RFI 0004
QUESTION 1.
Commence Work Definition: In section 00800, FAR 52.211-10 "Commencement, Prosecution, and Completion of Work", the solicitation documents state that "the Contractor shall be required to (a) commence work under this contract within 15 calendar days after the date the Contractor receives the notice to proceed…". There is no definition of what "work" is considered in the solicitation documents. Would the Gov't please clarify what constitutes work under this FAR clause?
GOVERNMENT RESPONSE: The solicitation, plans, and specifications define all work required.
QUESTION 2.
Allowed Dredge Type: In section 01 11 00, paragraph two of 1.1 "Work Covered by Contract Documents", and section 35 20 23, paragraph 3.5.1 "Dredge Equipment Requirements", the solicitation documents state "the dredged material shall be removed using mechanical dredge(s) capable of removing the ordinary and hard material as defined in this document, loaded onto scows, and towed to the disposal site locations." Will trailing suction hopper dredges (TSHD) be allowed to dredge and dispose of material on this Contract? If no, please provide a reason why they will not be allowed. If yes, will overflow of be allowed?
GOVERNMENT RESPONSE: As stated in the solicitation, the dredged material shall be removed using mechanical dredge(s). Trailing suction hopper dredges do not meet the solicitation requirements. The reasons for the Government’s requirements are not relevant to preparation of bids. Please bid in accordance with the solicitation.
QUESTION 3.
LNG Tanker Delays: In Section 01 11 00, paragraph 1.5(f), the solicitation documents state "Certain restrictions on vessel movement are in place when liquid natural gas tankers traverse the harbor. Delays in vessel movement of up to three hours per transit of liquid natural gas should be anticipated." Although the Contractor is to anticipate 3 hour delays per transit, the Contractor needs to know the frequency of LNG tanker transits in order to accurately anticipate delays of this nature. Will the Gov't provide an LNG transit schedule to allow the Contractor to accurately account for these delays or provide an additional line item for these delays to reduce the Contractor from including risk contingency in the price for these unknowns?
GOVERNMENT RESPONSE: The following historical information is provided for the information of potential bidders. The Government notes that historical information may not predict future activities. The bidder that is awarded the contract will be required to comply with the solicitation terms and conditions, including Section 01 11 00, paragraph 1.5(f). Based on records from the Coast Guard a total of 30 LNG tankers arrived in 2016 and current records indicate 25 have arrived so far in 2017. The frequency of these vessels depends on price of LNG and the time of year. Typically winter will have more frequent LNG tanker arrivals than the summer.
QUESTION 4.
FAA Restrictions: In Section 01 11 00, paragraphs 1.8.2.1 and 1.8.2.2, the solicitation documents state that "at any time the FAA may require the Contractor to stop work in the event of declining weather conditions that hinder visibility to the extent that the contractor's plant becomes a hazard to flying aircraft. This requirement applies to all areas in 1.8.2.1 and outside 1.8.2.2 of the critical area of work for of this contract." As this requirement has a high degree of unknowns, variability and even applies to outside the critical areas, it does not allow the Contractor to accurately price the costs of these shutdowns. Would the Gov't provide an additional line item for these shutdowns to avoid the Contractor from including risk contingency in the price for these unknowns or incorporate how many days per month the Contractor should expect?
GOVERNMENT RESPONSE: The following historical information is provided for the information of potential bidders. The Government notes that historical information may not predict future activities. The bidder that is awarded the contract will be required to comply with the solicitation terms and conditions, including Section 01 11 00, paragraphs 1.8.2.1 and 1.8.2.2. No shutdown for this reason was encountered during the entire maintenance dredging contract in 2017 or during the rock removal in 2012. Bidders are on notice that future FAA requirements may differ from such past activity. No separate line item will be included in the bid schedule for shutdowns of this nature.
QUESTION 5.
Height Restriction: In Section 01 11 00, paragraph 1.5(g), the solicitation documents state that "the maximum height of any equipment, shall be 155 feet above mean sea level (MSL). "Would the Gov't specify if this restriction applies to all dredge areas or only specific areas? Due to the approach and take off angles of aircraft, it would be logical that a higher maximum height can be allowed for dredge areas further from the airport (North Channel for example) as opposed dredge areas in the critical areas as specified in the plans.
GOVERNMENT RESPONSE: See revised height restrictions spec language of this amendment and FAA determination letters attached to this amendment.
QUESTION 6.
Existing Utilities: Will the Contractor be responsible for dredging above grade material around existing utilities that are within the specified dredging template as shown in the solicitation documents?
GOVERNMENT RESPONSE: The Contractor is responsible for dredging above grade material around existing utilities that are within the specified dredging template as shown in the solicitation documents. The HEEC cable in the reserve channel will be removed by others prior to dredging operations in that location.
All other utilities, with the exception of the new HEEC cable, will be in place during the dredging operations. The contractor is required to complete the dredging in the location of the new HEEC cable prior to its installation.
QUESTION 7.
Permits: Would the Gov't provide any and all permits, environmental impact statements, biological opinions, etc…that pertain to this solicitation that are not already included?
GOVERNMENT RESPONSE: FAA determination letters are attached to this amendment. In addition the environmental coordination effort for this project can be located at:

The plans and specifications have been designed to comply with the requirements of FINAL SUPPLEMENTAL ENVIRONMENTAL IMPACT STATEMENT
AND MASSACHUSETTS FINAL ENVIRONMENTAL IMPACT REPORT.
QUESTION 8.
No Spud Zones: The plans show there to be "NO SPUD ZONE" areas on various sheets. Will the Contractor be allowed to place anchors in these areas?
GOVERNMENT RESPONSE: No spuds or anchors will be allowed in these areas, please see revised specification section 35 20 23, 1.1.2.
QUESTION 9.
The Bidding Schedule includes Optional Item 0008 Subsurface Drilling and Sampling. Will this Option be exercised to confirm that the dredging contractor has removed all of the Hard Material down to the surface of Fast Rock? If subsurface drilling and sampling indicates that all of the Hard Material has not been removed, will the dredging contractor be required to remove the remaining Hard Material with equipment capable of removing the Hard Material?
GOVERNMENT RESPONSE: Optional Item 0008 may be exercised in accordance with the terms of the solicitation. The contract requires that all hard material be removed to grades shown on the contract drawings. If Optional Item 0008 is exercised and the borings show that material in an area is hard, the contractor will be required to return to that location and remove the material.
QUESTION 10.
The Contract Drawings indicate locations where the dredging contractor will encounter Hard Material. Will the horizontal limits of these areas change based on the observations of the Geotechnical Engineer/Geologist?
GOVERNMENT RESPONSE: The statement preceding this question does not accurately reflect the solicitation requirements. Please refer to specification section 35 20 23 subparts 1.6.1, 1.6.2 and 3.5.1 to understand how the Government has described the project site. Please refer to revised section 1.6.2 to understand how the Government has described the horizontal reach of subsurface conditions. As stated in the specification, local variations in the subsurface materials are to be expected and, if encountered, will not be considered materially different within the purview of the contract.
