The purpose of this amendment is to correct the 24 pairs of fiber optic cable to 24 strands in the statement of work and revise the language in Section 1.3.1 of the statement of work. See Attachment A.

STATEMENT OF WORK
GENERAL REQUIREMENTS
“Fiber Optic Cable Expansion”

1. GENERAL
The objective of this project is to install twenty four (24) strands of armored fiber optic cabling from building 61
LAN closet (1) on the second floor, through basement demark, to terminate in the mezzanine of the Training
Building at the COBRATF; install twenty four (24) strands of armored fiber optic cabling from ARTC Building
162 network wiring closet to terminate in the mezzanine of the Training Building at the COBRATF.
1.1. Scope of Work
The Contractor shall furnish all labor, management, cost estimating, scheduling, equipment, tools, materials, shop drawings, product data submittals, supervision and other items and services necessary, except those specified as
“Government Furnished,” to complete the required project in accordance with this document, specifications, drawings and applicable codes and industry standards. The Contractor will estimate and propose all project scope and any options, if applicable, separately.
1.2 Background Information
1.2.1. The Department of Homeland Security (DHS), Federal Emergency Management Agency (FEMA), Center for Domestic Preparedness (CDP) is a federal entity and is the designated federal training center engaged in preparing emergency first responders, emergency management officials, state and local community leaders and managers to combat terrorism including response to weapons of mass destruction and hazardous materials incidents. Training courses provided by the CDP provide specific knowledge and expertise for deterrence, prevention and response to Weapons of Mass Destruction (WMD) and hazardous materials incidents.
The CDP occupies six major areas of the former Fort McClellan, Alabama. They are:
a. CDP Main Complex (Building 61).
b. Advanced Responder Training Complex (ARTC).
c. CDP Responder Lodging Complex (900 Area).
d. The Chemical, Ordnance, Biological and Radiological Training Facility (COBRATF).
e. The Noble Training Facility (NTF).
f. The Warehouse/Maintenance Complex (Building 40).
1.3. Personnel
1.3.1. Contractor
Contractor shall be a licensed General Contractor (GC), or a licensed Competitive Exchange Carrier in the state of
Alabama. The Contractor must have a minimum of five years of significant supplier and installer experience in commercial applications.
1.3.2. Contract Manager/Superintendent
The Contractor shall designate a qualified contract manager and/or superintendent who will be responsible for the performance of the work. The contractor shall designate an alternate who will be responsible for the performance of the work in the event that that contract manager and/or superintendent is not available. Per Federal
Acquisition Regulation (FAR) Clause 52.236-6, at all times during performance of this contract and until the work is completed and accepted, the Contractor shall directly superintend the work or assign and have on the worksite a competent superintendent or designated alternate who is satisfactory to the Contracting Officer (CO) and has authority to act for the Contractor. The names of the superintendent, the contract manager, and alternate(s) shall be submitted for approval to the government, along with their qualifications. The Contracting
Officer’s Representative (COR) will review the qualifications and determine if the appointees are acceptable.
This contract manager and/or superintendent will also be responsible for conducting weekly meetings with CDP officials to update all work and discuss any discrepancies encountered.
1.4. Safety Requirements, Training, Soil testing Requirements, and Asbestos Containing Material and
Lead Based Paint
In order to provide safety controls for protection of the life and health of employees and other persons; for prevention of damage to property, materials, supplies, and equipment; and for avoidance of work interruptions in the performance of this contract, the Contractor shall comply with all applicable Federal laws and regulations with such additional measures as the government may deem necessary. Applicable provisions of Occupational Safety and Health Administration (OSHA) 29 CFR, Environmental Protection Agency (EPA), and the Alabama
Department of Environmental Management (ADEM) regulations will be applied to all work under this contract.
1.4.1. The Contractor(s) performing work at the CDP are required to show proof in the form of written documentation on required training specific to the work they may be required to perform on the project.
