**The unit "JOB" as used in this Bidding Schedule is synonymous with the term "Lump Sum" used elsewhere within these plans and specifications.

Award will be made as a whole to one bidder.

NOTE 1: Bidders shall furnish unit prices for each item listed in the Schedule requiring a unit price. If the bidder fails to insert a unit price in the appropriate blank for required item(s), but does furnish an extended total, or an estimated amount for such item(s), the Government shall deem the unit price to be the quotient obtained by dividing the extended amount for that line item by the quantity. IF A BIDDER OMITS BOTH THE

UNIT PRICE AND THE EXTENDED TOTAL OR ESTIMATED AMOUNT FOR ANY

ITEM, ITS BID SHALL BE DECLARED NON-RESPONSIVE AND THEREFORE

INELIGIBLE FOR AWARD.

NOTE 2: Any bid may be rejected if the Contracting Officer determines in writing that it is unreasonable as to price. Unreasonableness of price includes not only total price of bid, but the price for individual line items as well. Any bid may be rejected if the prices for any line items or sub line items are materially unbalanced (See FAR 14.404-2, Rejection of Individual Bids).

NOTE 3: THE NOTICE TO PROCEED (NTP): The successful bidder is advised that performance and payment bonds shall be submitted in accordance with the time frame in block 12B of SF 1442. The NTP will be issued immediately after verification of acceptable performance and payment bonds. Within seven (7) days after issuance of the NTP, the Contractor shall initiate a meeting to discuss the submittal process with the Area or Resident Engineer or his authorized representative. Physical work cannot start until the Accident Prevention Plan, Contractor Quality Control Plan, and other submittals which may be required, have been submitted and approved and all preliminary meetings called for under the contract, have been conducted.

NOTE 4: RAPID VENDOR PAYMENT: Web based instructions for the submission of invoices;

NOTE 5: OPTIONAL WORK ITEMS. The Government may require the delivery of the numbered line item(s), identified in the schedule as OPTIONAL WORK Items, in the quantities and prices stated in the schedule. The Contracting Officer may exercise the OPTIONAL WORK Items by written notice to the Contractor no later than 90 calendar days after issuance of the Notice to Proceed (NTP). The Government will exercise the Temporary No Work Areas (TNWA) at the pipeline corridors no later than 120 days after issuance of the Notice to Proceed (NTP). Bidders shall bid on all items including optional items (see “Evaluation of Options” FAR 52.217-5). Failure to bid on all items will result in a non-responsive bid.

NOTE 6: EVALUATION OF OPTIONS (FAR 52.217-5 JUL 1990). Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for this basic requirement.

Evaluation of options will not obligate the Government to exercise the option(s).

** If an option is to be exercised at the time of contract award FAR17.208 shall be used in place of FAR 52.217-5.

NOTE 7: TIME ADJUSTMENT IN THE EVENT OF THE EXERCISE OF

OPTIONAL WORK. In the event that OPTIONAL WORK items are exercised under the terms of this contract, the time required for completion of the contract will not be adjusted, but the Optional Work shall be performed concurrently with the contract duration of 365 calendar days established for the BASE WORK items specified in the Contract Clause entitled “COMMENCEMENT, PROSECUTION, AND COMPLETION

OF WORK (FAR 52-211-10 – APR 1984)”.

00010-8 Ed 20-019

After the crushed stone access road is complete, the Contractor shall mill 3-inches and overlay the 150-feet of asphalt paving off I-10 prior to placing asphalt on the roadway. The new asphalt road entrance to Access Road “F” and the boat launch area shall be constructed first followed by the removal of the existing asphalt entrance.

22. SPECIAL WORK REQUIREMENTS

a. Weight Restrictions/Road A Entrance Only. During construction of the access roads over the pipeline crossings, only one (1) vehicle or equipment at a time will be allowed to cross over the entire width of the pipeline crossings with the following maximum load restrictions:

(1) 20,000 pounds per axle for single axle loads;

(2) 34,000 pounds per axle for tandem axle loads; or

(3) 72,000 pounds total weight.

The Contractor shall have supervision at the pipeline crossings to limit the vehicles and equipment as specified above.

b. Required Flagmen. During times when the use of Access Roads B and C increase related to cultivation of sugar cane on adjacent fields, the Contractor shall employ a flagger at Airline Highway and along the access road to ensure vehicles and equipment associated with WSLP Construction and sugar cane cultivation both safely use the roadway. The Contractor shall coordinate their use of the access roads with the sugar cane farmers.

c. The Contractor, including employees and subcontractors, shall not hunt and fish within the right-of-way provided for construction.

QUESTION AND ANSWER

Questions and Answer

1) W912P821B0047 - Does a bench loop need to be run between all controls shown in drawings G-002 and G-003? (Question)

USACE’S RESPONSE: No, the contractor shall comply with benchmark spec and utilize three project controls for each access road being constructed.

