QUESTIONS AND ANSWERS
GTMO Intel-FOIA Support Questions & Answers
Solicitation W91QEX-19-R-0007
1. Is it a new opportunity? If not, please let us know the name of incumbent, contract number and if incumbent can recompete.
ANSWER: This is a new opportunity. The current task are consolidated on Task Order, W91QEX-14-F-1B23, being performed by Vertiss, LLC. The follow on task will be procured on a stand-a-lone contract.
2. Attachment 2 – Surge Pricing Sheet: Please clarify if the contractor needs to provide all 5 labor categories on the full time basis or on hourly basis as and when required by the government.
ANSWER: As indicated on the Surge Pricing Sheet, hourly rates shall be provided accordingly. Please see updated Surge Pricing Sheet.
3. RFP Reference p. 1; SF1449, Section 10 – Question: This solicitation is using NAICS code 541611 - Administrative Management and General Management Consulting Services, with a size standard of $15M. Given the nature of the work required under this solicitation, specifically Intelligence Analysis and Freedom of Information Act Support, and the associated labor categories of Senior Intelligence Analyst and Chief FOIA Analyst, would the government consider using NAICS 561611 Investigation Services, which is a code often associated with activities similar to those required under this PWS. The use of the 561611 code may more accurately align with the work being performed on this contract and has the added benefit of a $20.5M size standard that may increase competition.
ANSWER: The solicitation will remain to utilize NAICS code 541611
4. RFP Reference p. 99-100; Section L, Subfactor 1-Contractor Experience – Question:
The note for this section precludes the use of teaming partner or subcontractor past performance due to “affiliation rules that pertain to the Ostensible Subcontracting Rules”. SBA rules on ostensible subcontracting ensure that the small business prime contractor is not unduly reliant on its subcontractor and that the prime contractor and not the subcontractor is performing the primary and vital work of the contract. SBA’s ostensible subcontractor rule and OHA’s applicable decision in Size Appeal of Charitar Reality, SBA No. SIZ-5806 (2017) provides that violation of the ostensible subcontractor rule is more likely to be found if the proposed subcontractor will perform 40% or more of the contract. If the workshare percentage of the subcontractor is 40% or less of the contract, will the government consider the use of applicable past performance from a teaming partner or subcontractor?
ANSWER: Subcontracting consideration is not applicable for this requirement however as stated in the solicitation if the prime and teaming partner or subcontractor use their experience combined as part of their proposal submittal for both of their Technical Experience and Past Performance an approved SBA joint venture and/or mentor-protegee needs to be in place and approved by SBA.
5. RFP Reference p. 99-100; Section L, Subfactor 1-Contractor Experience – Question:
This section requires that the proposed corporate experience projects be similar in size and scope to the requirement of the PWS in support of the US Department of Defense.
The services required under this solicitation are not specific to the DoD and in fact both the intelligence community and law enforcement require intelligence analyst support.
Additionally, all Federal operations are subject to FOIA requests and may require similar support. Given the ubiquity of applicable intelligence analysis and FOIA support contracts within federal contracting operations outside the DoD, will the Government consider contractor experience that is similar in size and scope to this PWS, but that was performed in support of a federal agency besides the DoD, which may serve to increase competition on this solicitation?
ANSWER: The Government will only consider contractor experience that is similar in size and scope to the Department of Defense as identified in the solicitation.
6. RFP reference p. 109; Section Section I Contract Clauses 252.225-7048 Export-
Controlled Items – Question: Based on the solicitation and the inclusion of 252.225- 7048, what – if any – services provided by the contractor under this effort are subject to compliance requirements described in the Export Administration Regulations (EAR), International Traffic in Arms Regulations (ITAR), or Office of Foreign Assets Control (OFAC) regulations? Will these services require any export licenses or Electronic Export Information (EEI) filings?
ANSWER: This clause was removed from the solicitation as these services will not require any export licenses or Electronic Export Information (EEI) filings.
7. RFP Reference p. 1; SF1449, Section 8 – Question: The offer due date on the SF1449 is 03 August 2019 which is a Saturday. Will the Government consider extending the proposal due date to Monday 05 August 2019?
ANSWER: The offer due date has been changed to 05 August 2019, by 10:00AM (EST)
8. RFP Reference p. 69; Section H-Special Contact Requirements, Wage Rates – Question: Per Section H - Special Contract Requirements, Wage Rates, the solicitation references a different RFP (# W91QEX-19-R-0005). In addition, we would ask the government to consider the removal of this wage rates determination as these rates would prohibit the best employees to meet the requested expertise and clearance levels in some positions.