1.4.2. The Contractor shall ensure all tools, equipment, and machinery are in good working order. These items may be inspected by the CDP Safety Officer when the Contractor reports to the job site and at any subsequent time deemed appropriate by the CDP Safety Officer. Safety Data Sheets (SDS) for products containing hazardous chemicals will be reviewed by the government before they are used on the project. Contractors shall provide this information during the pre-construction meeting.
1.4.3. All Contractors and subcontractors performing work at the COBRATF will be required to attend site specific safety awareness training. This training will be provided at no cost and will take approximately one hour to complete.
1.4.4. Contractors are required to provide their personnel with the Personal Protective Equipment (PPE) necessary to complete the project. Sturdy, over-the-ankle boots, hard hats, and safety glasses with solid side shields shall be worn in all construction areas.
1.4.5. The McClellan Development Authority (MDA) landfill requires disposal of soils from Fort McClellan to be tested for contamination prior to disposal. Currently the only testing required by the landfill is for Toxicity
Characteristic Leaching Procedure (TCLP) metals. The contractor shall verify the current testing requirements for the chosen disposal facility and provide the required testing as part of this contract.
1.4.6. Some buildings at the CDP have been tested for asbestos and some buildings at the CDP do contain asbestos. If asbestos is known or may possibly be in the direct working environment, additional documentation will be provided. If the Contractor in the course of his work encounters suspected asbestos containing material that has not been addressed by the CDP, the CDP Safety Officer shall be immediately notified.
Some buildings at the CDP have been tested for lead-based paint and some buildings at the CDP do contain lead-based paint. If lead-based paint is known or may possibly be in the direct working environment, additional documentation will be provided. If the Contractor in the course of his work encounters suspected lead-based paint that has not been addressed by the CDP the CDP Safety Officer shall be immediately notified.
1.4.7. Contractors are expected to designate a qualified employee as a project Safety Representative. Qualified personnel trained in safety issues are defined as experienced employees, specifically designated on Contractor employee or payroll records as a Safety Representative or similar title, and possessing special qualifications and training in OSHA regulations. The qualifications of the designated safety representative will be reviewed by the
CO/COR for approval prior to designation.
1.4.8. If at any time during the life of the Contract the government determines that continued unsafe work practices occur, the CO may direct the Contractor to revise and/or supplement the present organization structure with additional qualified personnel trained in safety issues at no additional cost to the government or time extensions to the Contract.
1.4.9. The CO or COR will notify the Contractor of any non-compliance with the foregoing requirements. The
Contractor shall, after being notified, immediately take corrective action. If the Contractor fails, or refuses, to comply promptly, the CO may stop all or part of the work until satisfactory corrective action has been taken. No part of the time lost due to any such Stop Work Orders shall be legal grounds for an extension of time or for additional cost or damages incurred by the Contractor.
1.4.10. The Contractor shall include the provisions of this section (1.4 Safety Requirements) in all subcontracts and purchase orders. However, such requirement in the Contractor’s lower-tier subcontracts or purchase orders shall not relieve the Contractor of its obligation to assure compliance with the requirements of this clause for all aspects of the work whether performed by the Contractor or its lower-tier subcontractors.
1.5. CDP Security
1.5.1. The Contractor is responsible for the physical security for all materials, supplies and equipment of every description, including property that may be government owned, Contractor operated, work areas, storage areas, and also areas occupied jointly by the Contractor and the government. The Contractor shall comply with all CDP security requirements.
1.5.2. Contractor employees and employees of lower-tier subcontractors whose conduct is determined to be prejudicial to the interest of the Government shall be immediately removed from the work upon notification by the CO.
Compliance with the foregoing provisions of this paragraph by lower-tier subcontractors shall be the responsibility of the Contractor and there shall be no additional costs to the government for such action.
1.5.3. The government reserves the right at all times to issue instructions pertaining to the Contractor’s jurisdiction and general conduct of its security program and shall have the right to examine procedures, methods, records, and facilities used by the Contractor in complying with the requirements of the government.
