About this file

This is a Worker Protection and Investment Certification Form (BOP 2201) issued by the Commonwealth of Pennsylvania, specifically related to a Low-Income Tax Clinic Central contract opportunity administered by the Pennsylvania Department of Revenue. The form establishes compliance requirements for all contractors and grantees entering into agreements with the Commonwealth. Contractors must certify compliance with Pennsylvania's Unemployment Compensation Law, Workers' Compensation Law, and applicable state labor and workforce safety laws, including provisions covering workplace misclassification, child labor, minimum wage, prevailing wage, equal pay, employment medical examination fees, seasonal farm labor, wage payment collection, industrial homework, construction industry employee verification, healthcare overtime limits, apprenticeship and training, and employment records inspection. The certification must be executed by an officially authorized representative of the contracting organization and submitted as a required contractual document.

The Commonwealth of Pennsylvania imposes significant penalties for false certifications, including contract termination and three-year debarment from bidding on future state contracts under 62 Pa.C.S. § 531. Contractors are required to report any changes in their compliance status to the Purchasing Agency immediately upon occurrence. False certifications are subject to criminal penalties under 18 Pa.C.S. § 4904 for unsworn falsification to authorities. This certification requirement applies to the Low-Income Tax Clinic contract, which involves providing pro bono tax services to low-income Pennsylvania taxpayers, requiring the selected vendor to demonstrate expertise in Pennsylvania state tax law and dispute resolution while maintaining full compliance with all applicable labor protection and investment standards throughout the contract term.