ANSWER: The wage rate will remain with this acquisition.
9. RFP Reference p. 46; Part 3-Government Furnished Items and Services – Question: In Part 3, Section 3.6, the Government indicates that DOD Contractor employees assigned to operate either Government owned or leased equipment in performance of this contract shall be certified, by the contractor and at the contractor' expense. Can the
Government clarify what type of vehicles Contractor employees would be assigned to operate?
ANSWER: Vehicles are not required in support of the Intel/FOIA contract. The Government will not provide on island transportation for this contract. Paragraph 3.4,
3.5 and 3.6 of the PWS have been updated accordingly.
10. RFP Reference Attachment 2 – Surge Pricing Sheet – Question: Attachment 2 – Surge Pricing sheet has the correct solicitation Title (GTMO Intelligence / FOIA Surge Pricing Sheet), but the solicitation number is incorrect. Will the Government please revise the Attachment 2 document to reflect the correct solicitation number?
ANSWER: Attachment 2, Surge Pricing Sheet, is revised to reflect the correct solicitation number, W91QEX-19-R-0007.
11. RFP Reference Attachment 2 – Surge Pricing Sheet – Question: The “Base Period” of 9 months contradicts section 1.5 Period of Performance in the RFP (which states one base year of 8 months). Will the Government please clarify which is the correct base year to use for pricing and proposal purposes?
ANSWER: Section 1. 5 (Period of Performance) of the Performance Work Statement, has been updated accordingly to reflect one (1) base year of 9 months.
12. Volume 1/Factor 1 Technical Sub-Factor 1 Contractor Experience. a. Recency – To be considered recent, the contract reference must have been awarded within the last five
(5) years.
Volume 2/Factor 2 Past Performance. i. Recency & Relevancy- A recent contract reference will be considered an active the last five (5) years at the time of proposal submission.
Confirming that the Government intends to consider Contractor Experience and Past Performance for contracts that were active within the last five years (and not awarded within the last 5 years). Many small businesses may have relevant contracts that were recently active (within the last 5 years), but not awarded within the last 5 years. This is unnecessarily restrictive in that it limits ability for small businesses to bid despite having recent contracts that meet the relevancy requirements ($10Mil).
ANSWER: After further consideration, the Government has revised “Recency” to be awarded within the last five (5) years to seven (7) years for Contractor Experience.
In addition, in reference to Past Performance a recent contract reference will be considered an active contract within the last seven (7) years at the time of proposal submission.
13. Performance Work Statement 1.6.5 Place of Performance - The work to be performed under this contract will be performed at JTF- GTMO, Guantanamo Bay, Cuba and at SOUTHCOM HQ, 9301 NW 33rd Street, FL 33172, as required by the government.
Request confirmation that all positions being bid for this contract are currently located at GTMO. While we understand that the existing contract maintains positions at SOUTHCOM HQ, the provided CLINs and Surge Pricing Attachment do not identify any proposed positions specifically at SOUTHCOM HQ. If some portion of the work will be primarily executed from HQ USSOUTHCOM, please provide the number and corresponding to support accurate labor pricing.
ANSWER: The Government currently utilizes two FTE’s at SOUTHCOM HQ. From a historical perspective, one (1) Intelligence Analyst II and one (1) Intelligence Analyst III have performed services at SOUTHCOM HQ.
14. Additional Instructions and Information. 1.(a) Proposals submitted electronically via e-mail shall be prepared Microsoft application programs. While prepared in Microsoft application programs, will the Government permit submission of proposals in pdf format?
ANSWER: The Government will accept documents created in Microsoft applications converted to Adobe PDF.
15. ii. Sub-factor 2 – Staffing Plan & Resumes. 1. Key Personnel (Resumes). c. Senior FOIA Analyst II: The resumes shall demonstrate that the proposed FOIA Analyst III possesses the minimum… Please confirm that these key individual is FOIA Analyst II and not FOIA Analyst III.
ANSWER: Please note Chief FOIA Support and Lead Intelligence Analyst labor categories have been added to the solicitation.
Please note the following CLINS for Chief FOIA Support: CLINS 0005, 1004, 2004, 3004, and 4004.
Please note the following CLINS for Lead Intelligence Analyst: CLINS 0002, 1001, 2001, 3001, and 4001. Chief FOIA Support and Lead Intelliegence Analyst are identified as Key Personnel in accordance with paragprah 1.6.10 of the PWS.
16. Evaluation Factors: Sub-Factor 2: Staffing Plan & Resumes. a. Organizational Chart:
the Offeror shall submit an organizational chart detailing…..of the Offeror with applicable job titles and number of years’ of experience working under such job titles.