1.5.4. The Contractor shall require employees requiring on-site access to display such Identification Badging as may be approved and directed by the CO. All prescribed Identification Badges shall immediately be returned to the government for cancellation upon release of any employee.
1.5.5. The Contractor shall be responsible to adhere to any and all security regulations imposed by the government.
1.5.6. The CDP is designated as a workplace free of Alcohol and Substance Abuse problems associated with drugs and other chemical substances. The government may conduct periodic and unannounced inspections of the
Contractor’s work areas within government property (CDP) boundaries.
1.5.7. A local background security check form must be completed by each Contractor employee and routed through the CDP security office for processing. The security forms will be provided by the CO/COR as soon as the contract is awarded. Allow 14 workdays to process the local security check; therefore, it is advisable to submit the above referenced security form as soon as personnel who will be working on site are identified. The form must be properly completed in order to preclude delays in processing the request. This form authorizes a local background check by each individual. A successful background check is required before access to the CDP property is granted.
When possible, the Contractor will provide at least two days notification to the COR prior to removing an employee from the project. Any additional personnel added to the established project work force shall be in accordance with this paragraph.
1.5.8. All visitors must report to the Building 61 Front Guard House for badging before proceeding to the job site.
Visitors shall have picture identification for verification purposes. The COR will arrange for the necessary badging of Contractor personnel, as appropriate. All job site security and/or law enforcement related matters shall be processed through the CDP Security Specialist.
1.5.9. The entire CDP security requirement section (1.5.) shall be included by the Contractor in all subcontracts and purchase orders and further requires lower-tier Contractors and vendors to include these same requirements in their subcontracts and purchase orders.
1.6. Quality Assurance
1.6.1. Specific Government quality assurance methods will be determined after contract award, depending on the method of contract. Even though not specifically identified within this package it is expected that quality assurance provided by the Government will be consistent with FAR 52.246-12 (Inspection of Construction).
1.7. Work Plans
1.7.1 General Work Plan
The Contractor shall submit a General Work Plan which will identify how the Contractor intends to ensure requirements of this contract are provided as specified in the Scope of Work (SOW). This plan should be general in nature and encompass all aspects of the project from Notice to Proceed (NTP) to Project Closeout. The
General Work Plan shall consist of the following elements:
a. Brief description of the objective of the work, providing a context for the information to follow, and offering a basis for evaluating the work.
b. Brief discussion of the technical approach for executing the work.
c. Identification of the Superintendent, Contract Manager, and any designated alternates.
The Final General Work Plan shall be submitted to the COR for review and approval within 10 working days of the NTP.
1.7.2 Safety Plan
The Contractor shall establish and maintain a complete Safety Plan to ensure the requirements of this contract are provided as specified. The Contractor shall submit to the COR a written Accident Prevention Plan for review and approval. This plan shall include an analysis of significant hazards to life, limb, and property inherent in the contract work to be performed. The Contractor shall meet with the COR, CDP Safety Officer, and any CDP staff deemed necessary to discuss and develop a mutual understanding of the proposed plan. (Ref: EM 385 1-1
Appendix A.) The Final Safety Plan shall be submitted to the COR for review and approval within 10 working days of issuance of the NTP.
1.7.3 Quality Control Plan
The Contractor shall establish and maintain and implement a complete Quality Control Plan to ensure the requirements of this contract are provided as specified. The plan shall describe the methods of identifying and preventing defects in the quality of service performed before the level of performance becomes unacceptable. The plan must include, at a minimum, the following:
a. The Contractor shall provide a qualified Quality Control Manager (QCM) who will be responsible for implementing the Quality Control Plan. The QC manager shall conduct QC duties independent of the project Superintendent. Names, qualifications, duties, responsibilities, and authorities of QC personnel shall be included in the QC Plan.
b. Procedures for conducting QC inspections on all work, pre-final, and final inspections.
c. Procedure for identifying, documenting, and tracking deficient work from identification through acceptable corrective action.
