General Information

Part 1

GENERAL INFORMATION

1. GENERAL: This is a performance based non-personal services contract under which the personnel rendering the services are not subject, either by the contract’s terms or by the manner of its administration, to the supervision and control usually prevailing in relationships between the Government and its employees. The Contractor shall ensure that all contractor employees and subcontractor employees are medically, dentally, and psychologically fit for performance of their duties.

1.1 Description of Services/Introduction: The Contractor shall be required to provide support and surge personnel who have demonstrated area of responsibility (AOR) experience working within the expansive and multi-national geographic area of the Caribbean Basin, Central America, and South America. Acceptable AOR experience shall be within any of the following command levels: Headquarters USSOCOM (HQ USSOCOM), USSOCOM Sub-unified Commands, U.S. Army Special Operations Command (USASOC), Naval Special Warfare Command (NSWC), Air Force Special Operations Command (AFSOC), Marine Corps Special Operations Command (MARSOC), and all Component sub commands to include U.S. Southern Command (USSOUTHCOM) and Special Operations Command South (SOCSOUTH).

The Contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform Operations Directorate (J3) Support Services as defined in this Performance Work Statement (PWS) except for those items specified as government furnished property (GFP) and government furnished services (GFS). The contractor shall perform to the standards in this contract.

1.2 Background: SOCSOUTH is a sub-unified command of USSOUTHCOM, and the theater functional component for special operations. It is responsible for all Special Operations Forces (SOF) in the theater to include Civil Affairs and Psychological Operations forces. SOCSOUTH is composed of a joint headquarters, three permanently assigned operational units, and CONUS-based deployed SOF. The command manages over 200 SOF deployments per year with an average of 42 missions in 26 countries at any time. The SOCSOUTH mission is to plan, prepare for, and, when directed, conduct special operations in support of USSOUTHCOM strategies, plans and operations.

SOCSOUTH requires certain highly specialized technical and operational related functions for the Current Operations Division (J33), Joint Readiness and Training Division (JTREX), and the Command Center Operations to provide advanced professional, technical, and emergency management, comprehensive technology research, operational planning, readiness reporting, and continuity of critical operations activities.

To accomplish its missions, SOCSOUTH requires specialized personnel trained with a high degree of relevant and current knowledge and situational awareness of SOF activities as well as other human and geo-political issues affecting SOCSOUTH plans and activities. Planning, capabilities development support, analysis are also needed to accomplish the SOCSOUTH mission. Mission assurance activities include ensuring operational readiness through activities addressing the survivability of vulnerable personnel and mission-critical infrastructure.

1.3 Objectives: Operational objective of this contract requires certain highly specialized technical and operational related support of the Current Operations Division (J33), Future Operations Division (J35), Joint Readiness and Training Division (JTREX), and the Command Center Operations to provide advanced professional, technical, and emergency management, comprehensive technology research, operational planning, readiness reporting and continuity of critical operations activities. The SOCSOUTH mission requires contractor support that adapts and responds as needed to rapidly changing requirements. The Contractor may be required to deploy to Continental United States (CONUS) or Overseas (OCONUS) locations in support of U.S. national security objectives. The Contractor may be required to work additional or surge hours based on the needs of the Command. Typically these surge hours are in conjunction with military exercises or contingencies.

1.4 Scope: The contractor shall provide technical, operational, command control, and other non-personnel services, to include: Senior Contract Program Manager, Battlewatch Section Support Team, AT/FP Threat Support Analyst, SOCSOUTH DRRS Specialist, SOUTHCOM DRRS Team, Battlewatch Supervisor, Global Force Management team, Program Support Manager, Regional Fusion Cell Team. Support services shall be provided not only to US Special Operations entities but also other participating federal agencies.

1.5 Period of Performance: The period of performance shall be for one (1) Base Period of 9 months to include four

(4) 12 month options.

