Request for Proposal Lowest Price, Technically Acceptable
RFP Number: YA1323-15-BC-0006 Post Date: 07/30/2015
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.
This is Request for Proposal, YA1323-15-BC-0006, is for Open Market Pricing.
The purpose of this notice is to provide you with the information that you need in order to provide the Government with a proposal.
The Census Bureau is extending an existing operational Citrix technology-based system to allow for end user access and compatibility. This license renewal enables Census to maintain the current system environment and be eligible for upgrades of current technology. It also allows for technical support of the Citrix products and Technical Relationship Manager (TRM) hours.

2. Contract Type The Government intends to issue a Firm-Fixed-Price order for the product and services described in the Product Sheet (attachment 2) of this RFP.
3. Order Price In consideration of the Contractor’s full performance of the work, and in accordance with the terms of the order, the U.S. Census Bureau will pay the Contractor the fixed price of $(TBD) for the Base Period as provided through Compensation and Payment Provisions. Contractor’s price includes any and all costs and expenses, direct and indirect, as well as any profit, fee, or any markups of any nature.

4. CAR 1352.270-70 Period of Performance
(a) The base period of performance of this contract is from September 16, 2015 – September 15, 2016. If an option is exercised, the period of performance shall be extended through the end of that option period.
(b) The option periods that may be exercised are as follows:
Option Period One (1) - September 16, 2016 – September 15, 2017 Option Period Two (2) -September 16, 2017 – September 15, 2018
c) The notice requirements for unilateral exercise of option periods are set out in FAR 52.217-9.

5. Progress Reporting The Contractor shall provide a monthly written report to indicate the # of Service Requests, Summary, Status, and Date Case was Open/Closed, and TRM hours Used/Remaining.
6. Inspection and Acceptance

(a) The place of acceptance will be:

6.1 Responsibility for Inspection and Acceptance
Inspection and acceptance of all items and services under this contract will be accomplished by the government’s designated Contracting Officer Representative (COR). The COR will inspect and be responsible for, the review and acceptance of all deliverables under the contract. Acceptance testing will be specified, if required.
6.2 Deliverable Acceptance Standards
1. Citrix license renewals must be delivered so that no lapse in product maintenance and support occurs. They must continue to be able to be integrated and recognized into the Citrix Licenses Server to be deemed acceptable.
2. Timeliness – Work products shall submitted on or before the due date specified in this
RFP
3. Census monitors the licenses usage from our license server, and can determine if the renewal/maintenance occurred by the availability of upgrades.
7. Deliverables All Products listed on the Product Sheet must be delivered no later than September 30, 2015 by
12:00 PM EST.

9. Contract Authority CAR 1352.201-70 Contracting Officer’s Authority (March 2000) The Contracting Officer is the only person authorized to make or approve any changes in any of the requirements of this contract and notwithstanding any provisions contained elsewhere in this contract, the said authority remains solely in the Contracting Officer. In the event the Contractor makes any changes at the direction of any person other than the Contracting Officer, the change will be considered to have been made without authority and no adjustment will be made in the contract terms and conditions, including price.

CAR 1352.201-71 Contracting Officer’s Representative (COR) (Feb 2005)
(a) Christine L Milliken is hereby designated as the Contracting Officer's Representative (COR). The Government may change the COR at any time without prior notice to the Contractor by a unilateral modification to the Contract. The COR is located at:

(b) The responsibilities and limitations of the COR are as follows:
(1) The COR is responsible for the technical aspects of the project and serves as technical liaison with the Contractor. The COR is also responsible for the final inspection and acceptance of all reports, and such other responsibilities as may be specified in the contract.
(2) The COR is not authorized to make any commitments or otherwise obligate the Government or authorize any changes, which affect the Contract price, terms or conditions.
Any Contractor request for changes shall be referred to the Contracting Officer directly or through the COR. No such changes shall be made without the expressed prior authorization of the Contracting Officer (CO). The CO may designate assistant or alternate COR(s) to act for the COR by naming such assistant/alternate(s) in writing and transmitting a copy of such designation to the Contractor.
10. Billing Instructions
1. The Contractor shall provide a single point of contact for handling billing issues. The
Contractor shall provide a mailing address and a telephone number of the POC in order for the Government to notify the Contractor of billing problems.
2. Billing for products provided under a Firm Fixed Price Basis: For the product to be delivered under this fixed price basis, the contractor shall submit one (1) single invoice for the licenses and support good for one year.
Proper Invoice Information
(a) To constitute a proper invoice, the invoice must include, at a minimum, the following information:
• Title: ___TBD_____
• Name and Address of Contractor
• Contact Name, Title and Telephone Number
• Government Contract Number or Other Authorization for Delivery of Goods or Services
• Date of the Invoice
• Invoice Number, Account Number, or any other identifying number agreed to by the contract (At a minimum there must be an invoice number)
• Include the Actual date when services were performed or goods delivered.
• Include the Period of Performance on all invoices.
• Description – Including, for example, contract line/subline number, price, and quantity of goods and services rendered.
• Invoice Total for the Current Month
• Projected Cost for the Current Month
• Invoice Total to Date
• Funds Remaining
• Percent of Allocated Funds Invoiced to Date
• Percent of Funds Remaining
• Projected Costs for Next Month
• Projected Surplus or Deficit
• Include discount terms
• Other substantiating documentation or information required by the contract
• Shipping and Payment Terms (Required unless mutually agreed that this information is only required in the contract – Contact the Contracting Officer or Contract Specialist for clarification)
• Taxpayer Identifying Number (TIN) (Required unless agency procedures provide otherwise.)
• Address for mailing payment
• Banking Information such as name and address of bank, routing & account number
(Required unless agency procedures provide otherwise, or except in situations where the EFT requirements is waived under 31 CFR, 208.4.)
There shall also be three statements and signature lines included in the invoice. The wording for these statements is:
I hereby certify, to the best of my knowledge and belief that the services set forth herein were performed during the period stated above are current, accurate and complete.