As part of Quality Control, the Contractor shall provide photographic documentation throughout the course of the project and at the completion of major milestones of the project. These photos shall be provided in electronic format.
The Final Quality Control Plan shall be submitted to the COR for review and approval within 10 working days of the NTP.
1.7.4 The Contractor shall submit a detailed Work Plan for any unusual or complex features of work deemed necessary by the COR to ensure requirements of this contract are provided as specified in the SOW. A detailed
Work Plan may also be required for specific features of work that require utility interruptions or when utility interruptions become necessary during the course of construction.
The detailed Work Plan shall consist of the following elements:
a. Brief description of the objective of the work, providing a context for the information to follow, and offering a basis for evaluating the work.
b. Discussion of the technical approach for executing the work to include necessary plans and specifications.
c. Detailed description of the equipment to be used and methodologies and procedures to be employed.
d. Scheduling and operational sequencing and submittal requirements.
e. Identification of applicable regulatory requirements and permits, to include local, state, and federal.
f. Disposal facilities, alternate disposal facilities, and means of disposal.
g. Identification of all persons needed to conduct the field activities, including support personnel and their specific responsibilities, and coordination with the government.
h. Demolition and waste(s) control procedures and authorized haul route as appropriate.
i. Work Phasing Plan and/or General Construction Schedule in accordance with FAR Clause 52.236-15
- Schedules for Construction Contracts.
The detailed Work Plan shall be submitted to the COR for review and approval a minimum of 10 working days prior to commencement of work.
1.8. Hours of Operation
1.8.1. The contractor normally accomplishes all contract work between the hours of 7:30 a.m. CST and 4:30 p.m.
CST, Monday through Friday, excluding Federal holidays.
1.8.2. The CO reserves the right to modify this work schedule for the Contractor’s operations within reasonable parameters on an exception basis to accommodate other site schedules.
1.8.3. Work on weekends, holidays, and outside normal working hours listed above may be allowed if necessary to comply with the required completion schedule. The contractor will request a work schedule variance from the
COR at least two working days in advance of requested variance. This variance will include in detail the work that will be performed, the estimated duration of the variance, and the number of contractor personnel involved.
2. DEFINITIONS
2.1. Contracting Officer (CO): Person duly appointed with the authority to enter into and administer contracts on behalf of the government.
2.2. Contracting Officer Representative (COR): An individual designated and authorized in writing by
Contracting Officer to perform specific technical or administrative functions under the contract.
2.3. Government Property: All property owned by or leased to the Government or acquired by the Government under the terms of this contract. Government property includes both Government-furnished property and contractor acquired property as defined in FAR Part 45.
2.4. Quality Assurance: Those actions taken by the Government to assure services meet the requirements of the
Statement of Work and other service outputs.
3. GOVERNMENT FURNISHED PROPERTY AND SERVICES
No Government Furnished Equipment (GFE) will be available for this effort.
3.1. SERVICES
3.1.1. Operations and storage areas will be designated by the CO in the vicinity of the work site for use by the
Contractor for work and storage areas.
3.1.2. The Contractor may utilize existing building electrical service to power any equipment needed during construction.
3.1.3. Emergency medical services for Contractor personnel are the responsibility of the Contractor. However, when available, CDP emergency medical personnel will stabilize any injured Contractor personnel until local emergency response services arrive on site. No other emergency services shall be provided by the Government.
4. CONTRACTOR FURNISHED ITEMS AND SERVICES
4.1. General
Except for those items or services specifically stated to be Government furnished in Section 3, the contractor shall furnish everything required to perform this contract.
4.2. All affected drawings shall be redlined to incorporate contractor installed equipment and connections.
5. ADDITIONAL REQUIREMENTS
5.1. Appropriate measures should be taken to minimize damage to surrounding grounds, structures, and shrubbery during all work requirements and processes. Contractor must repair surrounding grounds, structures, and shrubbery due to construction and/or damage from construction. Grounds should be raked and smoothed free of debris to match adjoining ground level, and grass areas should be re-sown with grass seed and appropriate straw or replaced with sod in areas of a sod grass. Damaged shrubbery should be properly restored or replaced, and damaged structures should be repaired to original appearance and function.