2) W912P821B0047 - We respectfully request quantities for lump sum items on the bid schedule? (Question)

USACE’S RESPONSE: Lump sum quantities will be provided

3) W912P821B0047 - FAR 52.236-16 Quantity Surveys – The clause states that the Contractor performs original, final, and progress surveys. It also states (paragraph b) that the Government calculates quantities for payment. Is this accurate? The contractor performs original surveys, provides data to the Government who then calculates quantities based off of the Contractor’s data. (Question)

USACE’S RESPONSE: There is FAR language discussing payment calculations that are in every contract. There are no line items in this contract to be calculated for payment based on surveys, tonnage quantities will be based on truck tickets.

4) W912P821B0047 - Are existing pipelines identified on the drawings and in specification sections 01100-11 and 01100-12 bridged? If not, does the Contractor need to build permanent crossings? (Question)

USACE’S RESPONSE: On access roads B and G existing timber mats are shown on the drawings to be removed and become the property of the contractor. The Contractor shall adhere to requirements in Section 01100, paragraph “UTILITIES AND IMPROVEMENTS”. Yes, permanent roadways are to be built over the pipelines according to the plans, sheets DT-111 and DT-112.

5) W912P821B0047 - Is embankment material available from the Spillway stockpile projects? (Question)

USACE’S RESPONSE: No. The Government is not providing a site within the spillway for sand as part of the solicitation, but the contractor can request to utilize the Spillway as a source of sand by contacting John Fogarty at 504-862-1227. If the contractor elects to utilize the Bonnet Carre Spillway they do so at their own risk should they experience impacts from flooding of the spillway.

W912P821B0047

6) W912P821B0047 - Does the Staging Area chain link fencing need to follow the 32 31 13 specification sections for permanent fencing? (Question)

USACE’S RESPONSE: No, it shall be six feet high with locked gates.

7) W912P821B0047 - Is silt fencing to be installed along side of each of the access roadways? Plans only show silt fence locations at each driveway entrance and one run along Access Road G on the I-10 side. (Question)

USACE’S RESPONSE: No, silt fence is only to be installed at the entrances and along Access Road G on the I-10 side as shown.

8) Currently, the bids for the above referenced solicitation are due Tuesday July 6, which is the day after the observance of the 4th of July (July 5th). Would the Government consider extending the date a couple days, as many subcontractors and specialty trade contractors will also be closed for the holiday. As it stands, subs typically don’t provide numbers until the very close to the date bids/proposals are due, and with the holiday the day before, it is likely competitive pricing won’t be received. (Question)

USACE’S RESPONSE: Yes, bid opening date will be established in amendment 0002.

9) Regarding Document W912P821B0047, Section 01100-6, Page 94, Inspectors Field Office with all Amenities, Utilities, Phone & Internet: are all utilities, water, electricity, sewer, phone, internet etc. at end of Road F, or does it all have to be self-contained? (Question)

USACE’S RESPONSE: The contractor is responsible for visiting the site and verifying the availability of public utilities.

10) Regarding Sheet C-125 Road F, Transition from Concrete Entrance to Aggregate Road, C-125, Is F Road entrance @ HWY 61 concrete paving and asphalt? (With DEMO existing asphalt where new asphalt is going? (Question)

USACE’S RESPONSE: The new entrance is asphalt. After the installation of the new entrance, the existing entrance at the highway is to be removed. The word concrete will be removed by amendment.

11) Sheet C-120 & C-122 plans show no scales. Should we assume 1” = 60 feet as the other F roads? (Question)

USACE’S RESPONSE: Correct, same scale. This will be corrected via amendment.

12) Regarding CMP Table Sheet DT 106, Page 38, there are no specs for additional culvert LF/BE-1 on C-105 and C-112. (Question)

W912P821B0047

USACE’S RESPONSE: The culvert info for BE-1 is shown on sheet DT-104. On sheet, C-112 CC5 has been mislabeled, it should be CC4 and is included in the table on DT-106. This will be corrected via amendment.

13) Regarding the dewatering specs, page 422, in order to maintain dry working conditions, will centrifugal pumps with suction/discharge suffice in place of well points, wells or jet eductors? (Question)

USACE’S RESPONSE: Yes, provided the pumps provide dry working conditions.

14) Where will concrete at 3000 PSI be implemented other than fencing and signage?

USACE’S RESPONSE: No where else.

15) Regarding Road F/C-124, Page 29, we understand that the Contractor is to remove and haul off trash in ROW-Road F, are there other roads with trash on the ROW to load and haul off as well that are not called out on plans? (Question)

USACE’S RESPONSE: All locations of debris to be removed have been called out on the plans

16) On sheet C-139, page 13, the document scale reads 1”=200’, we are calculating a 1”=50’ scale, please clarify. (Question)

USACE’S RESPONSE: The scale on this sheet will be corrected by amendment.

USACE’S RESPONSE: Will provide a location map of borings via amendment.

18) On sheet C-109, it’s calling to relocate a ditch on sheet DT 103. There is no sheet DT-103, please clarify. (Question)

USACE’S RESPONSE: This callout should refer to sheet CS-106, this will be corrected via amendment.

19) Regarding the stone base aggregate for the roads, can we use crushed concrete on roads if it meets same PI as specs for aggregate? (Question)

USACE’S RESPONSE: No.

W912P821B0047

20) Will burning be allowed on site for trees, or do they have to be cut up and hauled off? (Question)
