About this file
This is a Worker Protection and Investment Certification Form (BOP-2201) required by the Commonwealth of Pennsylvania under Executive Order 2021-06, applicable to all contractors and grantees working on state contracts, including the Department of Environmental Protection's procurement for a 2027 Tracker 1860cc boat with trailer and engine. The certification mandates that contractors comply with Pennsylvania's Unemployment Compensation Law, Workers' Compensation Law, and thirteen specific state labor and workforce safety laws, including provisions related to construction workplace misclassification, child labor, minimum wage, prevailing wage, equal pay, employment record inspection, healthcare overtime restrictions, and apprenticeship requirements. Contractors must certify compliance with all applicable laws and agree to report any changes in compliance status to the purchasing agency immediately.
Pennsylvania law establishes significant penalties for providing false certifications, including contract termination and three-year ineligibility to bid on future state contracts under 62 Pa.C.S. § 531. The certification is subject to the provisions and penalties of 18 Pa.C.S. § 4904 regarding unsworn falsification to authorities. A duly authorized official of the contractor or grantee must execute the form, providing their signature, printed name, title, and the contractor/grantee name. This certification requirement applies to all bids submitted for the DEP boat procurement through the eMarketplace website.