5.2. Where specific dimensions, details or design intent cannot be determined, consult with the government representative before proceeding with the work.
5.3. If work involves digging in or around utilities, the Contractor will be responsible for locating commercial utility service lines by contacting the commercial locator service (Alabama One Call), and/or the required utility companies designated locating personnel.
5.4. CDP will provide all available drawings of privately owned utilities for use by the contractor in locating existing utilities. It is the contractor’s responsibility to verify the location of existing utilities. The contractor shall contact the COR if existing utility locations remain questionable. As with all former military bases, documentation of existing utilities dating back many decades is questionable and the contractor should use caution during any excavation.
5.5. Contractor shall repair/replace any utility that is within the (6) feet of the indicated location and damaged by the Contractor’s operations. All repairs shall be performed within 24 hours from the time of breakage unless otherwise directed by the COR. Notify the CO and/or the COR immediately of breakage. Repair materials shall be approved by the COR.
5.6. The Contractor will request, as far in advance as possible with a minimum of 72 hours, the disruption of any function of the facilities. This includes, but is not limited to, any shut-down, relocation, rerouting, etc. of any utilities, services, roads, facilities, personnel, etc. The Contractor shall not proceed with any disruption without the consent of the CO and/or the COR. When given approval for a disruption, the Contractor will accomplish the work during the period agreed upon. The Contractor will be required to notify the CO and/or the COR immediately prior to any disruption and as soon as the work is completed and normal functions are restored.
5.7. Contractor must provide a construction schedule that will outline the period of performance required to complete this task. The work described in this statement of work requires buildings and facilities to be worked in for a period of time and the government reserves the right to approve the work schedule for planning purposes in developing alternative solutions for building occupants, if needed.
5.8. Construction debris, waste materials, packaging material and the like shall be removed from the work site daily. Any dirt or mud which is tracked onto surfaces shall be removed. Materials resulting from demolition activities which are salvageable shall be stored within the supplemental storage area. Stored material not in trailers, whether new or salvaged, shall be neatly stacked when stored. The premises shall be left broom clean.
Stains, foreign substances, and temporary labels shall be removed from surfaces. Carpet and soft surfaces shall be vacuumed. Equipment and fixtures shall be cleaned to a sanitary condition. Operating equipment filters shall be cleaned. The site shall have waste, surplus materials, and rubbish removed. The project area shall have temporary structures, barricades, project signs, and construction facilities removed.
5.9. The contractor is responsible for final cleanup of all work included in the project.
6. SCOPE OF WORK
6.1. Project Description:
The objective of this project is to evaluate and select a Contractor for the installation of fiber stated in the objective.
6.2. Specific Tasks:
6.2.1 Install twenty four (24) strands of armored long haul dark fiber from building 61 LAN closet (1) on the second floor, to route through demark in the basement, to terminate at the COBRATF building 801C
(Training Building) mezzanine on the second floor (fiber length approximately 2.0 miles). (See Exhibit A)
6.2.2 Install twenty four (24) strands of armored long haul dark fiber from ARTC building 162 network closet to terminate at the COBRATF building 801C (Training Building) mezzanine on the second floor (fiber length approximately 1.6 miles). (See Exhibit A)
6.2.3 At the point of intersect of fiber (Freemont and Goode Rds.) from building 61 and fiber from ARTC building 162, trench as required to accommodate both fiber runs in one trench past the COBRATF Post 5 location to the 3” conduit located along fence line in front of COBRATF (see Exhibit A)
6.2.4 From building 801C mezzanine, fiber will route back to Post 5 location (The Post 5 location will require building penetration).