1.6 General Information:

1.6.1 Quality Control Plan (QCP) The Contractor shall develop, implement and maintain an effective quality control program (QCP) to ensure services are performed in accordance with this PWS and the associated standards as defined within the Performance Requirements Summary (PRS). The Contractor, not the Government, is responsible to develop and implement procedures to identify, prevent, and ensure non- recurrence of defective services. The Contractor’s QCP should assure that all work complies with the contract’s requirements. The contractor’s QCP is the means by which the contractor ensures all work complies with the requirements of the contract. The QCP identifies and corrects potential and actual problem areas throughout the entire scope of the contract. The Contractor shall provide an outline of their Quality Contract Plan (QCP) within 3 days after award. As a minimum, the Contractor shall develop quality control procedures that will include, but are not limited to the following: (1) An inspection system covering all the services stated in the PWS, which specifies areas to be inspected on both a scheduled or unscheduled basis and the individuals who will perform the inspections. (2) A method of identifying deficiencies in the quality of services performed before the level of performance is unacceptable. If the Contracting Officer has any objections or concerns with the plan, the Contracting Officer will provide in writing their objections and concerns for the Contractor to address. Once a program is acceptable to the Contracting Officer, the Contracting Officer will approve and accept the Contractor’s QCP in writing. After the acceptance, the Contractor must get written approval from the Contracting Officer before making any changes to the program. The Contractor’s QCP outline shall be submitted to the Contracting Officer Representative (COR) three (3) days after contract award.

The full plan will be due within 30 days after contract award.

1.6.1.1.1 Inspection Program: Included shall be a quality control inspection program covering all general and specific tasks included in the contract scope of work. It shall specify tasks or areas to be inspected on a scheduled or unscheduled basis, the manner in which inspections are to be conducted, the titles of the individuals who will perform the inspections, and the percentage of the work that will be inspected on a recurring basis. In developing this inspection program, the Contractor shall identify the key activities and associated characteristics in each process that have a significant influence on specific services and provide for methods for evaluation of the selected characteristics.

1.6.1.1.2 Deficiency Identification: The QCP shall include a method of identifying deficiencies in the quality of services performed before the level of performance becomes unacceptable as defined in the PRS. This shall contain processes for corrective action without dependence upon Government direction.

1.6.1.1.3 Deficiency Correction: The program shall contain process control and process performance measurement procedures that shall include how the Contractor shall implement preventive corrective actions. The Contractor shall demonstrate that it has designed quality into the delivery of services thereby mitigating the risk(s) associated with delivery of deficient or nonconforming services.

1.6.1.1.4 Documentation and Enforcement: The QCP shall include a method of documenting and enforcing quality control operations of both prime contractor and subcontractor work; including inspection and testing.

1.6.1.1.5 Trend Analysis: The QCP shall include a method of performing trend analysis and assessments through the use of metrics.

1.6.1.1.6 Surveillance Methods: The QCP shall contain specific surveillance techniques for all contract services.

The surveillance methods shall be comprehensive and adaptable to the reporting system of the plan.

1.6.2 Quality Assurance (QA): The government shall evaluate the contractor’s performance under this contract in accordance with (IAW) the Quality Assurance Surveillance Plan (QASP). This QASP is primarily focused on what the Government must do to ensure that the contractor has performed IAW the performance standards and contract quality requirements are met. Contract quality requirements means the technical requirements in the contract relating to the quality of the product or service and those contract clauses prescribing inspection, and other quality controls incumbent on the contractor, to ensure the product or service conforms to the contractual requirements. It defines how the performance standards will be applied, the frequency of surveillance, the minimum acceptable defect rate(s), and deductions, if applicable.

1.6.3 Recognized Holidays: The contractor is not required to perform services on official U.S. federal holidays listed below:

1.6.4 Hours of Operation: The contractor is responsible for conducting standard business between the hours of 0730-1700 Monday through Friday, except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. For other than firm fixed price contracts, the contractor will not be reimbursed when the government facility is closed for the above reasons. The Contractor must, at all times, maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons.

Hours may fluctuate depending on the mission. In addition to standard business hours, there may be a requirement for the contractor to work additional, surge hours as the mission dictates (i.e., during military exercises, crisis situations, contingencies.) Any surge hours must be approved in advance by the Contracting Officer Representative (COR). The Contractor must, at all times, maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons. Periods of absence should be reported to the Program Manager, who will then report absences to the COR.

