About this file

Summary

This is a Worker Protection and Investment Certification Form (BOP 2201) issued by the Commonwealth of Pennsylvania in conjunction with an Invitation for Bids from the Department of Labor and Industry's State Workers' Insurance Fund (SWIF) for Field Based Medical Case Management Services. The procurement seeks qualified independent contractors to provide on-demand medical case management services throughout Pennsylvania, coordinating care for injured workers receiving workers' compensation benefits through qualified Registered Nurses. Contractors must provide labor, materials, services, skills, supervision, and necessary equipment to perform field-based case management in compliance with the Pennsylvania Workers' Compensation Act, Title 34 Pa. Code Sections 123.201-123.302, and applicable federal and state regulations including HIPAA privacy requirements. The Commonwealth will award contracts for an initial term not exceeding three years with two successive one-year renewal options at its sole discretion, though contract award does not guarantee work and services may only commence upon issuance of a Notice to Proceed by SWIF.

All contractors and grantees must certify compliance with Pennsylvania's Unemployment Compensation Law, Workers' Compensation Law, and applicable state labor and workforce safety laws, including the Construction Workplace Misclassification Act, Employment of Minors Child Labor Act, Minimum Wage Act, Prevailing Wage Act, Equal Pay Law, and eleven additional specified statutes. Contractors must complete and sign the certification form confirming authorized status and compliance, with understanding that false certifications subject them to contract termination, three-year debarment from bidding on Commonwealth contracts under 62 Pa. C.S. § 531, and criminal penalties under 18 Pa. C.S. § 4904 for unsworn falsification to authorities. Contractors must also report any changes in compliance status to the Purchasing Agency immediately.
