QUESTIONS AND ANSWERS

Dale Hollow Freight Elevator Modernization

Solicitation - W912P518B0007 Amendment 0002

1. On Sheet Q-3 755.1 there’s a reference for a doweling location for a flood proof door. Please advise as to the specifications for the flood proof door including water protection height.

A: Flood proof door is not included in this contract. Drawings are provided for reference as indicated on the cover sheet to show the existing equipment and structure so that the new elevator can be designed to match the retaining equipment and existing structure. These reference drawings also assist contractor with the demolition plan. “For Reference Only” water mark shall be added to the drawing package.

2. Do we have to bid the total bid package?

A. Yes.

3. The package states asbestos abatement then states not having to do asbestos abatement. Which is it?

A: Asbestos abatement is required. See Section 02 82 14 – Asbestos Abatement work and Section 01 95 00 - Forms and Attachments for locations of equipment with asbestos and the asbestos analysis report.

4. Do we need to pull a confined space permit?

A: The pit is not labeled as a confined space. It is the bidder’s responsibility to reference the latest edition of the USACE EM 385-1-1 Safety & Health Requirements Manual to determine what is required when performing the work.

5. Fire Alarm. (a) How will that be done and coordinated? (b) Who does the monitoring? (c) Will we have to provide smoke alarms and wire to the annunciator? (d) Is the annunciator expandable?

A: Elevator Operation and Maintenance is performed by plant personnel. Service and Inspections are done through competitive bid. Currently there is no fire alarm system, the existing smoke detectors and initiating devices are tied into the elevators fire service and the projects annunciation system. Fire Alarm device requirements are listed in the Technical Specifications. Smoke Detectors requirements are listed in the Technical Specifications. See Section 14 21 13, par. 2.3.5 – Smoke Detectors. Submit shop drawings of fire alarm system in accordance with Section 14 21 13 for approval.

a. Currently there are smoke detectors at each landing with conduit and wiring leading up to machine room controls. A new system will have to be installed in accordance with current codes.

b. There is no traditional monitoring of the fire alarm system ( a dialer will not be required) all we need for monitoring will be a dry contact off the new fire alarm system and wire to the annunciator system located in the spread room on the 2nd level ( the elevator machinery room is on the 4th level).

c. The existing smoke detectors are over 10 years old and will need to be replaced and new wire pulled.

d. The Annunciator is expandable, but the wiring and programing of the annunciator will be done by plant personnel.

6. Are the hoistway rails to be demolished?

A: Guide rails for car and counterweight shall be replaced per section 14 21 13 – Electric Traction Freight Elevators, Paragraph Car and Counterweight Guide Rails and Fastenings. Items to be replaced include T-rails, T-rails clips, shims and fasteners for rails and clips. T-rail support brackets and anchor bolts shall be retained.

7. To confirm, is there lead paint on this project?

A: A survey was contracted and no lead paint was found in any of the equipment associated with the elevator. See Lead paint report in Section 01 95 00 – Forms and Attachments for details.

8. Do we need to provide dumpsters onsite?

A: Reference Section 01 57 19 paragraph 1.9.2(f) and 3.4.1; the Contractor is required to provide a plan for disposal of all waste and ensure that all Local, State, and Federal Regulations are followed.

9. What is floor finishes?

A: Old car- Mastic tile New car- See Section 14 21 13 – Electric Traction Freight Elevators, Paragraph Floor Platform.

10. What distinguishes hot work?

A: OSHA defines “hot work” as any activity such as but not limited to welding, cutting or grinding that produces flame or sparks that could ignite surrounding materials.

11. Do we need to salvage the existing elevator equipment for the COR?

A: Per section 02 41 00 paragraph 3.2.3(b) - the only item to be returned to the plant will be the over speed governor and its accessories. All other items are to be disposed of by the contractor.

12. Can we provide our schedule using Microsoft Project?

A: Any project software selected for use by the Contractor must comply with the Project Schedule requirements in Section 01 32 01.00 10 of the specifications. In general, any project software used by the Contractor must provide the Government with a useable and readable Gantt Chart.

13. Is Elevator Controls acceptable with their tape (Pixel) selector in lieu of encoder on the governor?

A: Yes, Pixel Elevator Control System with non-contact tape is acceptable.

14. The current elevator machine room is located in an area where non-elevator equipment is located which does not meet current ASME A17.1 standards. Are we to assume current machine room conditions will remain as existing or will we be required to construct an enclosed room for the elevator equipment, and if so what is the scope and requirements for the construction of this room outside of the requirements set forth in current ASME A17.1 codes?