(The above statement shall be signed by a government representative who has authority to approve the invoice. The COTR with approving authority if the work is authorized through the simplified acquisition system (purchase order) or the Contracting Officer.)
If there is insufficient space in the Standard Form 1034 to provide all of the required information, the Contractor may include the remaining information on bond paper. However, if bond paper is used, the contract, invoice number, and date of invoice must be listed at the top of the second and subsequent pages.
An original plus one copy of the voucher shall be submitted to:

To comply with the above requirements, two (2) sets of each voucher/invoice must be delivered to the Finance Division at the U.S. Census Bureau before it is considered received by the Government. If the voucher/invoice is for services on a time and material or labor hour basis, one of the two sets of a voucher/invoice must have copies of the timesheets or other substantiation attached and must be clearly marked “COTR or ACOTR’s Copy.” The second set of the two sets of a voucher/invoice does not require that the timesheets or other substantiation be attached. However, the second set must be clearly marked “Original for Finance.”
Invoices, which are submitted to an incorrect office, or which do not contain the information specified above, will be returned to the Contractor for corrections.
The final invoice under this task order contract shall be marked “FINAL.”
THE CONTRACTOR IS NOTIFIED THAT IT IS THEIR RESPONSIBILITY FOR
ENSURING THE VOUCHERS/INVOICES ARE DELEIVERED TO THE FINANCE
DIVISION, AND THAT THE COTR OR TASK MANAGER ARE NOT RESPONSIBLE FOR
ENSURING THE ADVANCED COPIES OF THE VOUCHERS/INVOICES ARE
PROVIDED TO THE FINANCE DIVISION.
Method of Payment
(a) Payments under this contract will be made by wire transfer through the Treasury Financial
Communications System.
(b) Not later than seven (7) days after receipt of notice of award, the Contractor shall forward the following information in writing to:

(1) Full name (where practicable), title, phone number, and complete mailing address of responsible official(s),
(i) To whom check payment are to be sent, and
(ii) Who may be contacted concerning the bank account information requested below
(2) The following bank account information required to accomplish wire transfers:
(i) Name, address, and telegraphic abbreviation of the receiving financial institution.
(ii) Receiving financial institution’s 9-digit American Bankers Association (ABA) identifying number for routing transfer of funds. Provide this number only if the receiving financial institution has access to the Federal Reserve Communications System (FRCS).
(iii) Recipient's name and account number at the receiving financial institution to be credited with the funds.
(iv) If the receiving financial institution does not have access to the FRCS, provide the name of the correspondent financial institution through which the receiving financial institution receives electronic funds transfer messages. If a correspondent financial institution is specified, also provide:
(a) Address and telegraphic abbreviation of the correspondent financial institution.
(b) The correspondent financial institution's 9-digit ABA identifying number for routing transfer of funds.
(c) Any changes to the information furnished under paragraph (b) of this clause shall be furnished to the Finance Office in writing at least 30 days before the effective date of the change. It is the Contractor's responsibility to furnish these changes thirty (30) days before submitting invoices to avoid payments to erroneous addresses or bank accounts.
(d) The document furnishing the information required in paragraphs (b) and (c) must be dated and contain the signature, title, and telephone number of the
Contractor official authorized to provide it, as well as the Contractor's name and contract number.

