About this file
This is a Wage Theft Prevention certification form (CM-16) established by the City of Boston for vendors bidding on city contracts. The form requires vendors to certify compliance with the Executive Order "Establishing Requirements for City Contracts in an Effort to Prevent Wage Theft." Vendors must check box 1 or box 2 as applicable and sign the form, which must be submitted with their bid or proposal. For multi-year contracts, the form must be completed annually on each contract anniversary. The City requires all vendors to post the Massachusetts Wage and Hour Laws notice informing employees of their protections under this executive order.
Vendors must certify that they have not received any federal or state criminal or civil judgment, administrative citation, determination, order, or debarment resulting from violations of wage and hour laws within a specified three-year period. Vendors who have disclosed such violations may be required to obtain a wage bond or other suitable insurance equal to one year's aggregate gross wages for all employees on the contract. Any vendor subject to state or federal debarment for violation of wage laws is prohibited from contracting with the City, and violation of this prohibition may result in contract termination. The form was approved as to form by Corporation Counsel in April 2025 and applies to the related contract for installation of electrical heaters at 200 Frontage Road in Massachusetts.