A: The current machine room conditions shall remain as existing. No new enclosed room will need to be constructed for the machine room.

15. Is an air-conditioned controller cabinet acceptable in lieu of installing an HVAC system in the machine room?

A: Air-conditioned controller cabinets are acceptable. Ensure panel is properly ventilated to prevent condensation from building up and/or provide an active condensate evaporation system. Condensate can be piped to existing condensate drain. Provide high and low refrigerant cut-outs with fault indication. Section 01 78 23 paragraph 1.5.1.9.

16. Per Section 2.10.1 (Hoistway Equipment; Car and Counterweight Guiderails): Specifications call for car and counterweight guide rails to be replaced. At the pre-bid meeting it was stated that the rail brackets were to be retained. Can you clarify the scope of that section to exactly what components are to be replaced and what is to be retained?

A: Guide rails for car and counterweight shall be replaced per section 14 21 13 – Electric Traction Freight Elevators, Paragraph Car and Counterweight Guide Rails and Fastenings. Items to be replaced include T-rails, T-rails clips, shims and fasteners for rails and clips. T-rail support brackets and anchor bolts shall be retained.

17. Per Section 2.2.7(f) a heat detector is to be installed in the Machine Room. Please clarify that will be the only fire recall initiating device required and that a smoke detector is not desired and not suitable for that location.

A: The space is ventilated and enclosed, please provide a combination heat/smoke detector per section 14 21 13 paragraph 2.2.7(f).

18. Per Section 2.3.5 specifications call for dual contact smoke detectors with direct connections to elevator controls or an addressable fire alarm system to initiate fireman’s recall. Section 2.2.7 calls for a Ten Zone fire control panel. Please clarify requirements of the new fire alarm system to be installed.

A: Per Section 14 21 13 paragraph 2.2.7(a) – Contractor is required to furnish and install a Ten Zone Fire Control Panel. Provide UL listed combination smoke/heat detectors. There are existing smoke detectors that operate the elevator fire recall, but these detectors as well as the wire will have to be replaced. There is no existing fire alarm system. There needs to be one zone for each initiating device.

19. We were advised the asbestos abatement should be limited to the floor of the existing elevator. Are there any other areas that may require abatement? May we abate the floor off-site assuming we can remove the floor without disturbing the asbestos?

A: Asbestos abatement is required. See Section 02 82 14 – Asbestos Abatement work and Section 01 95 00 - Forms and Attachments for locations of equipment with asbestos and the asbestos analysis report. There is also asbestos present in the brake shoes of the motor brake. Floor and brake shoes can be abated off-site as long as the floor and brake shoes can be safely removed. Provide asbestos plan and waste shipment record per Section 02 82 14 for approval.

20. The specifications reference ASME 17.1 which requires the machine room to be enclosed in a machine room with door, lighting, and ventilation. Will this room construction be required? Will the specifications be updated to include the requirements of its construction?

A: No, please see the answer to Question 14.

21. What is the scope of the ventilation required if the room is not constructed? Will a small unit made part of the control cabinet be acceptable as we have done this at other USACE facilities? If so, where should the condensate be piped too?

A: It is not required to construct a new machine room. Air-conditioned controller cabinets are acceptable. Ensure panel is properly ventilated to prevent condensation from building up and/or provide an active condensate evaporation system. Condensate can be piped to existing condensate drain. Provide high and low refrigerant cut-outs with fault indication.

22. If the room is not constructed, will we be required to replace all existing lights with LED fixtures?

A: No. Machine room lighting is not in the Scope of Work for this contract.

23. Will a sump pump be required at the bottom of the pit? If so should it be able to detect oil? Where should the drain be connected?

A: A sump pump is not required for this contract.

24. Do we need to install an exhaust fan in the top of the shaft for ventilation or do we need to provide exhaust for the entire penthouse space?

A: Exhaust fans in the top of the shaft is not required for this contract.

25. Is there an existing fire alarm system in the building? If so, who is the manufacturer?

A: There are existing smoke detectors that operate the elevator fire recall, but these detectors as well as the wire will have to be replaced per Section 14 21 13 paragraphs 2.2.7 and 2.3.5. There is no existing fire alarm system.

26. To provide the 110 volt power for the elevator service do we need to provide a high voltage panel, a step down transformer and low voltage panel, or can we connect to existing service? If so, please show where we can connect to 110 volt power.

A: Provide a new step down transformer (480 Volt to 120 Volt) with panel. Separate 480V and 120V panels are not required. Clearly label voltages in the panel. (ex. LC2 Panel 480/120V) in accordance with Section 26 20 00 paragraph 2.14.1.

