AMENDMENT 3
The purpose of this amendment is as follows:
Extend the response date to Thursday, 9/15/2016 by 10:00 AM CT.
Provide responses to questions submitted from interested vendors.
Provide notice that no further questions will be accepted for this solicitation. Any questions received after the posting of this amendment will not be responded to. Even if provided in other form, only the question responses included in amendments to this solicitation will govern performance of the resulting contract.
Interested vendors who submit a quote package in response to this solicitation shall state that they have read and understand Amendment 1, Amendment 2, and Amendment 3.
All other terms and conditions remain unchanged.
1) Question from interested vendor: Thank you for removing FAR clause 52.245-1 GOVERNMENT
PROPERTY. FAR clause 52.245-9 USE AND CHARGES is only applicable in the presence of 52.245-1;
therefore, could this clause please be removed?
Government's response: The referenced FAR clause 52.245-1 was removed in Amendment 2 of this
RFQ. Therefore, 52.245-9 is no longer applicable, and is hereby removed from this RFQ.
2) Question from interested vendor: Referencing FAR clause 52.223-2 AFFIRMATIVE PROCUREMENT
OF BIOBASED PRODUCTS UNDER SERVICE AND CONSTRUCTION CONTRACTS, this clause is only applicable to service and construction Contracts; therefore, could this clause please be removed?
Government's response: The contract resulting from this RFQ will not be a service or construction contract. Therefore, FAR clause 52.223-2 is hereby removed from this RFQ.
3) Question from interested vendor: Referencing CAR clause 1352.215-73 EVALUATION QUANTITIES-
INDEFINITE QUANTITY CONTRACT, we believe that the quantities are definite because the Contract contains orderable CLINs; therefore, could this clause please be removed?
Government's response: CAR clause 1352.215-73 will not be removed from this RFQ. As stated in the RFQ, the Government reserves the right to order “up to” a stated quantity. Therefore, there is no guarantee the maximum quantity will be ordered. Thus, NOAA has determined that the quantity is indefinite.
4) Question from interested vendor: Referencing CAR clause 1352.228-72 DEDUCTIBLES UNDER
REQUIRED INSURANCE COVERAGE- FIXED PRICE, this clause is only applicable in the presence of clause 1352.228–70 INSURANCE COVERAGE which is not included in the Terms and Conditions;
therefore, could this clause please be removed?
Government's response: The “Insurance against Loss or Damage to Government Property” section from the SOW was removed in Amendment 2 of this RFQ. Therefore, CAR clause 1352.228-70 was no longer applicable, and was removed from this RFQ. Since CAR clause 1352.228-70 was removed, CAR clause 1352.228-72 is no longer applicable, and is hereby removed from this RFQ.
5) Question from interested vendor: Referencing FAR clause 52.217-8 OPTION TO EXTEND SERVICES, this clause is only applicable to service Contracts and service is not the primary purpose of the subject Contract; therefore, could this clause please be removed?
Government's response: The contract resulting from this RFQ will not be a service contract.
Therefore, FAR clause 52.217-8 is hereby removed from this RFQ.
6) Question from interested vendor: Referencing FAR clause 52.222-49 SERVICE CONTRACT LABOR
STANDARDS-- PLACE OF PERFORMANCE UNKNOWN, this clause is only applicable to service
Contracts and service is not the primary purpose of the subject Contract. Also, the location of where the work will be performed is known; therefore, could this clause please be removed?
Government's response: The contract resulting from this RFQ will not be a service contract.
Therefore, FAR clause 52.217-8 is hereby removed from this RFQ.
7) Question from interested vendor: Referencing CAR clause 1352.270-70 PERIOD OF PERFORMANCE, our interpretation of this Contract is that the CLINs are orderable, and not options; therefore, could this clause please be removed?
Government's response: The contract resulting from this RFQ will be for 3+ years period of performance (date of award through 9/30/2019). There are no option periods. Line Items 0001, 0002, 0003, and 0004 are available to the Government if and when the Government orders any LF
Radome/Radomes during each respective ordering period. CAR clause 1352.270-70 will not be removed from this RFQ.
8) Question from interested vendor: Referencing section titled NOTICE OF POST-GOVERNMENT
EMPLOYMENT RESTRICTIONS, if this is a section H clause please provide the clause number.
Government's response: “NOTICE OF POST GOVERNMENT EMPLOYMENT RESTRICTIONS” is a term and condition required by NOAA, and is referenced as section 43 in the RFQ. There is no associated clause number. This solicitation is not using the Uniform Contract Format (UCF), so there is no section H.
9) Question from interested vendor: Reference the Certification section within the Statement of Work.
This section states “The contractor must certify and demonstrate that each LF radome meets the
OEM specifications and requirements”. However, the method and criteria for providing certification and demonstration is not provided. Please clarify the certification and demonstration requirements that are being requested.
Government's response: The contractor may self-certify for purposes of evaluation, and should provide any and all evidence that they feel best demonstrates the LF radome offered meets or is equivalent to the OEM specifications and requirements.
10) Question from interested vendor: Reference the Submittal of Invoices section within the Statement of Work. This section appears to reference itself within the paragraph. The “Submittal of Invoices” clause referred to within this section is not included in the Terms and Conditions. Please clarify.
Government's response: The invoice process described under the “Submittal of Invoices” section from the SOW is correct. However, the last sentence [See also “Submittal of Invoices” clause.] was inadvertently added. No “Submittal of Invoices” clause was added to this RFQ. Therefore, the language [See also “Submittal of Invoices” clause.] is hereby removed from this RFQ. Please note that FAR clause 52.212-4, specifically section (g), provides for invoice content requirements.