6.2.5 Install conduit with proper fill ratio, where required, to accommodate fiber cabling.
6.2.6 Provide fiber optic patch panels and terminate six (6) pairs of the fiber to panels at each termination point using industry standard cable management practices for cable routing and termination.
6.2.7 Coordinate with the City of Anniston and McClellan Development Authority to ensure project designs adhere to local authority requirements for fiber being installed within the public right of way. Coordinate with the aforementioned local authorities regarding current and future roadway realignments along the anticipated fiber route to determine the optimal installation method and location. It is anticipated that directional boring will be used at road crossings, if another method of installation is proposed the alternate method must be approved by local authorities and the CDP.
Note: Alternate routing may be authorized upon approval by the government and other authorities as required. It is the contractor’s responsibility to determine when and where proper authorization by other authorities is required.
7. DESIGN GENERAL REQUIREMENTS
7.1. General
The design-build Contractor shall provide all management, scheduling, cost estimating, labor, materials, shop drawings, product data submittals, and equipment to design all listed scope of work projects. Design-build
Contractor shall estimate and propose all project scope and any options, if applicable, separately.
7.2. Applicable Codes, Rules, Regulations, Regulatory Agency Approval and Independent Review(s)
7.2.1. It is the design-build Contractor and/or the design professional's responsibility to design the project in compliance with the most current applicable requirements of federal and state laws, codes, rules, regulations, ordinances, standards, and industry standards to include but not be limited to the list below.

Design Professional shall have copies available of applicable codes and regulations for ready reference.
7.2.2. Permits and Licenses
The design-build Contractor shall research all regulatory, permitting and licensing requirements. Where required the design-build Contractor shall submit the plans and/or specification documents to state and/ or local agencies for permitting purposes. Any and all regulatory agency comments received as a result of the agency review shall be forwarded to the CDP for review and approval prior to their incorporation into the documents. Once approved by the CDP, the necessary work to bring the documents into compliance with the comments shall be performed by the design-build Contractor as part of this contract including any subsequent re-submittals that may be required.
7.3. Project Design and Construction Standards
7.3.1. Professional Services
The design-build contractor shall obtain and designate a registered Professional Engineer (PE) as the designer of record who is responsible for the integration and approval of the complete design package. The designer of record shall, per the State of Alabama Board of Engineering Code, be registered in the state of Alabama.
The designer of record shall designate representatives as sign-off authority for individual disciplines required for completion of the design. These individuals must be registered engineers and have significant influence over the development of the design. Approval of the designer of record and designated representatives shall be on all applicable design document, specifications, and shop drawings. All drawings, specifications, reports and design documents and other engineering or land surveying documents submitted for review and approval shall be signed, sealed, and dated by the registered PE.

8. SPECIFIC INSTRUCTION
8.1. Design-Build Contractor Responsibilities
An acceptable quality design shall provide appropriate functional facilities at the lowest practical construction cost, with due consideration for economy in maintenance and operation. The specified construction materials must be of quality that is consistent with the intended use of the facility, the CDP, and reflect local availability and construction skills. Innovative materials and methods should be considered, but only if they provide an economic or functional advantage. Although this scope of work may identify specific elements of construction, it is the design-build Contractor's responsibility to provide all elements which are incidental to provide a fully functional end product.
The Contractor shall comply with FAR Clause 52.236-21 Specifications and Drawings for Construction at all times during the performance of the contract.
8.2. Design Deliverable Formats
8.2.1. The design-build Contractor shall provide 2D drawings in AutoCAD format 2008 or later, pdf format, and two hard copies.
8.2.2. Provide all specifications, materials data cut sheets, operations and maintenance documentation, warranty documents and supporting documents in PDF format, and two hard copies.