Request clarification on requirement to provide job titles and number of years of experience working under such titles. Does this requirement apply to key personnel or corporate management personnel? If this applies to key personnel, request that this data can be provided as part of summary of key personnel and/or resumes.
ANSWER: The organizational chart will not be evaluated under this Staffing Plan and Resumes. As a result, this verbiage has been removed.
17. The CLIN structure and Attachment 2 – Surge Pricing Sheet identify an Administrative Specialist III LCAT. Neither Section 5. Specific Tasks nor Technical Exhibit C –
Estimated Workload Data reference an Administrative Specialist III LCAT. Please confirm the intended inclusion or removal of the Administrative Specialist III LCAT.
ANSWER: The Government has CANCELLED the Administrative Specialist III labor category as this will not be part of this requirement. As a result, this CLIN shall be cancelled from this solicitation. In addition, this labor category was removed from Attachment 2 – Surge Pricing Sheet.
18. Volume I | Factor I-Technical: Sub-Factor 1- Contractor Experience (b) Experience, Page 138 of 145. The contractor reference must hold a minimum aggregate cumulative dollar value (includes base and option period values at time of contract award) of $10,000,000.00. A relevant contract reference can be a competitive or non-competitive single contract, purchase order, or a standalone task order.
QUESTION: Once the Offeror submits and meets the required minimum one (1) contract reference for Volume I and Volume II which the Offeror holds a minimum aggregate cumulative dollar value and scope (including base and option period values at time of contract award) of $10,000,000.00 and satisfies the requirement in both Volume I and Volume II, will the Government consider additional complete relevant contract experiences references in Volume I with complete contract references , which may not have a cumulative dollar value of $10,000,000.00 but is relevant in scope and not included in Volume II?
ANSWER: Please see answer #12
19. Are key personnel, e.g., PM, senior personnel offered individual housing given their unique responsibilities involving leadership and management over the larger workforce?
ANSWER: The Government will make every effort to provide individual housing for key personnel. Due to the limited availability of housing on NAVSTA GTMO, the Government cannot guarantee that individual housing requests can be met. Civilian hires have an estimated wait time up to 18 months for available housing units for family members.
20. Can the USG provide specific on/off island logistics details regarding the contractor’s personnel?
ANSWER: The Government is not clear on what is being asked since this is a broad question.
21. Page Limitations and Format, Page 136 of 145. What are the required page border margins for the layout?
ANSWER: There are no specific required page border margins for the layout as long as contractors stay within the guidelines identified in the solicitation.
22. Will interested vendors be granted a site visit to evaluate and assess the work site, lodging, and logistic of the location?
ANSWER: Site visits will be not be conducted.
23. Can the contracting company be granted routine and regularly scheduled visits to assess and evaluate the performance of the contract personnel and the customer service relationship with Government COR/CO?
ANSWER: Yes, the proposed contract awardee will have granted full access for regularly scheduled visits to assess and evaluate the performance of the contract personnel and the customer service relationship with Government Contracting Officer Representative.
24. Can the contract company schedule and sponsor holiday socials and gatherings to improve the morale of the contract personnel to help sustain and keep personnel on contract site for the life of the contract?
ANSWER: This is subject to the contract company policies in coordination with U.S.
Government Program Office.
25. Can the Government provide more details regarding the lodging arrangements, and furniture being utilized to house contract personnel at GTMO?
ANSWER: Lodging is coordinated by NAVSTA GTMO at fair market rental prices.
All furniture is to be provided by contractor or contractor personnel. The Government is not responsible for coordinating furniture or lodging. Lodging and utilities costs will be reimbursed under the ODC CLIN. The primary type of available housing is shared unaccompanied (no family members). The availability for temporary housing - while a contractor is awaiting family housing - is currently at capacity. We are awaiting NAVSTA housing officials to confirm for each person that temp housing has a vacancy, just so we can bring the sponsor (contractor or civilian) on-island. Meanwhile, the family waits in CONUS for up to 18 months until family housing is available, while the sponsor waits alone in temp quarters.
26. Can the Government explain the cost of housing that the contractor must pay to provide lodging for each contract personnel?
ANSWER: The Government is not responsible for coordinating furniture or lodging.
Lodging and utilities costs will be reimbursed under the ODC CLIN.
27. Can the Government explain the commercial transportation available for the Contract Company and personnel in transit for the purpose of Rest and Recreation back and forth to CONUS?
ANSWER: At this time, no commercial transportation services NAVSTA GTMO. All transportation is provided by the Government contracted rotator.