1.6.5 Place of Performance: The work to be performed under this contract will primarily be performed at Headquarters SOCSOUTH, 29401 SW125th Ave. Bldg 600, Homestead Air Reserve Base (HARB), Homestead, Florida 33039-0001. SOUTHCOM DRRS Support Team will solely perform functions at Headquarters, US Southern Command, 9301 NW 33rd St, Doral, FL 33172.

1.6.6 Type of Contract: The government anticipates a contract award of a Firm Fixed price contract with a cost reimbursable CLIN for surge hours, travel, and government required training.

1.6.7 Access and General Protection Policy and Procedures:

1.6.7.1 Physical Security: The contractor shall be responsible for safeguarding all government equipment, information, and property provided for contractor use. At the close of each work period, government facilities, equipment, and materials shall be secured IAW Army Regulation (AR) 190-13, “The Army Physical Security Program.”

1.6.7.2 Personnel Security Clearance Requirements: Contractor personnel performing work under this contract must have an active personnel security clearance at the Secret or Interim Secret Clearance level in the Joint

Personnel Adjudication System (JPAS) at time of the proposal submission. Personnel possessing a Interim shall be able to obtain an Active Secret Clearance no later than 3 months from contract award. Furthermore, for positions requiring Top Secret the personnel shall possess a Secret or Interim Secret security clearance and be able to obtain the Top Secret level, within six (6) months upon hire. All personnel must maintain the level of security required for the life of the contract.

The security requirements are IAW with the attached DD Form 254, “Department of Defense (DOD) Security Classification Specification”. The Contractor shall ensure that contractor employees and sub-contractor employees performing services under this contract comply with FAR 52.204-2, Security Requirements when the employee has access to information classified “Confidential,” “Secret,” or “Top Secret.” The Contract will ensure the employee complies with the Security Agreement (DD Form 441), including the National Industrial Security Program Operating Manual (DOD 5220.22-M), and any revisions to DOD 5220.22-M, notice of which has been furnished to the Contractor.

1.6.7.3 The contractor shall follow DOD Federal Acquisition Regulation Supplement (DFARS) clause 252.223- 7004, Drug-free Work Force; and local USSOUTHCOM policies regarding drug testing. The contractor shall conduct drug tests, ensuring all secret cleared contractor employees are tested at least once per year, each year of the contract, as well as when there is a reasonable suspicion that an employee uses illegal drugs. The drug testing shall be at the contractor’s expense. Positive drug test results shall be made available to both the KO and COR within 24 hours of known test results. Records of drug testing shall be made available to the COR.

1.6.7.4 Background Checks: The Contractor shall ensure contractor employees and subcontractor employees performing services under this contract have passed a security check conducted by the Host Nation Police Department of their residence or the State Police Department of their U.S. residence. Security checks that have been completed as part of a personnel security clearance background investigation, or a previous background check that was a condition of employment, meet this requirement. Documentation of these checks will be made available to the KO or COR upon request. The Government retains the right to exclude any employee from performance of duties under this contract if a background security check reveals an employee is a security risk. The exclusion of an employee for security reasons will not relieve the Contractor from performance of services required under this contract. If the Government determines additional background checks are required, at a minimum, and upon request from the Government, the Contractor shall provide to the KO or COR, the following information on any contractor or subcontractor employee performing services under this contract:

1.6.7.4.1 Background Check Notification Requirements: If a background check on any employee or subcontractor employee performing services under this contract, whether the check was conducted as a condition of employment or as part of the contract with the Government, reveals any information from any source (including host country law enforcement) of criminal activity by Contractor employees, subcontractors, or subcontractor employees, the Contractor shall immediately:

(1) Traffic violations, other than parking, will be reported to the KO or COR only if the contract is for drivers for the Government.

