The purpose of this amendment is to provide notice to all currently known parties, all prospective offerors, and other persons that the appeal of the North American Industry Classification System (NAICS) code designated in the solicitation, filed on October 28, 2016, has been decided as of November 17, 2016. As per the attached decision (11 pages) NAICS Appeal of LJR Solutions, LLC, SBA No. NAICS-5791 (2016), the United States Small Business Administration Office of Hearings and Appeals denied the appeal, concluding that the Appellant failed to establish clear error in the CO's NAICS code designation, further concluding that NAICS code 541711, Research and Development in Biotechnology, is the appropriate code for this procurement.

Update #2 ·

The U.S. Food and Drug Administration (FDA) National Center for Toxicological Research (NCTR) has a requirement for On-site Animal Care, Technical Procedures, Formulation, and Veterinary Care Services in support of FDA's mission. NCTR is located at the Jefferson Laboratory Complex in Jefferson, AR.

NCTR requires support services to NCTR's animal research program, but not limited to the provision of quality care to all research animals, sanitation of all animal care and diet preparation/formulation facilities, provision of protocol-specified technical procedures, provision of veterinary care to the non-human primate colony, and provision of formulation services (receipt, storage, formulation, packaging, and distribution of animal diets and test articles). Ancillary tasks necessary to accomplish these services are included (e.g., quality control, occupational safety and health, inventory control, equipment maintenance, development and maintenance of standard operating procedures, and a comprehensive training program). The need for these services is paramount as the preponderance of NCTR's research mission can only be accomplished through animal research. In addition, major funding sources for the Center's research program, such as the National Toxicology Program, mandate animal-based research projects. Such projects are highly regulated and demand exemplary execution.

This solicitation is set aside 100% for small business.

This is a follow-on acquisition for continuous on-site Animal Care services presently being performed by Priority One Services, Inc. (POS) under contract number HHSF223201110018C.

See attached Solicitation #16-223-SOL-00036 and supporting documents: Attachments 1-9.