27. Will shunt trip breakers be required as there is no sprinkler service in the shaft?

A: No.

28. Is there adequate clearance at the top of the elevator shaft and in the pit to meet current code requirements?

A: Per Section 14 21 13 paragraph 1.7.1; it is the contractor’s responsibility to verify and provide clearance dimensions in the shop drawings. It is not in the scope of work to modify the clearance from the top of the elevator shaft to the pit.

29. Will we be required to install materials such that nothing can be stored on the ledges in the elevator shaft?

A: No need to install any barriers on the elevator shaft ledges.

30. Please confirm NEMA 3R rated switch gear will meet the intent of the specification.

A: NEMA 3R is acceptable to meet the intent of the specifications.

31. We are assuming that the existing grounding is acceptable for the new equipment, please confirm.

A: Existing grounding exists throughout the plant and in the machinery room. If; during construction, it is found that isolated grounding is needed, the Contractor should bring it to the attention of the Contracting Officer’s Representative and the Contracting Officer.

32. Is there an existing dedicated phone line available to connect the remote dialer to the phone service? The remote dialer will occupy one phone line constantly.

A: If the remote dialer is in regard to the fire alarm then it will not be needed, as the input to the annunciator is all that is needed. A dialer on the fire alarm system will not be required. If this is in relation to the elevator controller then this will probably not be acceptable because of cyber security concerns.

33. We were advised on site that the existing rails and brackets would not be replaced, but the specifications call for their replacement. Can you confirm these brackets that connect the rails to the structure will remain?

A: In accordance with Section 14 21 13 paragraph 1.3; T-rail support brackets and anchor bolts shall be retained.

Brackets that connect the rails to the structural will remain.

34. No information is provided in the specifications regarding the elevator machine beams. Can you confirm the existing beams will remain or will they need to be replaced?

A: Elevator machine beams will remain. See section 14 21 13 paragraph 1.3.

35. A 280 day construction period is allowed from NTP. We anticipate approximately 105 days to fabricate the elevator and 98 days to complete installation. This would leave about 77 days for submittal approvals. Will this period be modified for an extended approval process?

A: Bid as specified in the Solicitation.

36. Slide shoes will be required to install the elevator, but the specifications call for roller guide assemblies.

Can you confirm slide shoes will be permitted?

A: Slide shoes shall be permitted. See Section 14 21 13 paragraph 2.8.1.

37. Please confirm that the counterweight will be retained.

A: Per Section 14 21 13 paragraph 1.3; the Counterweight frame and filler weights will be retained. Other accessories shall be replaced in accordance with the contract specifications. Contractor shall add or remove filler weight to make sure that the total weights (frame and fillers) shall be the same as the net car weight plus 40% to 50% of the car capacity.

38. The specification requires a full time CQC manager. In addition to QC personnel for elevator, electrical and mechanical and QC Clerk. (a) Does the QC Clerk have to reside on site or can they work remotely from the home office? (b) Does the QC personnel for elevators, mechanical and electrical have to reside on site during all applicable work or can they make periodic inspections during each week and coordinate directly with the CQC manager?

A: Per Section 01 45 00 paragraph 3.4.3:

(a) The Submittal Clerk may be offsite as long as the onsite QC staff is capable and maintains all necessary paperwork having it readily available onsite for the COR and QAR to review when asked.

(b) It is recommended that; as long as there is ongoing work on site which pertains to Electrical and Mechanical, both of the QC personnel be physically present at the installation site during work on their areas of responsibility, e.g. - present for inspections, preparatories, etc.

39. Due to the scope of work and potential subcontracting costs, will a bid an amount over the $250K - $500K Range of Magnitude (ROM) be considered for award?

A: Yes, bids exceeding the ROM will be considered for award. Per FAR 36.204, Disclosure of the Magnitude of Construction Projects, advance notices and solicitations shall state the magnitude of the requirement in terms of physical characteristics and estimated price range. Accordingly, the ROM represents the estimated price range for the construction requirement. Therefore, bidders are not limited to submitting a bid with a price within the advertised ROM ($250,000 - $500,000). However, it should be noted, per USACE Acquisition Instruction 5136.205-100, the Government is statutorily prohibited from making an award for a civil works-funded construction contract when the contract price exceeds the Independent Government Cost Estimate by more than 25%.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year. Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).

Union Rate Identifiers

A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example: PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1,2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination.

5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.

Survey wage rates are not updated and remain in effect until a new survey is conducted.

Union Average Rate Identifiers

Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)and 3.) should be followed.

With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations.

Write to:

Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7).

Write to:

Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.

3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:

Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

4.) All decisions by the Administrative Review Board are final.