(2) Notify the KO or COR of any suspicious activity by Contractor employees, subcontractors, or subcontractor employees the Contractor believes may pose a risk to U.S. or host nation national security or imminent risk of deadly bodily harm to any person;

(3) Any actions taken against Contractor employees, subcontractors, or subcontractor employees pursuant to this requirement.

1.6.7.4.2 Remedies: In addition to other remedies available to the Government, the Contractor’s failure to comply with the requirements of this paragraph my result in requiring the Contractor to remove a Contractor employee or employees from the performance of the contract.

1.6.7.4.3 Subcontracts: The Contractor shall include the substance of this paragraph and the preceding paragraph in all subcontracts.

1.6.7.5 Uncleared Contractor Common Access Card (CAC) Credentialing and Access Procedures

1.6.7.5.1 Contractor Common Access Card (CAC) Eligible Requirements: Before CAC issuance, the contractor employee requires, at a minimum, a favorably adjudicated National Agency Check with Inquiries (NACI) or an equivalent or higher investigation in accordance with Army Directive 2014-05. The contractor employee will be issued a CAC only if duties involve one of the following: (1) Both physical access to a DOD facility and access, via logon, to DOD networks on-site or remotely; (2) Remote access, via logon, to a DOD network using DOD-approved remote access procedures; or (3) Physical access to multiple DOD facilities or multiple non-DOD federally controlled facilities on behalf of the DOD on a recurring basis for a period of 6 months or more. At the discretion of the sponsoring activity, an initial CAC may be issued based on a favorable review of the FBI fingerprint check and a successfully scheduled NACI at the Office of Personnel Management.

1.6.7.5.2 Contractor Non CAC Eligible Requirements for DOD Facility and Installation Access: Contractor and all associated subcontractor employees shall comply with adjudication standards and procedures using the National Crime Information Center Interstate Identification Index (NCIC-III) and Terrorist Screening Database (TSDB) (Army Directive 2014-05/AR 190-13), applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative), or, at OCONUS locations, in accordance with status of forces agreements and other theater regulations.

1.6.7.6 Employment Eligibility: Contractor shall ensure that all contractor employees and sub-contractor employees performing services under this contract have been pre-screened for employment eligibility using the E-verify Program on the Department of Homeland Security website http://www.uscis.gov/e-verify. Personnel that have not met the employment eligibility requirement on this website are not authorized to perform services under this contract. Verification of the eligibility check will be made available to the KO or COR upon request. This requirement is not in lieu of and does not relieve the Contractor from the I-9 Employment Eligibility Verification Forms for employment of personnel.

1.6.7.7 Operations Security (OPSEC) Requirements: Contractor personnel shall adhere to facility security policies and restrictions. If applicable, government issued access badges shall not be worn outside designated facilities where visible to the general public. The Contractor shall immediately report suspicious activities to security personnel.

1.6.7.8 Key Control: The Contractor shall establish and implement methods of making sure all keys/key cards issued to the Contractor by the Government are not lost or misplaced and are not used by unauthorized persons. NOTE:

All references to keys include key cards. Contractor shall not duplicate keys provided by the Government. The Contractor shall develop procedures covering key control that shall be included in the Quality Control Plan. Such procedures shall include turn-in of any issued keys by personnel who no longer require access to locked areas.

1.6.7.8.1 The Contractor shall report any occurrences of lost or duplicate keys/key cards to the KO and the COR (and physical property manager, if applicable) within two (2) hours or the next business day if after hours and to request key or lock(s) replacement. This notification and request for key(s) and lock replacement shall be submitted in writing. The total cost of the replacement may be at the Contractor’s expense.

1.6.7.8.2. Only authorized Contractor personnel shall use Government issued key(s) and/or key card(s). Contractor personnel shall follow security access requirements when entering secure areas. Contractor shall receive appropriate security clearance approval to allow visitor(s) access in secure areas.

1.6.9 Post Award Conference/Contract Periodic Progress Meetings: The Contractor shall attend the post award conference convened by the contracting activity or contract administration office IAW Federal Acquisition Regulation (FAR) Subpart 42.5. The KO, COR, with other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings the KO will apprise the contractor of how the government views the contractor's performance and the contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues.