28. In order to sustain personnel for life of the contract, will the Government consider an annual Government paid transportation stateside and return for each contractor?
ANSWER: No, this cost is subject to the contract company.
29. What are the historical and unique challenges with support to GTMO other than limited transportation on and off the location?
ANSWER: The Government is not clear on what is being asked since this is a broad question.
30. What are the unique issues associated with the ability to provide health care other than what is provided in the PWS?
ANSWER: Please refer to PWS sections 1.6.21.6 to 1.6.21.7.1. Also, medical care on JTF-GTMO is primarily resourced for treatment of non-life threatening acute conditions experienced by a generally young and healthy population. A variety of serious or life-threatening conditions, or acute exacerbations of certain chronic conditions, require medical evacuation from the island.
31. Are there any medical support conditions or circumstances that would prohibit some personnel from working at this location, other than what is provided in the PWS?
ANSWER: Please refer to PWS sections 1.6.21.6 to 1.6.21.7.1. Also, see answer to question 27. QUESTION: The referenced requirement stated above seems to create an unfair competitive advantage that ONLY the incumbent or an incumbent Joint Venture can meet. This unfair advantage may create the potential for both pre and post award protests. Will the government consider changing the requirement to allow fair and reasonable competition?
ANSWER: The Government stands firm on the existing requirement as this requirement have been competitive bidded previously from other contract companies.
37. Reference: Pg. 100/ Sub-Factor 1 – Contractor Experience - “The contract reference must hold a minimum aggregate cumulative dollar value (includes base and option period values at time of contract award) of $10,000,000.00. A relevant contract reference can be a competitive or noncompetitive single contract, purchase order, or a standalone task order.”
ANSWER: After further evaluation to increase competition, the Government will reduce the requirement for similar, size, and scope from an aggregate cumulative dollar value of at least $10,000,000 to at least $7,000,000.
38. Reference: Pg. 100/ Sub-Factor 1 – Contractor Experience - “NOTE: The Prime and Teaming Partner or subcontractor may NOT use their experience combined as part of their proposal submittal both for their Technical Experience and Past Performance Proposal submission. Each prime contractor’s experiences should be evaluated solely in determining if an Offeror is technically acceptable. Unless there is an approved SBA joint venture and/or mentor-protégée in place, evaluation of prime and subcontractor technical competency cannot be combined due to affiliation rules that pertain to the Ostensible Subcontracting Rules.”
QUESTION: The referenced NOTE stated above further supports an unfair incumbent competitive advantage that ONLY the incumbent or an incumbent Joint Venture can meet. This unfair advantage may create the potential for both pre and post award protests. Will the government consider changing the requirement to allow fair and reasonable competition?
ANSWER: Subcontracting consideration is not applicable for this requirement however as stated in the solicitation if the prime and teaming partner or subcontractor use their experience combined as part of their proposal submittal for both of their Technical Experience and Past Performance an approved SBA joint venture and/or mentor-protegee needs to be in place and approved by SBA.
39. 42. 4.5- Leased Vehicles- Who is the provider of lease vehicles in Guantanamo Bay and does the government provide assistance in securing lease vehicles?
ANSWER: Vehicles are not required in support of the Intel/FOIA contract. The Government will not provide on island transportation for this contract. If the contractor would like to provide vehicles for their staff, they can rent vehicles from the NEX at NAVSTA GTMO or ship POVs to NAVSTA GTMO per section 4.7.2 of the PWS.
43. Page 100, sub-sections a & b, the definitions of recency appears unnecessarily restrictive, is it the government’s intention to evaluate work executed in the past 5 years or work awarded in the past 5 years. Due to long protests common in DoD and IC related contracts work is often “awarded” then does not commence for 12 to 18 months while the government mitigates or defeats protest. May the contractor submit work valued in aggregate of 10,000,000 for work done in the past 5 years inclusively, regardless of date of actual contract award?
ANSWER: Please see answer #37
44. Page 100 , Size and Scope definition. May the contractor submit 1 reference for intelligence work and a separate reference for FOIA support services? Not every agency chooses to consolidate these two functions, in fact some intentionally segregate
it. As written the requirement would appear unduly restrictive to the incumbent on this contract or those performing at one of 2 sister DoD agencies. For example the National Geospatial Intelligence Agency and Defense Intelligence Agency both service FOIA requests under different contract vehicles from other intelligence work, as does CIA (admittedly not a DoD agency). Asking for them to be on the same contract vehicle for the purpose of evaluating “scope” would seem to excessively limit the field based on an arbitrary delineation of contract vehicle.
ANSWER: The Government remains firm on the existing requirements as these services have been in existence dating back to 2011.