FAR 52.224-1 PRIVACY ACT NOTIFICATION (APR 1984)
The Contractor will be required to design, develop, or operate a system of records on individuals, to accomplish an agency function subject to the Privacy Act of 1974, Public Law 93-579, December 31, 1974 (5 U.S.C.552a) and applicable agency regulations. Violation of the Act may involve the imposition of criminal penalties.
FAR 52.224-2 PRIVACY ACT (APR 1984)
(a) The Contractor agrees to --
(1) Comply with the Privacy Act of 1974 (the Act) and the agency rules and regulations issued under the Act in the design, development, or operation of any system of records on individuals to accomplish an agency function when the task order specifically identifies --
(i) The systems of records; and
(ii) The design, development, or operation work that the Contractor is to perform;
(2) Include the Privacy Act notification contained in this task order in every solicitation and resulting subcontract and in every subcontract awarded without a solicitation, when the work statement in the proposed subcontract requires the redesign, development, or operation of a system of records on individuals that is subject to the Act; and
(3) Include this clause, including this subparagraph (3), in all subcontracts awarded under this task order which requires the design, development, or operation of such a system of records.
(b) In the event of violations of the Act, a civil action may be brought against the agency involved when the violation concerns the design, development, or operation of a system of records on individuals to accomplish an agency function, and criminal penalties may be imposed upon the officers or employees of the agency when the violation concerns the operation of a system of records on individuals to accomplish an agency function. For purposes of the Act, when the task order is for the operation of a system of records on individuals to accomplish an agency function, the Contractor is considered to be an employee of the agency.
(c)
(1) “Operation of a system of records,” as used in this clause, means performance of any of the activities associated with maintaining the system of records, including the collection, use, and dissemination of records.
(2) “Record,” as used in this clause, means any item, collection, or grouping of information about an individual that is maintained by an agency, including, but not limited to, education, financial transactions, medical history, and criminal or employment history and that contains the person’s name, or the identifying number, symbol, or other identifying particular assigned to the individual, such as a fingerprint or voiceprint or a photograph.
(3) “System of records on individuals,” as used in this clause, means a group of any records under the control of any agency from which information is retrieved by the name of the individual or by some identifying number, symbol, or other identifying particular assigned to the individual.

FAR 52.215-19 NOTIFICATION OF OWNERSHIP CHANGES (OCT 1997)
(a) The Contractor shall make the following notifications in writing:
(1) When the Contractor becomes aware that a change in its ownership has occurred, or is certain to occur, that could result in changes in the valuation of its capitalized assets in the accounting records, the Contractor shall notify the Administrative Contracting Officer (ACO) within 30 days.
(2) The Contractor shall also notify the ACO within 30 days whenever changes to asset valuations or any other cost changes have occurred or are certain to occur as a result of a change in ownership.
(b) The Contractor shall—
(1) Maintain current, accurate, and complete inventory records of assets and their costs;
(2) Provide the ACO or designated representative ready access to the records upon request;
(3) Ensure that all individual and grouped assets, their capitalized values, accumulated depreciation or amortization, and remaining useful lives are identified accurately before and after each of the Contractor’s ownership changes; and
(4) Retain and continue to maintain depreciation and amortization schedules based on the asset records maintained before each Contractor ownership change.
(c) The Contractor shall include the substance of this clause in all subcontracts under this task order that meet the applicability requirement of FAR 15.408(k).

FAR 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)
The Government may require continued performance of any services within the limits and at the rates specified in the current period of the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed six (6) months. The Contracting Officer may exercise the option by written notice to the Contractor prior to contract expiration.