8.2.3. Provide all electronic files associated with this project on a labeled CD.
8.3. Design Documents
8.3.1. Within 35 days of award, the design-build Contractor shall develop and submit a 95% design marked “Not for Construction” that includes the following:
a. Basis of design describing the systems, components, conditions and methods chosen to meet the project intent.
b. Final proposed layout and features.
c. Applicable drawings necessary to describe pertinent project features including but not limited to architectural, civil, structural, mechanical, electrical, fire protection, life safety, plumbing, HVAC, etc.
d. Applicable specifications with all catalog cut sheets.
The final drawings, specifications, documents, and reports, once approved by the COR, shall be marked
“APPROVED FOR CONSTRUCTION”.
8.3.2. The design-build Contractor shall not begin construction until all elements of the 100% design submission are approved for construction. The goal is to provide an environment in which all stakeholders participate freely in the design process through program validation, design development sessions and design document review.
Additionally, the design-build Contractor shall evaluate the impact of design decisions on contract budget and schedule and conduct value engineering during the design process.
8.3.3. Within 21 days of receipt of 95% design review comments from the CDP, the design-build Contractor shall deliver the Final Design Package for CDP approval. Construction shall not commence without “APPROVED
FOR CONSTRUCTION” drawings, specifications, and documents. The approval of the drawings, specifications, and documents by the COR shall not be construed as a complete check, but will indicate only that the general method of construction and detailing is satisfactory. Approval of such drawings will not relieve the
Contractor of the responsibility for any error which may exist as the Contractor shall be responsible for the dimensions and design of adequate connections, details, and satisfactory design and construction of all work.
8.3.4. Upon construction completion, the design-build Contractor shall submit as-built drawings in electronic
CAD format, hard copy documents, and redlined drawings. The design-build Contractor shall revise all engineering plans and specifications throughout the duration of the project. The design-build Contractor shall maintain up-to-date red line drawings onsite during construction.
8.4. Design Acceptance
8.4.1. Design documents shall contain a level of quality and detail that is consistent with the current industry standard.
8.4.2. All design documents shall be reviewed and accepted by the CDP.
8.4.3. Contractor shall anticipate a turnaround of 14 calendar days for all design review comments by the CDP.
The CDP shall review each submittal; provide comments to be addressed by the Contractor; the contractor shall submit their proposed comment resolution on the comment form; upon agreement of the CDP with the proposed comment resolution the Contractor shall proceed to the next submittal iteration. A comment review meeting may be necessary if the Contractor’s proposed comment resolutions are not acceptable to the CDP. The 100%
“APPROVED FOR CONSTRUCTION” submittal shall be reviewed and accepted (if all review comments have been appropriately addressed by the Contractor) by the CDP prior to permission to commence construction being granted.
8.5. Submittals

8.5.2. For the submissions identified above, the design-build Contractor shall submit two sets of drawings and project documents (drawings shall consist of two full-size sets and two half size sets), as well as two sets of design calculations to the CDP for review and comment. All design submittals, along with as-built drawings, shall be signed, sealed, and dated by the appropriate licensed professionals. Each submittal of drawings shall be incorporated into an AutoCAD (version 2008 or later) compatible electronic format on compact disc and be delivered to the CDP by the design-build Contractor in addition to the drawing and specification sets required.
Complete project specification documents shall also be furnished on a compact disc in electronic format that is
Microsoft Word compatible.
8.5.3. The design-build Contractor shall be responsible for the professional quality, technical accuracy and adherence to the requirements of the scope of work for all plan submittals required under this contract. The CDP shall perform a review of the required submissions within 14 calendar days of receipt of the submittals. The review will be limited to project constructability (e.g. site problems, existing obstructions or proposed utilities, proposed contract time for construction, omissions, discrepancies, known issues that have occurred at the site or with projects of similar scopes, phasing, and coordination problems that could lead to construction difficulties), design (conformance to the negotiated scope of work) and construction quality control procedures. Review and acceptance of design documents by the CDP does not imply that all applicable codes and current industry standards have been satisfied nor does review and acceptance relieve the design build contractor of the responsibility to provide all services contained within the scope of work with adherence to applicable codes and current industry standards. The CDP may require one or more design review meetings to be at the CDP and shall be attended by the Contractor, key-subcontractors and the design consultants (all disciplines).