These meetings shall be at no additional cost to the government.

1.6.10 Contracting Officer Representative (COR): The (COR) will be identified by separate letter. The COR monitors all technical aspects of the contract and assists in contract administration. The COR is authorized to perform the following functions: ensure the Contractor performs the technical requirements of the contract; perform inspections necessary in connection with contract performance; maintain written and oral communications with the Contractor concerning technical aspects of the contract; issue written interpretations of technical requirements, including Government drawings, designs, specifications; monitor Contractor's performance and notifies both the KO and Contractor of any deficiencies; coordinate availability of government furnished property; and provide site entry of Contractor personnel. A letter of designation issued to the COR, a copy of which is sent to the Contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates, or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting order.

1.6.11.1 Key Personnel: The follow personnel are considered key personnel by the government: Senior Contract Program Manager (SCPM)/Alternate. The Contractor shall provide a SCPM who shall be responsible for the overall performance of the work. The name of this person and an alternate who shall act for the Contractor when the manager is absent shall be designated in writing to the Contracting Officer. The Contract Manager or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract. The SCPM or alternate shall be available on site during hours of normal operation Monday thru Friday, except Federal holidays or when the government facility is closed for administrative reasons. Qualifications for SCPM are:

minimum of 15 years SOCSOUTH and/or SOUTHCOM AOR experience, minimum of 5 years of military operational background at a Headquarters or TSOC level, minimum of 5 years of program management/contract execution experience, and must possess a BA/BS degree. No specific requirements for the alternate position. The contractor proposed management/staffing plan shall be submitted to the COR during the Evaluation Phase of the acquisitions process. Additionally, the contractor shall provide during the Evaluation Phase a sampling of proposed resumes for Key Personnel and identified positions within Section 1.6.12.

1.6.11.2 Special Qualifications or Certifications: All contractor personnel shall meet the education and certification standards as identified in para 1.6.12, Table 1. A copy of their Professional Certifications, degree, and/or transcripts shall be submitted to the COR during the Evaluation Phase of the acquisition process and be maintained for life of contract.

1.6.11.3 IA/IT Training Certification: All Contractor employees and subcontractor employees supporting IA/IT functions must be certified upon contract award as directed in DoD 8570.01-M, DFARS 252.239.7001, and AR 25-

2. Baseline certification as stipulated in DoD 8570.01-M must be completed upon contract award.

1.6.11.4 Position and Education Level Requirements/Qualifications: All Contractor employees must be able to proficiently read, write, and speak English and write in proper, formal English grammar and sentence structure, in order to complete the research and written assignments associated with this contract. The contractor shall provide personnel that meet at minimum Level 5 – “Advanced Proficient” based on the English Language Proficienct Assessment (ELPA) or equivalent testing measure.

Additionally, for personnel with additional Spanish language requirement, contractor employees must be able to proficiently read, write, and speak Spanigh and write in proper, formal Spanish grammar and sentence structure, in order to complete the research and written assignments associated with this contract. The contractor shall provide personnel that meet a Defense Language Profieciency Test (DLPT) minimum score of 2/2.

1.6.13 Identification of Contractor Employees: Contractor employees shall identify themselves as contractor personnel and shall avoid representing themselves as Government employees. This identification includes meeting attendance, answering Government telephones, email communications, and working in other situations where contractor status is not obvious. Contractor personnel identification shall be easily identifiable through the display of badges, name tags, lanyards, etc. Contractor personnel will be issued a USSOUTHCOM picture identification badge which shall be worn and visible at all times while in Government place of work only. All Contractor personnel shall comply with all applicable Federal, DOD, Command, and Unit security procedures, measures, requirements, regulations, and directives. Government issued identification remains the property of the Government and shall be returned to the issuing office or other designated Government personnel upon transfer of Contractor personnel from USSOUTHCOM.

