soliciting on a sole-source basis for one Ballistic Shield (Safariland NEW Assault III LW 20X36, Model #1362603) and one Ballistic Shield Lens (Safariland PTA-SA Assault Viewport Lens 3 Layer Tear Off Kit, Model #1355021), with proposals due August 4, 2026 at 12:00 p.m.
This is a sole-source procurement under Agency Sole Source Determination ASSD 0612 SP15270000001, reflecting that only one vendor meets the agency's requirements for these specific ballistic protection items. Delivery is to the West Virginia State Police, 4124 Kanawha Turnpike, South Charleston, WV 25309.
The contract is subject to West Virginia's standard contractual addendum (WV-96), which prohibits advanced payments except for software and SaaS licenses, mandates Attorney General approval for amendments or renewals, retains all data ownership by the state, and prohibits contract assignment without written change order and Attorney General approval. The state may terminate for convenience with thirty days' written notice and will pay only for goods or services actually delivered prior to termination. Funding is contingent upon legislative appropriation; non-appropriation is not an event of default.
Vendors must execute a Purchasing Affidavit under W. Va. Code 5-22-1(i) before a notary, affirming they are not in default on monetary obligations to the state or any political subdivision. For non-construction contracts, vendors and related parties cannot owe aggregate debts exceeding one thousand dollars or be in employer default, including workers' compensation liabilities.
If federal funds are utilized, the contract incorporates fourteen federal provisions including Davis-Bacon wage rates for construction exceeding $2,000, clean air and water standards for contracts exceeding $150,000, equal employment opportunity requirements, debarment verification through the System for Award Management, and Byrd Anti-Lobbying certifications for awards exceeding $100,000.
