STATEMENT OF WORK

Overview: Install chain‐link fencing in accordance with applicable regulations and guidelines to provide a secure perimeter around the upper tactical sites. Fencing will tie into existing fence lines on each end and contain one (1) personnel entry/exit gate with pin‐code locks, two (2) personnel exit‐only gates with pin‐code lock, one (1) sliding vehicle access gate, and one (1) double gate swing vehicle access gate. Refer to drawings SK‐2 thru SK7 for layout and details.

Materials:

The materials shall conform to specifications, applicable industry codes and standards and the manufacturer’s recommendations, whichever is more stringent. Certificates of compliance and Technical Data Sheets are required for all materials supplied. A list of all chemicals to be used shall be provided prior to the start of work. The list shall state the commercial name, manufacturer’s name, chemical name, and quantity to be used or stored on government property (see Attachment 1, 2).

Details:

Fencing: Consists of approximately 550 foot run (including all access gates) connecting the existing inner fence line on the east side of the facility to the existing inner fence line on the west side of the facility. Wire needs to be 8 feet high constructed of 2 inch galvanized mesh. Entire fence line needs to be topped with minimum 7 gauge tension wire and 3 strands of barbed wire. All pipe needs to be galvanized schedule‐40. Line and terminal posts need to be at least 3 inch with slide gate posts at least 4 inch. The fence is to be installed on low shrub, gravel, and paved surfaces. The fence should be located as shown on SK‐2 and SK‐3. Approximately 200 feet of fencing is to be installed on a 25% grade. The fence needs to be 30 feet away from any raised item or building.

Personnel Entry/Exit Gate: Consists of one (1) four foot wide walk through gate with Locknetics® CMseries compatible lock(s) to allow controlled entry and exit. This gate is to be located on the south side of building

20 at the stairwell exit. A post with light will need to be installed and wired at this location.

Personnel Exit Only Gates: Consists of two (2) four foot wide walk through gates each with a Locknetics®

CM‐series compatible lock to allow exit only from the controlled area. One gate is to be located on the east side of the facility near the existing vehicle access gate. The second gate will be located on the west side of the facility adjacent to the new double gate swing.

Sliding Vehicle Access Gate: This gate consists of one (1) manual opening sliding gate to close an approximately 21 foot wide opening, Contractor responsible for field verification. This gate will be located at edge of the parking lot on the west side of building 20 where it meets the gravel of the tactical site. This gate will normally be chained and locked closed.

Double‐Swing Vehicle Access Gate: This gate consists of two (2) swinging gates that when closed will meet in the center of the existing road on the west side of building 20, just south‐west of the parking lot. This is a manually opening gate that will normally be chained and locked closed.

Existing Utilities: The area contains underground electrical and communication wiring. Contractor is responsible for contacting CALL BEFORE YOU DIG prior to any work.

Submittals: The Contractor shall submit shop drawings (3 sets minimum) of all material to be purchased and installed for this project for approval prior to any construction.

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour

Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the

Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)

and 3.) should be followed.

With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the

Branch of Construction Wage Determinations. Write to:

Branch of Construction Wage Determinations

Wage and Hour Division

U.S. Department of Labor

200 Constitution Avenue, N.W.

2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator

(See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:

Wage and Hour Administrator

The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.

3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative

52.219-28 POST-AWARD SMALL BUSINESS PROGRAM REREPRESENTATION (APR 2009)

(a) Definitions. As used in this clause--

Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority.

Small business concern means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (c) of this clause. Such a concern is ``not dominant in its field of operation'' when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity.

(b) If the Contractor represented that it was a small business concern prior to award of this contract, the Contractor shall rerepresent its size status according to paragraph (e) of this clause or, if applicable, paragraph (g) of this clause, upon the occurrence of any of the following:

(1) Within 30 days after execution of a novation agreement or within 30 days after modification of the contract to include this clause, if the novation agreement was executed prior to inclusion of this clause in the contract.

(2) Within 30 days after a merger or acquisition that does not require a novation or within 30 days after modification of the contract to include this clause, if the merger or acquisition occurred prior to inclusion of this clause in the contract.

(3) For long-term contracts--

(i) Within 60 to 120 days prior to the end of the fifth year of the contract; and

(ii) Within 60 to 120 days prior to the date specified in the contract for exercising any option thereafter.

(c) The Contractor shall rerepresent its size status in accordance with the size standard in effect at the time of this rerepresentation that corresponds to the North American Industry Classification System (NAICS) code assigned to this contract. The small business size standard corresponding to this NAICS code can be found at http://www.sba.gov/services/contractingopportunities/sizestandardstopics/.

(d) The small business size standard for a Contractor providing a product which it does not manufacture itself, for a contract other than a construction or service contract, is 500 employees.

(e) Except as provided in paragraph (g) of this clause, the Contractor shall make the rerepresentation required by paragraph (b) of this clause by validating or updating all its representations in the Online Representations and Certifications Application and its data in the Central Contractor Registration, as necessary, to ensure that they reflect the Contractor's current status. The Contractor shall notify the contracting office in writing within the timeframes specified in paragraph (b) of this clause that the data have been validated or updated, and provide the date of the validation or update.

(f) If the Contractor represented that it was other than a small business concern prior to award of this contract, the Contractor may, but is not required to, take the actions required by paragraphs (e) or (g) of this clause.

(g) If the Contractor does not have representations and certifications in ORCA, or does not have a representation in ORCA for the NAICS code applicable to this contract, the Contractor is required to complete the following rerepresentation and submit it to the contracting office, along with the contract number and the date on which the rerepresentation was completed:

The Contractor represents that it ( ) is, ( ) is not a small business concern under NAICS Code 332618- assigned to contract/solicitation number W91ZRS-09-T-0017.
