Contract Amendment Summary
This is Amendment 1 to Contract YH23-0067, a state and local contract between the Arizona Health Care Cost Containment System (AHCCCS) and the Arizona Board of Regents acting on behalf of Arizona State University (ASU). The amendment, effective upon final signature and dated March 23–25, 2023, is administered under the DGA program. The primary purpose of this amendment is to update the contractor's legal name to Arizona Board of Regents, Acting on Behalf of the Arizona State University, and to replace the contract's Definitions, Uniform Terms and Conditions, Special Terms and Conditions, and Insurance Requirements sections with new standardized terms and conditions.
The amended contract retains all other provisions of the original agreement and incorporates new terms and conditions governing the parties' relationship. Key contractual elements include payment terms based on a Price Sheet per project, non-availability of funds provisions allowing AHCCCS to terminate at the end of any appropriation period without liability, and compliance requirements including HIPAA, E-Verify, Federal Immigration and Nationality Act requirements, and non-discrimination standards. The contract permits termination by either party upon thirty working days' written notice and requires ASU to maintain all records relating to contract performance for five years following completion. The parties acknowledge mutual self-insured status and agree to resolve disputes through arbitration under Arizona law with venue in Maricopa County.

You will have the ability to download and print documents we send to you through the DocuSign system during and immediately after the signing session and, if you elect to create a DocuSign account, you may access the documents for a limited period of time

If you elect to receive required notices and disclosures only in paper format, it will slow the speed at which we can complete certain steps in transactions with you and delivering services to you because we will need first to send the required notices or disclosures to you in paper format, and then wait until we receive back from you your acknowledgment of your receipt of such paper notices or disclosures. Further, you will no longer be able to use the DocuSign system to receive required notices and consents electronically from us or to sign electronically documents from us.
All notices and disclosures will be sent to you electronically