FAR 52.204-99 SYSTEM FOR AWARD MANAGEMENT REGISTRATION (Class Deviation from 52.204-7) (September 2012) (DEVIATION)
(a) Definitions. As used in this clause- "Central Contractor Registration (CCR) database" means the retired primary Government repository for Contractor information required for the conduct of business with the Government.
"Commercial and Government Entity (CAGE) code" means-
(1) A code assigned by the Defense Logistics Agency (DLA) Logistics Information Service to identify a commercial or Government entity; or
(2) A code assigned by a member of the North Atlantic Treaty Organization that DLA records and maintains in the CAGE master file. This type of code is known as an "NCAGE code."
"Data Universal Numbering System (DUNS) number" means the 9-digit number assigned by Dun and Bradstreet, Inc. (D&B) to identify unique business entities.
"Data Universal Numbering System+4 (DUNS+4) number" means the DUNS number means the number assigned by D&B plus a 4-character suffix that may be assigned by a business concern.
(D&B has no affiliation with this 4-character suffix.) This 4-character suffix may be assigned at the discretion of the business concern to establish additional SAM records for identifying alternative Electronic Funds Transfer (EFT) accounts (see the FAR at Subpart 32.11) for the same concern.
"Registered in the SAM database" means that-
(1) The Contractor has entered all mandatory information, including the DUNS number or the DUNS+4 numbers, into the SAM database;
(2) The Contractor's CAGE code is in the SAM database; and
(3) The Government has validated all mandatory data fields, to include validation of the Taxpayer Identification Number (TIN) with the Internal Revenue Service (IRS), and has marked the record "Active". The Contractor will be required to provide consent for TIN Attachment, Page 1 of 4 validation to the Government as a part of the SAM registration process.
"System for Award Management (SAM)" means the primary Government repository for prospective federal awardee information and the centralized Government system for certain contracting, grants, and other assistance related processes. It includes-
(1) Data collected from prospective federal awardees required for the conduct of business with the Government;
(2) Prospective contractor submitted annual representations and certifications in accordance with FAR Subpart 4.12; and
(3) The list of all parties suspended, proposed for debarment, debarred, declared ineligible, or excluded or disqualified under the nonprocurement common rule by agencies, Government corporations , or by the Government Accountability Office.
(b)
(1) The Contractor shall be registered in the SAM database prior to submitting an invoice and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation.
(2) The SAM registration shall be for the same name and address identified on the contract, with its associated CAGE code and DUNS or DUNS+4.
(3) If indicated by the Government during performance, registration in an alternate system may be required in lieu of SAM.
(c) If the Contractor does not have a DUNS number, it should contact Dun and Bradstreet directly to obtain one.
(1) A contractor may obtain a DUNS number-
(i) Via the internet at http://fedgov.dnb.com/webform or if the contractor does not have internet access, it may call Dun and Bradstreet at 1-866-705-5711 if located within the United States; or http://fedgov.dnb.com/webform
(ii) If located outside the United States, by contacting the local Dun and Bradstreet office. The contractor should indicate that it is a contractor for a U.S.
Government contract when contacting the local Dun and Bradstreet office.
(2) The Contractor should be prepared to provide the following information:
(i) Company legal business name.
(ii) Tradestyle, doing business, or other name by which your entity is commonly recognized.
(iii) Company physical street address, city, state and Zip Code.
(iv) Company mailing address, city, state and Zip Code (if separate from physical).
(v) Company telephone number.
(vi) Date the company was started.
(vii) Number of employees at your location.
(viii) Chief executive officer/key manager.
(ix) Line of business (industry).
(x) Company Headquarters name and address (reporting relationship within your entity).
(d) Reserved.
(e) Processing time for registration in SAM, which normally takes five business days, should be taken into consideration when registering. Contractors who are not already registered should consider applying for registration at least two weeks prior to invoicing.
(f) The Contractor is responsible for the accuracy and completeness of the data within the SAM database, and for any liability resulting from the Government's reliance on inaccurate or incomplete data. To remain registered in the SAM database after the initial registration, the Contractor is required to review and update on an annual basis from the date of initial registration or subsequent updates its information in the SAM database to ensure it is current, accurate and complete. Updating information in the SAM does not alter the terms and conditions of this contract and is not a substitute for a properly executed contractual document.
(g)
(1)
(i) If a Contractor has legally changed its business name, "doing business as" name, or division name (whichever is shown on the contract), or has transferred the assets used in performing the contract, but has not completed the necessary requirements regarding novation and change-of-name agreements in Subpart 42.12, the Contractor shall provide the responsible Contracting Officer sufficient documentation to support the legally changed name with a minimum of one business day's written notification of its intention to-
(A) Change the name in the SAM database;
(B) Comply with the requirements of subpart 42.12 of the FAR; and
(C) Agree in writing to the timeline and procedures specified by the responsible Contracting Officer.
(ii) If the Contractor fails to comply with the requirements of paragraph (g) (1) (i) of this clause, or fails to perform the agreement at paragraph (g) (1) (i) (C) of this clause, and, in the absence of a properly executed novation or change-of-name agreement, the SAM information that shows the Contractor to be other than the Contractor indicated in the contract will be considered to be incorrect information within the meaning of the "Suspension of Payment" paragraph of the electronic funds transfer (EFT) clause of this contract.
(2) The Contractor shall not change the name or address for EFT payments or manual payments, as appropriate, in the SAM record to reflect an assignee for the purpose of assignment of claims (see FAR Subpart 32.8, Assignment of Claims). Assignees shall be separately registered in the SAM database. Information provided to the Contractor's SAM record that indicates payments, including those made by EFT, to an ultimate recipient other than that Contractor will be considered to be incorrect information within the meaning of the "Suspension of payment" paragraph of the EFT clause of this contract.
(h) Contractors may obtain information on registration and annual confirmation requirements via the SAM accessed through https://www.acquisition.gov or by calling 866-606-8220, or 334-206- 7828 for international calls.

• Offeror’s shall submit past performance reflecting items such as timeliness of product delivery and/or ratings from previous customers (government or private).

Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)).
The proposals are intended to be evaluated, and award made, without discussions with the offeror (other than discussion conducted for the purpose of minor clarification[s]), unless discussions are determined to be necessary.