1.6.14 Contractor Travel: The Contractor may be required to travel CONUS or OCONUS locations in support of U.S. national security objectives and other destinations worldwide. The Government will provide written notice of travel as soon as practicable, and identify specific objective(s) of the travel. The Contractor, in coordination with the Government, shall make necessary travel arrangements and be responsible for obtaining passports and visas for Contractor personnel. The Government will provide Contractor personnel with documentation indicating the Contractors' travel on behalf of the Government, and will obtain country clearances in accordance with established DOD and Department of State procedures. A trip/travel report will be submitted within 3 business days of the completion of the travel per the appropriate Performance Work Statement.

Contractor will be authorized travel expenses consistent with the substantive provisions of the Joint Travel Regulation (JTR) and the limitation of funds specified in this contract to provide support at a Government site or other site as may be specified, all travel shall be submitted to the COR, at a minimum two weeks prior to travel date.

Contractor will not be reimbursed for travel that was not approved prior to the commencement of travel by the COR and by the Contracting Officer (KO). The Government has historical performed 50 trips to support the agency requirements.

All costs for approved travel shall be reimbursed in accordance with FAR Subpart 31.205-46 Travel Costs. Costs incurred for lodging, meals and incidental expenses shall be considered to be reasonable and allowable only to the extent that they do not exceed on a daily basis the maximum per diem rates in effect at the time of travel in accordance with the applicable Travel Regulation. Travel costs shall not include overhead or profit. The contractor shall be responsible for making all necessary travel arrangements.

1.6.17. Non-Disclosure Requirements: Performance under this contract may require the Contractor and subcontractor to access data and information proprietary to a Government agency, another Government Contractor, or of such nature that its dissemination or use other than as specified in this work statement would be adverse to the interests of the Government or others. Neither the Contractor, nor Contractor personnel, shall divulge, nor release data or information developed, or obtained under performance of this work statement, except to authorize Government personnel or upon written approval of the KO. The Contractor shall not use, disclose, or reproduce proprietary data, which bears a restrictive legend, other than as specified in this PWS. All documentation showing individual names or other personal information shall apply, and shall be controlled and protected under the provisions of the Privacy Act of 1974, Public Law 93-579, 5 United States Code (U.S.C.) Section 552a.

1.6.17.1. Non-Disclosure Statements: The Contractor shall provide signed non-disclosure agreements to the Government prior to commencement of work under the contract. Disclosure of information by Contractor personnel may result in Contractor personnel removal from performance of duties under this contract.

1.6.17.2 Advertisement and Social Media: The Contractor shall NOT post information to public website or social media locations, personal or professional, that in any way disclose names, locations, hotel data, participants, discussions, pictures, etc. before, during or after the contract period of performance without the express consent of the Government. The use of propaganda violates DOD Commercial Use of Imagery Guidelines stated at (http://www.defenseimagery.mil/products/DODimagery/commercialuse.html). The Contractor shall not cite any information (e.g., contract information, pictures, locations, etc.) obtained through this contract on any marketing tools to include its company website.

1.6.17.3 At no time will the Contractor or associated sub-contractor employees transmit government documents or information using methods that do not meet the security requirements specified in the National Institute of Standards and Technology (NIST) Special Publication (SP) 800-171, "Protecting Controlled Unclassified Information in Nonfederal Information Systems and Organizations" such as personal electronic mail accounts, public digital data storage sites (cloud storage), social media platforms or instant messaging. Approved government sites such as U.S.

Army Aviation and Missile Research Development and Engineering Center (ARMDEC) Safe Exchange at https://safe.amrdec.army.mil/SAFE/About.aspx , or All Partners Access Network (APAN) at https://community.apan.org/ , or other transmission means determined by the government must be used.

1.6.18 Organizational Conflict of Interest (OCI): Contractor and subcontractor personnel performing work under this contract may receive, have access to, or participate in the development of proprietary or source selection information (e.g., cost or pricing information, budget information or analyses, specifications or work statements, etc.) or perform evaluation services which may create a current or subsequent Organizational Conflict of Interests (OCI) as defined in FAR Subpart 9.5. The Contractor shall notify the KO immediately whenever it becomes aware that such access or participation may result in any actual or potential OCI and shall promptly submit a plan to the

KO to avoid or mitigate any such OCI.
