QUESTIONS & ANSWERS 5 JUN 18

Questions and answers to Solicitation W912PQ-18-Q-9002 5 June 2018

Q- In amendment 0001 the basis for award includes the requirement to “Describe your management approach, personnel required, and system design to integrate strength and conditioning, physical therapy/injury management, and orthopedic manual physical therapy into a HPO program providing the services identified in PWS section 5. Identify how your approach, personnel, and design will accomplish the objectives identified in PWS paragraph 1.2.” as Sub-Factor 2. 1-Please confirm this requirement is applicable to this solicitation as the requirement for strength and conditioning, physical therapy/injury management, and orthopedic manual physical therapy is not typically related to Logistic Support Services, and there is nothing regarding these requirements identified in PWS section 5. 2-Also, this sub-factor requires an approach, personnel, and design for meeting objectives identified in PWS paragraph

1.2. However the PWS paragraph 1.2 is the background regarding the requirement and does not specifically identify any objectives. Please confirm this is the applicable PWS paragraph.

A- The solicitation concerning the basis of award, FAR Clause 52.212-2 Evaluation – Commercial Items have been corrected and published to this amendment to reflect the proper PWS.

Q-Is this a new requirement? If not please provide the incumbent award information.

A- No, currently performed by Darkblade Systems Corporation for a period of 3 months ending 29 Jun 18.

Q- Please provide the Statement of Equivalent Rates for Federal Hires. SCA regulations require contractors to provide PTO to employees in SCA positions based on time in the job, including previous contracts. Would the government please provide incumbent FTE's anniversary dates to allow offerors to include this in our pricing?

A- The Statement of Equivalent Rates for Federal Hires has been incorporated into the solicitaion as FAR clause 52.222-42. The last two incumbent information is as follows: W912PQ-17-F-0134 TDB Communications 1 Sep 17 to 28 Feb 18 and W912PQ-18-P-9005 Darkblade Systems Corp 27 Mar 18 to 22 Jun 18.

BASIS FOR AWARD

Award will be made to the proposal that is evaluated as Lowest Price Techically Acceptable. See FAR 52.212-2 Evaluation - Commercial Items.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

The Government will use the results of Lowest Price Technically Acceptable as the evaluation process of its award decision. The selection process will determine the overall merits of each proposal in terms of its potential to best satisfy the needs of the Government. A rating of no less than “Acceptable” must be achieved to be considered for award in the Technical and Price proposal being reasonable, complete and balanced. Option periods pricing will also be included in the evaluation.

The absence of any information required to support the Technical factors herein and as described below will result in disqualification from the competition, as that offer will be found non-responsive and unacceptable.

The Government reserves the right to award a contract without discussion.

Cost/price evaluation will include an analysis of the total price to perform the required work. The total cost/price supplied by the offeror shall be provided in accordance with the Provision at 52.212-1, Instructions to Offerors—Commercial Items, and shall constitute the total firm fixed-price for the services described by the Performance Work Statement (PWS).

Proposals that are unrealistic in terms of technical commitment or unreasonably low or high in cost/price will be deemed reflective of an inherent lack of technical competence or indicative of failure to comprehend the complexity and risk involved in the contract requirements and may be grounds for rejection of the proposal.

1 Evaluation Criteria Contractor selection will be based on evaluation of proposals in accordance with the responses received to the criteria outlined in PWS. Award will be made to the proposal that is evaluated:

- Technical Evaluation: Rated as “Acceptable”

- Past Performance Evaluation: Rated as “Acceptable”

- Price Evaluation

The Government reserves the right to reject any or all proposals received and/or request clarification of proposals. The Government also reserves the right to determine a competitive range for negotiation based upon the technical and cost/price acceptability of proposals. In addition, the Government reserves the right to award a contract without discussion.

Cost/price evaluation will include an analysis of the total cost/price to perform the required work. The total cost/price supplied by the offeror shall constitute the total firm fixed-price for the services described by the Performance Work Statement (PWS).

Proposals that are unrealistic in terms of technical commitment or unreasonably low or high in cost/price will be deemed reflective of an inherent lack of technical competence or indicative of failure to comprehend the complexity and risk involved in the contract requirements and may be grounds for rejection of the proposal.

2 Evaluation Factors

2.1 Technical Evaluation

Technical proposals will be initially evaluated with respect to three (3) sub-factors for determination of the competitive range. In determining the competitive range, each Technical Proposal shall be assign an adjectival rating of “Acceptable” or “Unacceptable” as illustrated in Table 1 (below). In order to attain an

“Acceptable” Technical Rating, each of the sub-factors below must have been evaluated as “Acceptable”.

1. Sub-Factor 1: Qualifications of proposed personnel are adequate for accomplishing all requirements of the PWS.

2. Sub-Factor 2: Operations support plan clearly demonstrates the offeror’s overall technical approach and proposed methodology to adequately support the Government’s mission. The

Operations Support Plan shall clearly demonstrate the offeror’s understanding of the scope of work and the requirement.

3. Sub-Factor 3: Quality Control Plan.

Those offerors whose proposals are determined to be “Unacceptable” will be excluded from further consideration.

Table 1, Technical Proposal Ratings

Adjectival Rating Description

Acceptable Proposal meets the requirements of the solicitation.

Unacceptable Proposal does not meet the requirements of the solicitation.

2.2 Price Evaluation

Proposals rated as “Acceptable” will be evaluated to determine the reasonableness of the proposed price.

Unrealistic offers cannot be selected for award.

Each proposal’s cost/pricing proposal shall be evaluated on a “Realistic” or “Unrealistic” basis. Those offerors whose proposals are determined to be “Unrealistic” will be excluded from further consideration.

This requirement contains the FAR Clause at 52.217-8, Option to Extend Services. Circumstances may arise that require the Contracting Officer to utilize FAR 52.217-8, Option to Extend Services, upon the performance end date of Option Period Four, for no more than six (6) months. Pricing for an additional six (6) months will be evaluated based off of pricing proposed for Option Period Four by adding one-half of the offeror’s final option period price to the Offeror’s total price. Thus, the Offeror’s total price for the purpose of evaluation will include the Base Period, 1st, 2nd, 3rd, 4th, and ½ of the 4th option. Inclusion of this clause shall not obligate the

Government to exercise the options.

2.3 Past Performance Evaluation

In evaluating Past Performance, the Government will evaluate the quality, timeliness, and safety of the offeror’s past performance considering currency, relevancy, sources, context, and trends on recent (within the past five years). Also, evaluations available through the Past Performance Information Retrieval System (PPIRS) may be used. An adjectival rating of “Acceptable” or “Unacceptable” will be assigned to each offeror’s past performance as illustrated in Table 2 (below). In order to attain an “Acceptable” past performance rating, the offeror’s past performance should indicate that their efforts under present or previous requirements were acceptable.

In the context of an acceptability/unacceptability, an offeror without a record of relevant past performance, or for whom information on past performance is not available or is so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be rated favorably or unfavorably. In such circumstances, the offeror shall be determined to have unknown (or “neutral”) past performance and shall be considered

“Acceptable”.

Table 2, Past Performance Evaluation Ratings

Adjectival Rating Description

Acceptable

Based on the offeror’s performance record, the

Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.

Unacceptable

Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