8.5.4. Unless stated otherwise, review comments and concurrence with the required submissions do not revise the scope or intent of the project and do not constitute a request for change beyond the negotiated scope of work. In the event CDP personnel determine that any required submission is incomplete which precludes a meaningful review, or does not adhere to the scope of work, CDP personnel will advise the design-build Contractor of the shortcomings and direct the design-build Contractor to revise and resubmit the plan. No time extension will be granted as a result of such action. In the event the design-build Contractor believes that any review comment requires a change to the scope of agreed work, the design-build Contractor shall first consult the CDP for clarification, and shall provide written notice to the CO concerning the reasons why the design-build Contractor believes the scope has been changed.
8.5.5. Following concurrence of the design documentation at the Design Complete stage(s), the design-build
Contractor shall prepare plan sets for use during construction. All review comments shall be resolved in writing by the design-build Contractor to the satisfaction of the CDP before the design-build Contractor submits the final construction plans. Each plan sheet shall have the last revised date noted on the sheet and clearly marked
“APPROVED FOR CONSTRUCTION”. In addition to the review, coordination and specification of interior building finishes/colors submittal (color board) is required where applicable. This submittal is required at the 50%
Preliminary Review Submission construction document and final Design Complete Submission stages of design.
Two copies of the color board shall be submitted to CDP at each of the identified design submissions.
8.5.6. Building Design
The design-build Contractor must be familiar with local construction methods and building materials, and shall provide a design that exemplifies the optimum balance of economy, aesthetics, energy conservation, safety, ease of maintenance and speed of construction. The design-build Contractor shall develop a complete set of documents as required for compliance with current codes and in accordance with the requirements as described.
9. EQUIPMENT
9.1 The design-build Contractor shall clearly differentiate equipment that is a part of the design-build Contractor's responsibility from equipment that is the Government's responsibility.
10. OPTIONAL PROVISIONS
10.1. It is also anticipated that the design-build Contractor will need to assess the design and construction requirements of the City of Anniston Building Codes and McClellan Development Authority.
11. CONSTRUCTION DOCUMENTS
11.1. Reproduction
Three sets of the “APPROVED FOR CONSTRUCTION” documents and drawings, sealed, and dated by the appropriate licensed professionals, shall be reproduced for CDP use.
11.2. Availability of Existing Documents
The CDP shall provide the available drawings of the facilities to include, floor plans, architectural, electrical, mechanical and civil drawings. All drawings shall be provided on a CD for the Contractor’s use.
11.3. Construction Document Guidelines
Contractor shall provide construction plans following the guidelines below.

The Design Professional shall provide electrical distribution panel schedules to include manufacturer information, panel ratings, equipment served, incoming service and location of panels.
11.3.4. Fire Protection
The design-build Contractor shall ensure any changes and/or modifications made under this project will not interfere with fire protection systems of the applicable buildings. All design and/or work must be made within
NFPA guidelines, ensuring fire protection of the applicable buildings.

13. TESTING AND INSPECTION OF SYSTEMS
13.1. The design-build Contractor is responsible for all inspection and testing of work completed under the scope of the project.
13.2. All tests and inspections shall be documented by certified written reports and test results. The contractor shall distribute copies of all testing and inspection reports to the CDP. The design-build Contractor shall make additional copies as required and distribute to all affected sub-contractors and material suppliers.
14. START-UP, COMMISSIONING, AND TRAINING
14.1. The purpose of commissioning documentation is to record the standards of performance for building systems and to verify that what is designed and constructed meets those standards. At a minimum, the design-build Contractor shall accomplish the following:
a. Provide functional performance testing. Verify that the systems operate in accordance with the design intent.
b. Retest specific systems and/or system components once the deficiencies discovered during the first test are resolved.
c. Testing should examine systems as a whole in order to evaluate overall design and compatibility.
